Autor prezentowanego opracowania podejmuje kwestię relacji pomiędzy Kantonem Vaud (Waadt) a Kościołami i związkami wyznaniowymi. Analizując przepisy Konstytucji federalnej Konfederacji Szwajcarskiej z 18 kwietnia 1999 r. i ustawy zasadniczej Kantonu Vaud z 14 kwietnia 2003 r. oraz inne akty prawa regulujące sprawy natury religijnej, ustala on zasady określające sytuację prawną poszczególnych Kościołów i związków wyznaniowych, wykonujących swe funkcje na terenie Kantonu Vaud. Przeprowadzona analiza obowiązujących przepisów prawa wyznaniowego w zakresie wspomnianych relacji pozwala wysunąć następujące konkluzje natury ogólnej: • System prawa w zakresie regulacji relacji Państwo-Kościoły i związki wyznaniowe, przyjęty w Konstytucji Kantonu Vaud z 14 kwietnia 2003 r. nie ma charakteru nowatorskiego; znaczna część kantonów współtworzących Konfederację Szwajcarską przyjmuje dzisiaj właśnie taki sposób określenia sytuacji prawnej poszczególnych społeczności religijnych. • Zasady prawne przyświecające przyjęciu wspomnianego systemu z jednej strony pozwalają uszanować zasadę pozytywnej laickości Państwa, z drugiej zaś przyznają oficjalnie uznanym wspólnotom religijnym stosowną swobodę w zakresie określenia ich ustroju i realizacji działalności religijnej. • Aktualna regulacja sytuacji prawnej Kościołów i związków wyznaniowych, przyjęta w prawodawstwie Kantonu Vaud, jest wyrazem zapoczątkowanej w II połowie XIX w. oraz systematycznie pielęgnowanej tradycji tolerancji kulturowej i religijnej. Naczelnymi zasadami przyjętego systemu prawnego w zakresie regulacji kwestii religijnych są: wolność sumienia i wyznania, uznanie istotnej roli społeczności religijnych w zakresie kształtowania relacji społecznych i upowszechniania podstawowych wartości ludzkich, pokojowe współistnienie przedstawicieli różnych wspólnot religijnych.

The author of the study reviews the problem of relations among Canton Vaud (Waadt), the Church and other religious associations. By examining the provisions of the Federal Constitution of the Swiss Confederation of 18 April 1999 and the Constitution of Canton Vaud of 14 April 2003 as well as other legal acts regulating religious matters, the author isolates the principles that govern the legal statuses of individual churches and denominations functioning in the Canton of Vaud. The analysis of the law on denominations with regard to these relations leads the author to the following generic conclusions: • The legal system pertaining to the relations among the state, Church and other denominations adopted in Canton Vaud in 14 April 2003 cannot be perceived as novel; the majority of cantons composing the Swiss Confederation adhere to this method of defining the legal situation of individual religious communities. • On the one hand, the legal principles governing the aforesaid system respect the positive secularity of the state; on the other, the officially recognized religious groups are free in proposing their own internal organization scheme and method of religious activity. • The current regulation of the legal situation of churches and religious associations adopted in the legislation of Canton Vaud is the continuation of a well-preserved, mid-19th century tradition of cultural and religious toleration. The prime principles of the binding legal system associated with religious matters are: freedom of conscience and religion, the recognition of a crucial role of religious communities in the shaping of social relations and promotion of fundamental values, harmonious coexistence of the followers of different religious groups.
