Alexy’s theory is probably the most influential and elaborated theory of balancing. This paper provides its in-depth analysis. It also identifies its drawbacks. First, it resides on a paradox, that taken as the Law of balancing it is overly simplistic (the only relevant factor is the intensity of the interference). And, taken from the perspective of the Weight formula it is overly complicated (arithmetical). The paradox of the Weight formula is that, notwithstanding its overly complicated nature, it is not able to grasp complex issues inherently related to human rights conflicts resolution. Second, the Weight formula presupposes a quantification, which goes, hand in hand, with another pitfall it was designed to avoid, i.e. a subjectivism. It could laps into a situation that we will input digits that will enable us to arrive at a desired end by means of downplaying and ignoring relevant arguments. Third, according to Alexy, there are only three factors relevant to balancing competing constitutional rights and public interests (intensity of interference; abstract weight and epistemic reliability). However, these factors cannot capture the normative complexity of a human rights’ universe as whole. The abovementioned arguments drive the author to a necessary conclusion that the Weight formula has to be abandoned and the Law of balancing has to be refined. Finally, a discussion of concurring conceptions of balancing (namely Barak’s and Möller’s approaches) is undertaken and a suggestion of how to get a better grasp of the balancing avoiding pitfalls of the Alexy’s theory is drawn from it.

Alexyho teorie je pravděpodobně nejpropracovanější a nejvlivnější teorií proporcionality vůbec. Tento článek ji podrobně analyzuje. Následně též identifikuje její slabá místa a nekonzistentnosti. Těmito jsou především zjednodušující podoba poměřování, je-li nahlíženo skrze tzv. zákon poměřování, neboť jediným relevantním faktorem je zde intenzita zásahu. Současně se jeví jako problematická přílišná složitost poměřování, je-li nahlíženo skrze tzv. vážící formuli. Paradoxem vážící formule je pak to, že navzdory své zmíněné složitosti není způsobilá uchopit komplexní realitu normativního světa základních práv. Tato navíc nutně předpokládá kvantifikaci uplatněné argumentace. Ruku v ruce s ní však jde další nebezpečí, kterého se paradoxně vážící formule snažila vyvarovat, a tím je nebezpečí subjektivizmu a intuitivnosti soudcovského rozhodování. Může totiž sklouznout k tomu, že do vážící formule budeme dosazovat taková čísla, která nám umožní dobrat se kýženého závěru, respektive budeme tak bagatelizovat či zcela ignorovat některé argumenty, které budou „ležet na stole“. Konečně, faktory, které Alexy považuje za relevantní pro poměřování, nejsou vyčerpávající a nemohou tak v úplnosti uchopit normativní realitu základních práv. Tato zjištění vedou autora k zavržení vážící formule a překonání doslovného znění zákona poměřování, nikoli však k úplnému zavržení Alexyho teorie jako takové. Tato totiž není nesprávná. Je pouze neúplná. Konečně, na základě diskuse odlišných přístupů k poměřování (Barakova a Möllerova koncepce) autor naznačuje způsob, jak je třeba kritérium poměřování uchopit, abychom překonali nedostatky Alexyho teorie.
The South African theory and practice of their Constitutional Court on socio-economic rights has become prominent example in the field of comparative constitutional law. The Court uses the reasonableness review as a specific methodology in cases on socio-economic rights. It became an important source of inspiration for both national and international bodies of human rights protection. No wonder that it attracts attention of Czech constitutional law scholars, who pin their hopes to improve the Czech Constitutional Court’s methodology (the rationality test) on socio-economic rights. Notwithstanding its great comparative potential, the reasonableness review is far from undisputed. Thus, the main aim of this paper is to reveal its true nature. Particularly, whether it can be perceived as a deferential variation on proportionality. To answer this question, one more has to be addressed - If the reasonableness review complies with the contemporary paradigm of constitutional rights which distinguishes between a scope of a right and an extent of its protection.

Jihoafrická doktrína i praxe Ústavního soudu k socioekonomickým právům v současnosti představují prominentní příklad v oboru ústavního srovnávacího práva. Metoda reasonableness, kterou Ústavní soud aplikuje na přezkum pozitivních závazků plynoucích z těchto práv, se tak stala významným zdrojem inspirace pro národní i mezinárodní orgány ochrany základních práv. Nyní se k ní obrací i zrak české odborné veřejnosti, která v metodě reasonableness spatřuje lék na neduhy trápící metodologii Ústavního soudu ČR, test racionality. Navzdory tomu, že je metoda reasonableness prezentována jako příklad hodný následování, tak její skutečná povaha je stále předmětem odborných polemik. Někteří autoři ji označují za deferenční variantu metody proporcionality, jiní zase za pouhé zkoumání vhodnosti, způsobilosti či racionality. Tento článek se tedy snaží zodpovědět výše naznačenou otázku po povaze metody reasonableness. Konkrétně, zda je možné tuto metodu považovat za variantu metody proporcionality. Zodpovězení této otázky logicky předchází otázka jiná, tj. zda vůbec metoda reasnonableness odpovídá současnému paradigmatu ochrany základních práv rozlišující mezi rozsahem působnosti základního práva a rozsahem jeho ochrany. Právě z tohoto paradigmatu totiž metoda proporcionality vychází.
This paper analyses the application of the legitimate goal (proper purpose) stage in the practice of the Czech Constitutional Court (“the CCC”). The legitimate goal stage is embodied in the paradigmatic structure of the constitutional review and this structure also provides a context for the analysis in this paper. First, the paper deals with functional connection between legitimate goal stage and proportionality analysis and it comes to conclusion that the legitimacy does not constitute an essential part of the proportionality’s structure, however it is an essential precondition for its applicability. Second, the paper focuses on the foundation and importance of the legitimate goal stage. It sets forth what purposes and goals could be deemed to be legitimate in the first place, and how they could be derived from the wording of the Constitution. Third, it discusses the issue whether the goal in hand must be of some weight or importance to be deemed legitimate, or not. Finally, the legitimate goal stage represents the so-called threshold criterion which works as a filter. Legitimate goals and reasons will pass the criterion, but illegitimate ones will be categorically excluded and will not be taken into consideration in the following steps of the constitutional review (proportionality analysis). This “filtering procedure” is operated by the so-called excluded reasons doctrine of which theoretical basis as well as its reflection in the case-law of the CCC is dedicated last part of this paper.

Tento článek se věnuje kritériu legitimity v rozhodovací praxi Ústavního soudu ČR (dále jen „ÚS“). Kritérium legitimity představuje jeden ze základních prvků současného paradigmatu přezkumu ústavnosti, a právě v kontextu této struktury je zde také analyzováno. Článek se nejprve zabývá funkčním propojením kritérií legitimity a proporcionality, přičemž dochází k závěru, že kritérium legitimity nemusí být koncepčně zařazeno jako součást (dílčí krok) metody proporcionality, avšak je jejím nutným předpokladem (identifikuje kolizi ústavních hodnot). Dále se věnuje východiskům kritéria legitimity a také tomu, jaké cíle lze vůbec považovat za legitimní, a jak je lze v konkrétním případě dovodit a formulovat. Poukazuje též na to, že navzdory formulacím užívaným též někdy ÚS, aby bylo kritérium legitimity splněno, nemusí legitimní cíl vykazovat žádnou specifickou závažnost či důležitost. Konečně, co do povahy, je kritérium legitimity tzv. prahovým kritériem, které funguje jako filtr. Legitimní cíle jím projdou do dalších kroků přezkumu a nelegitimní jsou naopak kategoricky vyloučeny a v rámci dalšího přezkumu se k nim již nepřihlíží. K rozlišení legitimních a nelegitimních cílů a důvodů přitom slouží tzv. doktrína vyloučených důvodů, jejíž teorii i reflexi v praxi ÚS je věnována poslední část tohoto článku.
