The article addresses the conditions that must be fulfilled in order for a liable entity (e.g. the State Treasury) which has paid damages to an aggrieved party for damage caused as a result of the action or omission of a public official to then pursue a recourse claim against the responsible official. The deliberations are centered around issues of material regulations. The analyses conducted demonstrate discrepancies between the conditions for liability of a liable entity compared to those of recourse liability of a public official towards that entity. It is then demonstrated that the potential for pursuing recourse claims against a public official is in fact quite limited.
This text refers to the description of activity of The Laboratory of Clinical Teaching of Law, which was established at the Institute of Civil Law at the Faculty of Law, Administration and Economy of the University of Wrocław on the basis of the Bylaw No 117/2014 enacted by the Rector of the University of Wrocław on 5 November 2014. The text describes the genesis of this Laboratory, as well as teaching and scientific activities conducted within its framework. It also mentions the exchange of experiences with other such entities and legal clinics operating at Polish universities.
This article refers to the circumstances which, in accordance with the provisions of the Polish Civil Code, exclude the liability for damage caused by a dangerous product. The starting point for the considerations on how to qualify these circumstances is to determine what kind of responsibility it is and on what principle it is based. Finally, the author concludes that it is a tort liability and it is based on the principle of risk. Consequently, circumstances excluding this liability are exoneration circumstances. Such a conclusion is reached after a dispute with different views, according to which it is thought that here the principle of fault comes into play, and responsibility is not of a tortious character. Then, the author discusses the circumstances allowing the exemption of liability for damage caused by a dangerous product. The final consideration concerns the issue of who bears the burden of proving these circumstances.
У статті представлений науковий аналіз однієї з підстав для винесення рішення про усунення від права на спадкування спадкоємця від певного спадкодавця, а конкрет- ніше: береться до уваги випадок, коли спадкоємець щодо спадкодавця вчиняє умис- ний тяжкий злочин (що дає підстави для визнання негідним спадкування згідно зі статтею 928 § 1 п. 1 ЦК). У польській системі права законодавець вичерпно визначає підстави для винесення рішення про усунення від спадкування. А тому детальне ви- світлення цих підстав матиме важливе практичне значення, оскільки тягне за собою можливість суду винести рішення на підставі пред’явленого позову суб’єктом, який у цій справі має законну підставу, про те, що даний спадкоємець не може спадкувати від конкретного спадкодавця, в результаті чого ця особа вилучається із списку спад- коємців даного спадкодавця. З тієї причини в статті детально проаналізовані поняття, що використовуються у наведеній нормі права. З огляду на те, що в польському Цивільному кодексі окремі використовувані в ньому терміни законодавець не уточнює в окремих випадках можуть схиляти до позиції, що скоєний проти спадкодавця зло чин не повинен призводити до усунення спадкоємця, який скоїв злочин, від спадку- вання (негідним спадкоємства) від спадкодавця. У тексті звернено увагу також на досить поширену практику у винесенні рішень, згідно з якою як тяжкий умисний злочин за ст. 928 § 1 pkt 1 ЦК з урахуванням конкретних обставин даного випадку також можна кваліфікувати і проступки (як відомо, злочини згідно з польським Кар- ним кодексом поділяються на злочини і проступки). Показано, що найчастіше при винесенні рішень суду за вчинені злочини проти спадкодавця, юридично значимими на підставі 928 статті 1§ 1 п. ЦК вважаються про- типравні діяння спрямовані проти спадкодавця, а саме: злочини проти життя і здо- ров’я, свободи, статевої свободи та статевої недоторканності, сім’ї та неповнолітніх, гідності особи та свободи особи. На цьому тлі відзначено цікаву нову тенденцію за- раховувати до таких типів злочинів протиправні дії щодо майна, якщо ними завдано шкоду базовим засобам існування спадкодавця. Такий підхід нерідко піддається як критичній оцінці, особливо в судових рішеннях, у яких аргументується, що в 928 статті 1 § 1 п. КЦ йдеться про злочин проти спадкодавця, а отже проти його осо- би, так і схвальній оцінці, навіть до такої міри, що в літературі пропонується прийня- ти за юридично значимі всі види злочинів щодо майна, які не обов’язково завдають шкоди базовим засобам існування спадкодавця, а лише опосередковано спрямовані проти власності спадкодавця, у яких під прямою загрозою знаходиться майно. Саме цю проблематику дуже детально розглянуто в статті. Автор не раз висловлює критичне ставлення до найбільш поширених поглядів щодо аналізованої проблематики, пропонуючи свою власну інтерпретацію законів. Насамкінець, піддано порівняльній характеристиці приклади скоєння злочину як причини для винесення судового рішення про усунення від права на спадкування (928 ст., 1 §, п. 1 ЦК.) із ситуаціями, які надають підстави до ексгередації (позбавлен- ня спадщини) (1008 ст., п. 2 КЦ), оголошуючи на цім тлі постулати de lege ferenda.

The considerations conducted in this article are centered around the exact nature of one of the grounds for judging the unworthiness of inheritance by the heir after the particular devisor, namely around the case where the heir has intentionally committed a serious offense against the testator (which is a prerequisite for judging the inadmissibility of inheritance under Article 928 § 1 point 1 of the Polish Civil Code). The terms used in the above of criminal law must be used here, especially in the context of the notion crime, its stadia and phenomena, as well as the intentional nature of the heirs actions. It has also been showned the need for an individual judgment in each case by the court whether the act can be classified as severe; the text comprises indications in this regard, including these flowing from the case law. To several of the above-mentioned aspects the author made some critical remarks, proposing her own interpretation of the discused regulations. Finally, the case of committing an offense as a reason for the ruling on the unworthiness of inheritance (Article 928 § 1 point 1 of the Polish Civil Code) has been compared to situations where this constitutes a ground for disinheritance (Article 1008 point 2 of the Polish Civil Code). At this background some de legeferenda remarks has been made.
This article attempts to specify in what circumstances, in the light of Polish inheritance law, it is possible to make an oral testament. Th e legislator limits the possibility of using this form of will to three cases, namely to the situation when there is a fear of imminent death of the testator, or if due to special circumstances the preparation of the ordinary form of the testament is impossible or very difficult. The article contains an interpretation of the provision stipulating the possibility of making an oral testament only when either of these circumstances occurred. For this purpose, among other things, it was considered whether accepting that there is concern about the imminent death of the testator must be justified by objective or subjective factors, or perhaps both of them at once. It was also considered how to treat cases when the testament is made by a person who wants to commit suicide or someone who, as a result of a medical diagnosis, is convinced that he will soon die, and this diagnosis turns out to be wrong. It was also questioned whether it is reasonable to treat an elderly person’s very old age as a circumstance justifying the fear of imminent death and, consequently, allowing an oral testament to be made. The article also refers to the issue when it can be assumed that due to special circumstances the preparation of the ordinary form of the testament is impossible or very difficult.
Artykuł dotyczy kwestii związanych z sytuacją prawną dziecka osoby zmarłej w kontekście uprawnień wynikających z prawa spadkowego. Obejmuje analizę i ocenę rozwiązań normatywnych przyjętych w tym zakresie przez polskiego ustawodawcę. Punktem wyjścia prowadzonych rozważań jest pozycja dziecka spadkodawcy jako podmiotu należącego do pierwszej grupy spadkobierców ustawowych. Pokazany został jego uprzywilejowany status w tym aspekcie, a także teoretyczne uzasadnienie takiej konstrukcji prawnej. Wykazano też, że pozycja prawna dziecka osoby zmarłej jest korzystnie dla niego ukształtowana w wielu przepisach szczególnych, w wyniku czego otrzyma ono poszczególne prawa majątkowe również na innej drodze niż poprzez dziedziczenie. Rozważania przeprowadzone w artykule prowadzą do wniosku, że interesy majątkowe dziecka w przypadku śmierci jego rodzica są odpowiednio chronione przez polskie prawo spadkowe.

The article refers to the legal situation of a child of a deceased person in the context of rights under inheritance law. It encompasses the analysis and assessment of normative solutions adopted in this area by the Polish legislator. The starting point for the considerations is the position of the child of the deceased person as an entity belonging to the first group of statutory heirs. It is shown its privileged position in this area, as well as theoretical justifications for this legal solution. It has also been shown that the position of the child of the deceased person is favourably shaped in a number of special provisions too, which means that he will receive certain property rights also in a way other than through inheritance. The considerations carried out in the article lead to the conclusion that the property interests of the child in the event of the death of his parent are adequately protected by Polish inheritance law.
The article addresses the issue of interrupting the running of the limitation period through the initiation of mediation. First, this issue is analysed in the context of other circumstances provided for in the Civil Code, which may interrupt the running of the limitation period but frequently provoke controversy. These examples are used to demonstrate that interpretative difficulties arise in respect of the initiation of mediation proceedings as well, as an event interrupting the running of the limitation period. Such difficulties are primarily due to the fact that while Article 1836 § 1 of the Code of Civil Procedure (CCP) states that mediation proceedings are initiated from the moment one of the parties serves the mediator with a petition to conduct mediation proceedings, there is no regulation addressing the matter of formal defects in the petition; legal scholars take diametrically opposing positions in respect of whether it is possible to remedy these defects and initiate the mediation process, and whether the running of the limitation period can thereby be interrupted. In addition, Article 1836 § 2 CCP is another source of uncertainty as it provides for a range of circumstances in which the proper serving of the petition does not lead to the initiation of mediation proceedings. The article subjects these regulations to thorough analysis, with particular attention paid to the impact of these situations on interruption of the limitation period on claims (including assessment of the justifiability of such legal solutions and with reference to the views of scholars, as well as de lege ferenda remarks). Mention is also made of issues associated with the limitation period in cases where the court directs the parties to engage in mediation.

Artykuł dotyczy kwestii przerwania biegu przedawnienia roszczeń przez wszczęcie mediacji. W artykule poddano analizie ten przypadek, przedstawiając go najpierw w kontekście pozostałych przewidzianych w Kodeksie cywilnym przyczyn przerwania biegu przedawnienia, które budzą liczne kontrowersje, i na tym tle pokazano, że wątpliwości interpretacyjne powstają także w odniesieniu do tej przyczyny przerwania biegu przedawnienia, zwłaszcza jeśli chodzi o mediację inicjowaną przez stronę. Wynikają one przede wszystkim z tego, że choć zgodnie z art. 1836 § 1 k.p.c. wszczęcie mediacji następuje z chwilą doręczenia przez stronę mediatorowi wniosku o przeprowadzenie mediacji (z dołączonym dowodem doręczenia jego odpisu drugiej stronie), to jednak nie uregulowano prawnie sytuacji, gdy wniosek taki zawierał będzie braki formalne (a poglądy doktryny co do tego, czy możliwe jest ich uzupełnienie i wszczęcie wówczas mediacji, a co za tym idzie – przerwanie biegu przedawnienia, są diametralnie zróżnicowane). Ponadto źródłem wspomnianych wątpliwości jest też art. 1836 § 2 k.p.c., w którym ustawodawca przewidział cały szereg przypadków, w jakich pomimo prawidłowego doręczenia wspomnianego wyżej wniosku nie będzie dochodzić do wszczęcia mediacji. W artykule poddano je dokładnej analizie, ze szczególnym uwzględnieniem wpływu takich sytuacji na przerwanie biegu przedawnienia roszczeń (w tym oceniając zasadność tych rozwiązań prawnych oraz odnosząc się do poglądów doktryny i zgłaszając uwagi de lege ferenda). Podniesiono także kwestie wiążące się z przedawnieniem w przypadku, w którym to sąd kieruje strony do mediacji.
The article points out the importance of the way of taking into account the fact that the claim demanded before the court is time-barred for the perception of the standard of protection of the individual’s rights in court proceedings. It is shown how it depends on whether the limitation period is taken into account ex officio or upon the objection raised by the person against whom the claim is brought.
The text will present arguments raised by the supporters of two different positions regarding the manner of taking into account the expiry of the limitation period, namely those that are supposed to speak in favor of taking this circumstance by the courts ex officio, and those which prevail to take it into account only in the event of raising the plea of limitation by the one against whom the claim is due. Against this background, a polemical analysis will be made with these arguments, including inquiries about interests of which entities or social groups are implemented and protected for each of these solutions. It will be shown that some of the arguments put forward actually emphasize that the institution of limitation is to serve not so much as a party involved in a given claim (creditors or debtors), but rather institutions of the judiciary. It will also be shown that the solution currently in force in Polish civil law, within which the taking into account of the fact that a given claim is time-barred is possible only if the one against whom the claim is entitled raises the relevant claim of limitation, in fact prefers only the more affluent and better educated social strata, deepening the social exclusion of those who, due to, for example, worse property status, do not have the necessary knowledge, nor can afford to take advantage of legal aid. The latter, in effect, often do not plead the expiration of limitation period, because they do not know that they are entitled to it (in general, or are unable to assess when the claim became due, at which point the limitation period began or has ended). Polish civil law is a good example here for considering, firstly, that in the 20th century the regulations concerning the limitation of claims were changed several times, and each time a discussion on how to consider the expiry of the limitation period came to life (which provides rich argumentation with which one can confront) and also because historical and political entanglements play a significant role here. Namely, the text will show that the main resistance against taking into account the expiration of limitation period ex officio (which is a solution that protects the poorer people who can not afford legal assistance) is due to the fact that this solution, which was in force in the original version of the current Polish Civil Code, was modeled on the solutions of Soviet law. This means that after the political change in Poland in 1989, it was automatically attempted to eliminate it, and replace it with a solution used in European countries, where only if the one against whom the claim is entitled raises the relevant claim of limitation, even without any reflection on the substantive legitimacy of such a change and without analyzing the practical social effects of a solution, within which the expiry of the limitation period only is taking into account on when relevant plea is raised, not ex officio. Immersion of considerations in the realities of Polish law will also allow to show interests that have recently clashed on the occasion of the regulation of electronic writ-of-payment proceedings. In this example, it will be shown that despite the legislator making certain facade measures to protect the interests of people with less legal awareness and poorer, who can not afford to get help from a lawyer, in fact, many gates have been left, which question the reality of striving for such protection, because they allow to sue for the claim after the expiration of the limitation period in this proceeding. In this context, the latest change in Polish civil law in this area was also discussed, that is, the Act of April 13, 2018. On the basis of this Act, there has been a return to taking into account the expiration of the limitation period ex officio, but only if the entrepreneur sue the consumer. In the remaining scope, a solution was left within which the expiry of the limitation period is taking into account only when relevant plea is raised.
