Sytuacja pracowników domów pomocy społecznej w okresie epidemii koronawirusa SARS-CoV-2 (COVID-19) w Polsce

Artykuł jest prezentacją wyników badań przeprowadzonych w Polsce, w kwietniu 2020 r., w okresie stanu epidemii koronawirusa SARS-CoV2, na temat sytuacji pracowników domów pomocy społecznej w jej czasie. Badania przeprowadzono metodą ankietową w formie elektronicznej, na grupie 160 (N = 160) pracowników. Celem badań uczyniono wstępną i bieżącą analizę uwarunkowań pracy pracowników DPS w okresie epidemii SARS-CoV2 (COVID-19). W artykule wskazano także kontekst sytuacji prawnej, w jakiej prowadzone były badania, wobec podejmowania przez organy administracji czynności w trybie przepisów szczególnych, w celu zabezpieczenia sytuacji pracowników i mieszkańców DPS. W wyniku badań ustalono, że większość pracowników objętych ankietowaniem wskazała braki w zabezpieczeniu w środki ochrony osobistej, a także sytuację braku poczucia bezpieczeństwa w pracy. Postawiono i potwierdzono tezę o konieczności podjęcia pilnych czynności prawnych i faktycznych zmierzających do zabezpieczenia pracowników DPS, w sposób maksymalnie gwarantujący im bezpieczeństwo, przy uwzględnieniu oczywistej możliwości zakażenia, która jednak poprzez zapewnienie środków ochrony i wykonywanie procedur – może zostać ograniczone.

System orzekania o niepełnosprawności w Polsce oparty jest na strukturze dwuinstancyjnej. Rolę zasadniczą mają powiatowe zespołu do spraw orzekania o niepełnosprawności, wykonujące zadanie zlecone powiatom. Jest to uprawnienie wyłączne, powierzone wyłącznie tym organom, przy zachowaniu toku instancyjnego. Niepełnosprawność w ujęciu społecznym wymagający tak równego traktowania osób nie w pełni sprawnych, jak i realizacji funkcji gwarancyjnych ze strony państwa stanowi przedmiot zainteresowania nauk pedagogicznych, politycznych i prawnych, czym autorzy opracowania zajęli się w jego treści.

Tasks of a county authority in the field of disability assessment from a social and legal perspective

The system of disability assessment in Poland is based on a two-instance structure. The main role is played by district disability assessment boards, which perform tasks assigned to the counties (county – powiat). This is an exclusive power, entrusted exclusively to these bodies, while maintaining the course of instances. People with disabilities, whose physical or mental capacity prevents or complicates their education, work and social roles require equal treatment. A disability certificate entitles disabled people to numerous benefits and preferences, and protection in this area is guaranteed and implemented by the state. This is the subject of interest of pedagogical, political and legal sciences, and the authors of the study have addressed related issues.

The situation of employees of social assistance facilities during the SARS-CoV-2 (COVID-19) coronavirus epidemic in Poland

The article is a presentation of the results of research conducted in Poland in April 2020, during the SARS-CoV-2 coronavirus epidemic, on the situation of employees of the nursery homes. The research was conducted using an electronic survey method on a group of 160 (N = 160) employees. The aim of the study was to provide a preliminary and ongoing analysis of the work conditions of employees of social assistance facilities during the SARS-CoV-2 epidemic (COVID-19). The article also indicates the context of the legal situation in which the research was conducted, in relation to the administrative bodies taking actions under special provisions to secure the situation of employees and residents of the social assistance facility. As a result of the research, it was found that the majority of employees covered by the survey indicated deficiencies in personal protective equipment, as well as a situation of insecurity at work. The thesis about the necessity to take urgent legal and factual actions aimed at securing DPS employees in a way that guarantees their safety as much as possible, taking into account the obvious possibility of infection, which, however, by providing protection measures and performing procedures – may be limited.
