Jádrem úvahy v tomto článku jsou především systémové otázky soukromého práva a jeho schopnost čelit zásahům do jeho koherence. Autoři věnují pozornost významným rizikovým faktorům historické, doktrinální povahy i faktorům vyplývajícím ze současného praktického vývoje (soukromým) právem regulované reality i odpovídajícího vývoje samotného práva. Řešení vidí v návratu ke specifikaci kritéria vyjadřujícího podstatu a funkční potenciál základních typových přístupů k právní regulaci.

The submitted paper focuses mainly on the questions of the system of private law and on its ability to resist the infringement of its coherence. The authors pay their attention to the significant risks of its historical and doctrinal nature and also to the risk arising from the contemporary developments not only in practice but also (regulated by private law) with the corresponding development of law itself. The solution can be seen in the return to the discussion about the criterions distinguishing between private and public law and expressing both the nature and functional potential of types of the approaches to the legal regulation.
