В докладе описан один из судебных органов Советской Украины – Единый Верховный Трибунал Советской Украины. Анализ этого учреждения основан на советских правовых документах а также до ныне не публикованих архивных материалах. Описано начало трибунала, структуру, отношения к другим учреждениям УССР, полномочия и процедуру функционирования. Широко подняты вопросы принципов деятельности пленума трибунала. Проанализирован также ряд архивных дел по функционированию трибунала.

This paper describes one of the law agencies in the Soviet Ukraine, called The Su¬preme Court of the Ukrainian SSR. The analysis of the institution was carried out on the ba¬- sis of Soviet legislation and previously unpublished archival materials. The article describes the origin of the tribunal, its structure, its relationships with other institutions in the USSR, its powers and its procedures. Widely described is the principle of the plenum of this Court. Numerous archival texts regarding the functioning of The Supreme Court of the Ukrainian SSR were analysed.

В статье обсуждается первые лета функционирования всеобщего правосудия в Российской Федеративной Советской Республике. Затронуты вопросы формирования первых судов и их эволюция. Описаны ключевые юридические акты касающие развития правосудия этого государства, с особым учтением декретов о суде № 1, № 2 и № 3. Кроме того, в тексте найти можно характеристику политического положения в России, сопутствующей формировании большевистского правосудия. В статье описаны взгляды В. Ленина и г. Стучкий, по правосудю. Особый вес привязано к структуре всеобщего правосудия, судебных заседании и его реформам.

Article is focused on first years of functioning common courts of law in RSFSR. Is said also about evolution first courts. Article describes the law acts which are fundamental for evolution administration of justice to take into account of decrets of justice no1, 2 and 3. Beside this, in text we can find the charateristic of the political situation in Russia which accompanying start the bolshevick law. Article treat about views Lenin and Stuczka. The most impotrant is the structure of common courts of law, bench in a given case and his reform.

В данной статье дается характеристика правового статуса украинской республики в составе СССР. Целью статьи является ответ на вопрос, являлась ли Советская Украина государством. В начале работы рассматривается проблема признания государства в сфере международных отношений, далее анализируются статьи конституции Советской Украины и Союза Советских Социалистических Республик, в которых обозначаются признаки, указывающие на Украину как государство, а также как субъект права не являющийся государством. Работу заканчивает изложение аргументов статьи и ответ на вышеизложенный вопрос.

The purpose of this Article is characteristic of the legal status of this republic and the answer to the question posed in the title. Paper begins the characteristic of the problem of the recognition of the states status in the international arena. Further, analyzes rules of the Constitution of Soviet Ukraine and the Soviet Union, which characterized Ukraine like a state or juridical subject without states attributes. The work finish a summary of the arguments from the paper and the answer to the question from title.
