The Polish model of sectoral regulation was shaped under the influence of Community regulations, which forced (or at least accelerated) the process of abolishing legal monopolies within infrastructure sectors. The article addresses issues related to the subjective side of sectoral regulation, i.e. discusses the functioning of independent regulatory bodies. Due to the presence of monocratic regulators, the issue is presented in two ways. Firstly, the considerations were centred around the regulators and secondly, the issue of regulatory offices and the staff employed therein was addressed. The main objective of the article was to show and assess the changes that have taken place in relation to Polish regulators since the first such authority was established in the energy sector. Does the Polish legislator effectively uphold the independence of regulatory authorities, which is the most important feature of these bodies?

Polski model regulacji sektorowej kształtował się pod wpływem przepisów wspólnotowych, które wymusiły (lub przynajmniej przyśpieszyły) proces znoszenia monopoli prawnych w obrębie sektorów infrastrukturalnych. W artykule poruszono kwestie związane z podmiotową stroną regulacji sektorowej, a więc omówiono funkcjonowanie niezależnych organów regulacyjnych. Z uwagi na obecność monokratycznych organów regulacyjnych problematykę przedstawiono dwojako. Po pierwsze, rozważania skupiono wokół organów regulacyjnych, a po drugie, podjęto kwestię urzędów regulacyjnych i zatrudnionych w nim pracowników. Głównym celem artykułu było ukazanie i ocena zmian, które nastąpiły w stosunku do polskich regulatorów od chwili powołania pierwszego tego typu organu w sektorze energetycznym. Czy polski prawodawca skutecznie stoi na straży niezależności organów regulacyjnych, która jest najważniejszą cechą tych organów?
