W artykule przedstawiono problematykę zwolnień od pracy i nauki celem uprawiania kultu religijnego, przypadającego w każdym tygodniu w dniu innym niż niedziela. Autor wykazał, że zgodnie z ustawą z 30 czerwca 1995 r. o stosunku Państwa do Kościoła Adwentystów Dnia Siódmego w Rzeczypospolitej Polskiej wyznawcom tego Kościoła przysługuje zwolnienie od pracy i nauki w dniu ich święta, czyli w sobotę (szabat, szabas), podobnie zresztą jak wyznawcom gmin żydowskich w świetle ustawy z 20 lutego 1997 r. o stosunku Państwa do gmin wyznaniowych żydowskich w Rzeczypospolitej Polskiej. Wszelkie przypadki odmowy zwolnienia od pracy w sobotę (szabat, szabas) czy też nauki, m.in. poprzez wyznaczanie egzaminów lekarskich, jak i prawniczych dla wyznawców Kościoła Adwentystów Dnia Siódmego w Rzeczypospolitej Polskiej w dniu ich święta, byłyby działaniem contra legem nie tylko w świetle ustawy o stosunku Państwa do Kościoła Adwentystów Dnia Siódmego w Rzeczypospolitej Polskiej, ale również ustawy zasadniczej, a ponadto regulacji prawa europejskiego i międzynarodowego. Analogiczne stanowisko prezentuje także orzecznictwo i doktryna.

The article presents a problem of a day off from work and learning to worship everyday but Sunday. The author pointed out that according to the Act of 30 June of 1995 on The relation of the State and the Seventh-day Adventist Church in the Republic of Poland, the followers of this Church are entitled to a day off from work and learning on the day of their holiday – on Saturday (Sabbath), similarly to the followers of Jewish community in the light of the Act of 20 February 1997 on The Relation of the State to the Jewish community in the Republic of Poland. All of the cases of refusing to grant a day off on Saturday (Sabbath) from work or learning, inter alia, by organising medical and legal exams for the followers of the Seventh-day Adventist Church on their holiday would be a contra legem action, not only in the light of the Act of 30 June 1995 on The relation of the State and the Seventh-day Adventist Church in the Republic of Poland, but also in the light of the Constitution and regulations of the European Union and international law. An analogous position is presented by the judicature and the doctrine.
