Zmiany w wykonywaniu zwierzchnictwa terytorialnego wymuszają na zamieszkałej na danym terytorium ludności podjęcie decyzji co do dalszego utrzymywania obywatelstwa dotychczasowego suwerena lub zmiany na obywatelstwo suwerena rozciągającego swe zwierzchnictwo na tym terytorium. Status prawny cudzoziemca i apatrydy uwidoczniony zostaje w oparciu o status obywatela oraz kwestie z nim związane, m.in. ustalenie istnienia bezpaństwowości.

People should decide if they want to have continue citizenship of former soverein or new one, when there are changes in the excersite of territorial sovereignty in the territory. The legal status of the foreigner and ststeless is visualized on the basis of citizenship status and related matters, including determining the existence of statelessness.

Odpowiedzialność w prawie międzynarodowym jest coraz trudniejsza do wyegzekwowania z uwagi na skomplikowane procedury oraz wielość różnorodnych czynników wpływających na zaistnienie danego zdarzenia. Nie ulega wątpliwości, że stabilność linii orzeczniczej MTS sprzyja jasnemu rozróżnianiu, co podlega, a co nie deliktowi międzynarodowemu. Wobec niestabilnej sytuacji na arenie międzynarodowej oraz wobec częściej niż dotychczas występujących incydentów stanowiących przesłankę odpowiedzialności państwa, tym bardziej w kontekście zasiedzenia, autorka zdecydowała się na analizę tego tak istotnego zagadnienia. Omówione zostaną przesłanki zaistnienia deliktu wraz z czynnikami statuującymi odpowiedzialność państwa za ich wystąpienie.

Responsibility in international law is more and more difficult to enforce due to complicated procedures and the multiplicity of various factors affecting the occurrence of a given event. There is no doubt that the stability of the MTS jurisprudence line helps to clearly distinguish what is subject to and what will not be an international tort. In view of the unstable situation on the international arena, and more often than before to incidents that constitute the premise of state responsibility, the more in the context of acquisitive prescription, the author decided to analyze this important issue. Discussed will be the premises of the existence of the tort together with the factors that set the state’s responsibility for their appearance.

Dokonujące się zmiany na arenie międzynarodowej stwarzają pytanie o osoby zamieszkujące dane terytoria w aspekcie poszanowania praw człowieka. Obserwując niemal masową migrację osób z terenów objętych zwierzchnictwem nowego suwerena, oraz wezwania organizacji międzynarodowych do poszanowania praw człowieka, nasuwa się wątpliwość czy działania nowego suwerena zostały zaplanowane, czy wynikają z innych przyczyn pojawiających się ad hoc. Nie ulega wątpliwości, że zmiany terytorialne i związane z tym reperkusje powodują ryzyko naruszania w sposób świadomy, bądź przypadkowy podstawowych praw człowieka. Dlatego też Autorka podjęła się analizy zagadnienia zmierzając do wykazania, że zmiany terytorialne nie powinny powodować naruszania fundamentalnych praw ludności zamieszkałej na nim.

There are a lot of changes in international law in these days, and that is why we should ask about people who live in that territory if their rights are obey. When we observe migration of people who refuge from the territory which are in supremacy of another state. When we heard apeal to International Organisation about help these people we are frightened that they right aren’t be obey, too. We have doubts if that situation wasn’t planned or it was only happend. We know, that changes of territory make a risk of Human Rights Violations, but in these days we should protect them (these people). Author would like to show, that changes of territory should not cause Human Rights Violations of people who live in that territory
