Utilizando os conceitos de justiça social e participação paritária de Nancy Fraser, esse artigo pre-tende avaliar a afirmação de que a nova lei de migração é um avanço em relação ao antigo Esta-tuto do Estrangeiro, baseado na lógica de Segurança Nacional e criado durante a Ditadura Mili-tar. Para isso, todas versões da lei foram analisadas, evidenciando seus avanços e retrocessos, bem como a participação da Sociedade Civil no processo. Após isso, é possível concluir que as desigualdades institucionais dos migrantes impediram a mudança completa de paradigma da lei e a participação efetiva dos atores interessados.

Utilizing Nancy Fraser’s concepts of social justice and participatory parity, this article assesses the claim that the New Migration Statute in Brazil is an improvement compared to the previous 1980 Foreigners Statute which was permeated by the doctrine of national security and was adop-ted during the military dictatorship. To do so, every draft of the statute was analyzed, putting in evidence its improvements and setbacks, as well as the participation of civil society during the process of approving the Statute. In doing so, we concluded that the institutional inequalities between migrants and nationals prevented a complete change of the legal paradigm as well as ef-fective participation of the interested actors.
