Koncesja jako umowa, której przedmiotem są roboty budowlane lub usługi, charakteryzująca się specyficzną formą wynagrodzenia, znana już była na ziemiach polskich w okresie międzywojennym. Autor prowadzi analizę, jaki wpływ miało ustawodawstwo europejskie na obecny kształt koncesji na roboty budowlane lub usługi. W artykule zajęto się również analizą pojęcia koncesji na roboty budowlane lub usługi, zdefiniowanego w nowej ustawie o umowach koncesji na roboty budowlane lub usługi z punktu widzenia możliwości praktycznego wykorzystania tej instytucji prawnej.

The concession as a contract which is the subject of works or services, characterized by a specific form of payment was known already on Polish territory in the interwar period. The author is analyzing the impact was European legislation on the current shape of public works concessions or services. The article dealt with the analysis of the concept of works concessions or services as defined in the new law on concession agreements for works or services from the viewpoint of practical use of this legal institution.

Warszawska jednostka kontrolna NIK może poszczycić się blisko stuletnim doświadczeniem. Powstała jako jedna z pierwszych okręgowych izb kontroli państwowej, obok kieleckiej i lwowskiej, już w 1920 roku. Na różnorodność podejmowanych przez nią zagadnień miało wpływ usytuowanie w stolicy, przy jednoczesnym objęciu właściwością miejscową terenu kilku województw. Odpowiedzią na różne problemy stolicy i województwa miało być w latach 60. XX wieku utworzenie dwóch odrębnych delegatur – dla m.st. Warszawy oraz województwa warszawskiego. Dzisiejsza delegatura prowadzi kontrole na Mazowszu, a specyfikę jej pracy niezmiennie określa największa aglomeracja w kraju. Ich wyniki wskazują zaś, że od międzywojnia niektóre problemy pozostały niezmienne.

Social clauses in public procurement allow for achieving social objectives related to public procurement. However, social clauses are hardly ever used, despite the changes introduced to the Public Procurement Law. In his article, the author attempts to find out whether this is due to the fact that social clauses are in vogue among more socially conscious buyers only, or due to little awareness of the existence of social clauses and the benefits they can give. Another potential reason may be the lack of knowledge and experience as for what clauses and in what way should be included in public procurement documents.

Regulacje prawne, które możemy zakwalifikować do jednego spójnego systemu prawa regulującego procedury realizacji zamówień publicznych, muszą w swojej treści normatywnej regulować kwestie związane ze sposobem udzielania zamówień publicznych, w szczególności na potrzeby podmiotów sektora publicznego lub podmiotów dysponujących środkami publicznymi na określone cele. Konieczność szczególnego i systemowego podejścia do regulacji zamówień publicznych pojawiła się w związku z ich ogromnym znaczeniem dla sprawnego funkcjonowania sektora publicznego, świadczącego bez zakłóceń usługi publiczne. W artykule wskazano cechy pozwalające na wyróżnienie trzech instytucji systemu zamówień publicznych, tj. koncesji, partnerstwa publiczno-prywatnego i klasycznych zamówień publicznych. Zarówno koncesje, jak i PPP zaliczymy do katalogu instrumentów prawnych umożliwiających udzielanie zamówień publicznych, zmierzających do realizacji zadań publicznych.

Over the last dozen of years, many activities have been undertaken related to the reform of the law establishment system, however its quality still calls for improvements. The mediocre quality of the regulations established in our country has been evidenced, among others, by the position of Poland in the rankings on regulatory environment. For instance, in the Sustainable Governance Indicators (SGI) ranking done by the Bertelsmann Foundation, in the item related to the application of the mechanisms to identify the needs, objectives and socio-economic impact of newly introduced regulations, Poland was as low as on the 37th position out of the 41 countries subject to the ranking in 2017. In their article, the authors analyse the law establishment process from the perspective of the correctness of forecasting socio-economic effects (impact assessment) of drafted regulations. The examination was based on the findings of the NIK audit conducted in the area in the government legislative process.

Genetic research allows not only for precise diagnosing of diseases, but also for selecting therapy and appropriate medicines, and for insight into future health condition. Genetic information obtained as a result of genetic research is related not only to patients, but to their relatives, too. In this context a threat arises of abuse, infringement of human rights and unauthorised access to genetic data. The audit of NIK was aimed, in the first place, to examine whether genetic research in Poland is conducted with due care for safety requirements, that is whether Polish legal regulations keep up with the development of modern technologies in medicine.
