An article begins with a short description of an iconic turn which happened in human sciences during the last few decades. The article describes specific visibility of humanistic discourses which is perceptible in the area of history, philosophy, literature science etc. From that perspective, the author tries to look at Polish cybernetic poetry and find out what is the reason of a lower status of the cybernetic poetry, which is considered to be marginal in literature, without a rightful place in post-avant-garde. Cybernetic poetry is presented in the line of tradition of visual poetry and conceptualism. Chosen cybernetic works are analyzed: works by Roman Bromboszcz who is one of the main representatives of this artistic current in Poland. This example is analyzed with the use of John Cage’s categories and the author tries to define a special position of cybernetic text. The author also tries to analyze the differences in approach to cybernetic text and its possible interpretations – in comparison to the approach to the traditional, pure linguistic poetry, written in classical, linear versification. In his conclusions the author claims that the cybernetic poetry requires an active recipient – active in other way than traditional recipient such as a more conservative literary critic. Such a recipient must be intellectually open for the semantics of images.
The article initially discusses the potential reception of the cover of the first edition of the novel by Aleksander Minkowski entitled Valley of Light. Next, the article passes to the strategy contained in the novel’s exposure: focalization, narrative style and relations of the protagonist with other characters, as well as sources of potential conflict constructing the story, are analyzed. In these analyzes, the model reader of this youth novel is taken into account, as well as the emotions that individual stylistic holds and great narrative figures can evoke. In this perspective, the concepts of Gaston Bachelard, Roland Barthes and Rita Felski are used, among others.
Umowa konsorcjalna to umowa nienazwana zobowiązująca do wspólnego działania dla osiągnięcia założonego celu, wykształcona na płaszczyźnie praktycznej, przy czym wspólnym celem w systemie zamówień publicznych jest złożenie oferty wspólnej, a następnie wspólne wykonanie umowy. Ustawodawca umożliwił wykonawcom wspólne ubieganie się o udzielenie zamówienia publicznego na podstawie art. 23 Prawa zamówień publicznych. Przedmiotem artykułu jest odpowiedzialność konsorcjantów w relacjach między konsorcjum i zamawiającym oraz w stosunkach wewnętrznych. Pierwszym celem, który sobie stawiam jest wykazanie, że sytuacja prawna konsorcjanta ubiegającego się wspólnie z innymi osobami o udzielenie zamówienia publicznego jest niekorzystna z powodu ograniczonych instrumentów redukcji ryzyka poniesienia odpowiedzialności za uchybienia spowodowane przez inne podmioty. Drugim celem jest identyfikacja klauzul umownych, które choć w pewnym stopniu pozwoliłyby przywrócić równowagę pozycji konsorcjantów wobec siebie nawzajem i wobec zamawiającego. Obiektem rozważań jest przede wszystkim model jawnego konsorcjum scentralizowanego.

A consortium agreement is an unnamed agreement obliging to act jointly in order to achieve the agreed objective, formed by the practice. The common objective within the public procurement system is a submission of a joint tender, and later a performance of the public contract. The lawmaker has allowed economic operators to apply for a joint public procurement on the basis of article 23 of Public Procurement Law. The subject of this paper is a liability of the consortium members in a relationship between the consortium and the contracting authority as well as in internal relations. The first aim is to demonstrate that the legal situation of the consortium member applying jointly with others for the award of a public contract is disadvantageous because of the limited instruments for reducing the risk of incurring liability for infringements caused by other entities. The second aim is to identify the contractual clauses which would restore to some extent the equilibrium of consortium members’ positions to each other and in relation to the contracting authority. The object of the author's analysis is primarily a model of explicit and centralized consortium.

Autor aprobuje wypracowaną w tej uchwale tezę, że „w razie nabycia wadliwej rzeczy oznaczonej co do tożsamości kupujący może wykonać uprawnienia z tytułu rękojmi albo uchylić się od skutków prawnych oświadczenia woli złożonego pod wpływem błędu”. Argumenty za przyjętym stanowiskiem to autonomia woli podmiotów prawa prywatnego w kontekście wyboru środków ochrony interesów tych podmiotów, sprzeciw wobec traktowania rękojmi jako legem specialem w stosunku do przepisów o błędzie oraz odmienny cel obu regulacji. Problem stosunku przepisów regulujących uprawnienia z tytułu rękojmi do przepisów dotyczących złożenia oświadczenia woli pod wpływem błędu posłużył autorowi do rozważań nad ogólniejszymi problemami związanymi ze zbiegiem przepisów przyznających uprawnienia podmiotom prawa cywilnego. W literaturze i orzecznictwie wskazywano dotąd dwa rozwiązania przypadków kolizji norm odnoszących się do błędu oraz rękojmi: zbieg pozorny – zamierzony przez ustawodawcę – skutkujący wyłączeniem drugiej regulacji oraz zbieg realny dający możliwość stosowania obu instytucji, w zależności od wyboru kupującego. Sąd w uchwale przyjmuje drugie rozwiązanie, co może być wskazówką odnośnie traktowania analogicznych sytuacji, gdy uprawnionemu przysługuje równolegle kilka środków ochrony jego praw.

This is a commentary approving the ruling of the Supreme Court ref. III CZP 90/11. The author endorses the argument put forward in the resolution that “in the case of an acquisition of defective goods in specie, the buyer may exercise rights under implied warranty or may avoid the legal consequences of his declaration of intent made under the influence of an error”. The arguments for the adopted standpoint are the following: the autonomy of private-law entities within the context of choosing measures to protect the interests of these entities, objection to treatment of implied warranty as lex speciali in relation to the provisions regarding an error and different aim of both legal institutions. The question of relations between provisions regulating rights under implied warranty and provisions concerning a declaration of intent made under the influence of an error was used by the author to consider broader issues associated with the concurrence of provisions conferring rights on civil-law entities. In literature and judicature two solutions were indicated in the case of a conflict of rules relating to the error and implied warranty: apparent concurrence – intended by the legislator – resulting in the exclusion of the other regulation and real concurrence – providing the possibility to use the two legal institutions depending on the choice of the buyer. The court adopts the second solution in the ruling, which may be an indication regarding the treatment of similar situations where the entitled entity has several parallel measures to protect his rights.

Autor aprobuje wypracowaną w tej uchwale tezę, że „Właściciel rzeczy może żądać od posiadacza służebności wynagrodzenia za bezumowne korzystanie z rzeczy”, nawet wówczas gdy właściciel nie realizuje roszczenia negatoryjnego polegającego na żądaniu usunięcia urządzeń przesyłowych. Roszczenie o wynagrodzenie za bezumowne korzystanie z rzeczy ma zdaniem sądu i autora charakter samodzielny. Zagadnienie samego charakteru prawnego roszczeń uzupełniających, a zwłaszcza ich samodzielności, nadal budzi spory w polskiej cywilistyce. Wątpliwości dotyczą również tego, czy do wystąpienia przez właściciela z roszczeniem o wynagrodzenie za bezumowne korzystanie z nieruchomości bez tytułu prawnego niezbędna jest równoczesna legitymacja tego właściciela do wystąpienia z roszczeniem windykacyjnym, co wykluczałoby żądanie wynagrodzenia przy istnieniu podstaw do jedynie roszczenia negatoryjnego. Zatem wyłączone byłoby tego rodzaju roszczenie dla urządzeń przesyłowych. Należy się zgodzić ze stanowiskiem sądu, że roszczenie o wynagrodzenie za korzystanie z rzeczy ma charakter obligacyjny i wówczas, gdy powstanie - uzyskuje samodzielny byt w stosunku do innych roszczeń właściciela i może być przedmiotem obrotu.

This is a commentary approving the ruling of the Supreme Court ref. III CZP 36/13. The author endorses the argument put forward in this ruling that “The owner can demand a fee from the possessor of the easement for non-contractual use of a thing”, even if the owner does not pursue actio negatoria that is based on demanding removal of transmission facilities. In the Court's opinion and the author’s opinion as well, a claim for a fee for non-contractual use of a thing is independent. The issue of the legal nature of the supplementary claims, particularly their independence, remains a matter of dispute in Polish civil law. It is also questionable whether it is necessary for the owner to simultaneously have entitlement to pursue rei vindicatio in order to demand a fee for non-contractual use of a real estate without legal title, which would exclude a claim for a fee in the presence of grounds only for actio negatoria. Therefore, this kind of a claim would be excluded with regard to transmission facilities. One shall accept the standpoint of the Court that the claim for a fee for non-contractual use of a thing has the nature of obligation, and when it arises - it obtains independent existence in relation to other claims of the owner and may be traded.
