The opinion concerns the evaluation of consistency with the Constitution of the Republic of Poland of 2 April 1997 of Article 55a of the Act of 26 January 2018 on the Institute of National Remembrance — Commission for the Prosecution of Crimes Against the Polish Nation. In the author’s opinion, the discussed provision establishes the protection of honour and dignity of the Polish Nation and the Polish State from attacks in the form of assigning — publicly and contrary to the facts — responsibility or co-responsibility for the crimes specifi ed in paragraph 1 of the discussed article, or blatantly belittling the responsibility of the actual perpetrators. However, no such crime is committed by a person committing such an act in his/her scientifi c or artistic activity.

The aim of the article is to define the boundaries of the prerogative of pardon in the Ukrainian legal system in terms of the objective and subjective aspects from the constitutional point of view and the decree of the President of Ukraine on the application of the prerogative of pardon. This decree significantly restricts the decision-making freedom of the head of state in making decisions on the application of the prerogative of pardon, which raises doubts as to the compliance of the adopted solution with the fundamental law. The article compares the constitutional approach to the prerogative of pardon with the solutions adopted in the decree in order to answer the question whether they are consistent with the essence and nature of the presidential prerogative of pardon under the constitution.

The article concerns the issue of the resignation of the voivodship marshal in the light of the Act of 5 June 1998 on voivodship self-government in the context of the possibility of re-election resigning to the voivodship board. According to the author, the aforementioned Act does not provide for any exclusion in this respect, therefore the voivodship marshal who resigned from his function may be re-elected to the voivodship board, including he may become the voivodship marshal again. Adopting a different interpretation would conflict with art. 65 section 1 of the Polish Constitution of April 2, 1997.
