Elektronizacja aktów normatywnych

The amendment of the Law on Promulgation of Normative Acts and other legal regulations constitute that from 1 January 2012 the Acts and Regulations are published exclusively in electronic form – on the Internet. The public administration bodies have been obliged to maintain a separate web page for each electronic official journal. On the basis of the amended Law the Prime Minister issued the Regulation which sets out technical requirements for electronic documents that contain normative acts. In addition, the obligation of consolidation normative text at least once a year, if at that time the act was amended, was imposed. This article details the introduced changes and their complementarity with other changes related to electronization of law and administrative procedures. The article also examines the adequacy of the adopted solutions and presumptions of a common access to the Internet.

The article is a compendium of knowledge about the Polish point of single contact (PSC). The genesis of PSC, legal basis for its functioning and also user interface are described. The article in a very comprehensible way introduces different functionalities which can be applied by administration officials. It also presents several PSC benefits to businesses and citizens. At the end the barriers that prevent full electronization of administrative procedures as well as the problems with their implementation through the PSC are mentioned.

General duty of publication of electronic documents patterns by public authorities prior to rendering available to citizens in a form of electronic services has been introduced by the legislator. Lack of precise rules and a shared vision of informatization of the public administration wreaks legal and organizational havoc, thus impeding the smooth launch of new services. From the authorities perspective this results primarily in problems with establishing responsibility and clearing rights to submit applications to the Central Document Repository and difficulties in the process of creating a correct pattern. For the citizens this results in a lack of uniform documents patterns for the whole country and a limited access to electronic path of settling official matters. Electronic Platform for e-Services of Public Administration provides tools for creating electronic patterns and sharing electronic services. The software on which the Application Construction Environment is based provides visual and fully accessible tools for preparing electronic forms. Unfortunately, the end result - accepted by the Platform as correct - does not automatically meet the requirements specified in the regulations; therefore, it needs to be adapted, which is a significant problem blocking any further steps of the process. According to the authors, changes are necessary both in terms of legislation and software. Greater emphasis should be put on cooperation between central authorities and local government units, which will result in procedures consistent at country level and effective use of resources and public funds.

Platforma ePUAP krok po kroku

Until recently the electronic platform, known as ePUAP, through which entrepreneurs can handle official matters via the Internet, has not been very popular. It was considered that the main reason was the requirement to have payable qualified electronic signature. Thus so called trusted profile, which is a free equivalent to an e-signature, has been launched. A new method of confirming the identity in public administration systems was introduced by the revised Act on computerisation of public service. On this basis, two regulations were issued, first on the scope and terms of use an electronic platform for government services and the second on the principles of validation, renewal, exploitation and revocation of the trusted profile on electronic platform for government services. Both came into force on 9th of June 2011. With these improvements, platform is gaining more and more supporters and thus becomes the central place of e-services. The article is a specific instruction, which describes how to take first steps on ePUAP.

The following article presents the rules of the publication of electronic documents models in the Central Repository of Electronic Document Models on ePUAP platform. The paper is a kind of step by step instruction on how to publish electronic documents models in this repository. Moreover, the law aspects of the electronic documents models is discussed. The author explains also how institutions can get free help with creating the electronic documents models.
