Z początkiem 2012 r. zostało wprowadzone, nieznane wcześniej w Polsce, ubezpieczenie na rzecz pacjentów z tytułu zdarzeń medycznych. Obowiązkiem tego ubezpieczenia obarczono szpitale. Ubezpieczenie to jest elementem pozasądowego trybu dochodzenia roszczeń przez pacjentów poszkodowanych w wyniku świadczeń szpitalnych. Funkcjonuje od trzech lat, a nadal nie jest jasny jego charakter prawny. Przedmiotem rozważań w poniższym artykule jest analiza elementów określających charakter prawny ubezpieczenia z tytułu zdarzeń medycznych. Autor skupia uwagę na konsekwencjach ubezpieczenia na rzecz pacjentów, rozbieżnościach odnośnie przedmiotu ubezpieczenia oraz jego obowiązkowego charakteru. Przeprowadzona analiza ukazała wiele błędów, niejasności i sprzeczności w obecnej regulacji prawnej, co zdaniem autora uzasadnia radykalne zmiany ustawodawcze, które powinny być poprzedzone dyskusją merytoryczną o charakterze naukowym.

As of the beginning of 2012 a new insurance product was introduced on the Polish market, i.e. patients’ insurance covering medical events. The obligation to maintain this coverage was placed on hospitals. This insurance is part of a non-litigious procedure for asserting claims by patients who suffer injuries while receiving hospital services. Although the coverage has been available for three years, its legal nature is still unclear. The author analyses the elements that determine the legal nature of insurance covering medical events. He focuses on the consequences of “patients’ insurance”, divergences with regard to the subject matter of insurance and its obligatory nature. The author’s analysis revealed a number of mistakes, ambiguities and disparities in the current legal situation, which, according to the author, call for a radical legislative change based on a prior, content-oriented scientific discussion.
