The goal of the article was to analyse the situation in the public procurement market in regard to the use of electronic bidding and to highlight the benefits and risks that may arise from the use of this type of procurement for contracting construction works. The article presents the electronic bidding procedure as well as the author's results from the statistical analysis of 570 contract award notices published in the Public Procurement Bulletin. For the research, the author chose the period from 2008 to October 2014. The research involved the number of procedures for works, kind of works, number of bids, duration of the procedure and differences between bids and the estimated value of the contract. The benefits and risks from the use of this type of procurement for commissioning works is also shown. The results can be used to popularise this type of procurement not only among contracting authorities but also investors not subject to the rigours of the Public Procurement Act.

Celem artykułu była analiza sytuacji na rynku zamówień publicznych w zakresie stosowania trybu licytacji elektronicznej oraz wskazanie korzyści i zagrożeń jakie mogą wynikać ze stosowania tego trybu do zlecania robót budowlanych. W artykule przedstawiono procedurę postępowania licytacji elektronicznej oraz przedstawiono wyniki badań Autorki, która przeprowadziła analizę statystyczną 570 ogłoszeń o udzieleniu zamówienia zamieszczonych w Biuletynie Zamówień Publicznych. Do badań Autorka wybrała okres od 2008 do października 2014 r. Przedmiotem badań była m.in.: liczba postępowań o roboty budowlane, rodzaj robót budowlanych, liczba składanych ofert, czas trwania postępowania oraz różnice pomiędzy ofertami a wartością szacunkową zamówienia. Wskazano również korzyści jak i zagrożenia wynikające ze stosowania tego trybu w zlecaniu robót budowlanych. Wyniki badań mogą posłużyć w rozpowszechnieniu tego trybu nie tylko wśród zamawiających publicznych ale również inwestorów niepodlegających rygorom Prawa zamówień publicznych.

To be successful, a building project should be completed on time, meet clients requirements, delivered safely and within the planned budget. Choosing an appropriate contract arrangement is a key element in this process. There are many forms of contract used in practice. Authors are briefly described the main legal provision related to construction contract in Poland and Ireland. In Poland, the lack of generally applicable terms and conditions for contracts for public works significantly disorganizes the construction market. In the Civil Code is relatively little legislation directly relating to those contracts. Public procurement law also does not provide detailed regulations concerning contracts for public works, suggesting that it is possible to use the existing standards. In Ireland, these issues are sorted out. In the case of the public sector, there are ready-made standards which can be used by contractor authorities. In the private sector the parties can choose different standards which exist on the construction market. The different groups of contracts and their main forms were also discussed in the paper.

Pomyślne zakończenie przedsięwzięcia budowlanego oznacza terminowe zakończenie budowy, z uwzględnieniem założonego kosztu i jakości. Istnieje wiele form umów na roboty budowlane stosowanych w praktyce. Autorzy scharakteryzowali główne przepisy prawne związane z umowami na roboty budowlane w Polsce i Irlandii. W Polsce brak powszechnie obowiązujących zasad i warunków umów na roboty budowlane znacznie dezorganizuje rynek budowlany. W kodeksie cywilnym jest stosunkowo niewiele przepisów odnoszących się bezpośrednio do tych umów. Prawo zamówień publicznych nie przewiduje szczegółowych przepisów dotyczących kontraktów na roboty publiczne. W Irlandii, kwestie te są uporządkowane. W przypadku sektora publicznego, funkcjonują standardy, które mogą być wykorzystywane przez wykonawcę. Podobnie jest w sektorze prywatnym. W artykule przedstawione zostały różne rodzaje umów i ich główne formy.
