The article tries to answer the question of liability in competition law, especially succession of liability in case when originally liable subject ceases to exist. From this point of view most important is economic continuity test developed by case law of European courts and now introduced in case law of Antimonopoly Office of the Slovak Republic cofirmed by case law of the Slovak courts. Except for attention paid to economic continuity test the article reflects also questions of liability of consultative companies and liability of companies of the same economic unit (especially the parent company and its subsidiary).

Starting from legal regulation of parallel proceedings in Regulation 1/2003 on the implementation of the rules on competition laid down in Articles 81 and 82 of the Treaty the article gives survey of community judicature concerning conditions of application of the ne bis in idem principle in competition cases. It demonstrates reflection of their conclusions as far as the ne bis in idem principle is concerned on recently judicator international cartel agreement (GIS) in judicature of the national competition authorities of the Slovak and Czech Republic.

The article attempts to give a brief survey of fundamental changes brought by the Lisbon Treaty. At the same time it gives analysis of the new regulations based on domestic and foreign legal literature referring to this topic. It drives attention to the problems and open questions evoked by the new legal regulations. It does not avoid controversial discussion concerning sovereignty and competences forming a natural starting point of understanding of competences in the EU and their division between the EU and its member states.
