Wprowadzenie 20 marca 2020 r. stanu epidemii wywołanej wirusem SARS-CoV-2 spowodowało zmiany w funkcjonowaniu polskiego sądownictwa administracyjnego w zakresie rozpoznawania spraw sądowoadministarcyjnych. Rozwiązania przewidziane w art. 15 zzs4 ustawy covidowej przewidują możliwość przeprowadzenia rozprawy sądowoadministracyjnej w trybie odmiejscowionym za zgodą strony postępowania. Istotnej modyfikacji doznają ponadto uprawnienia przewodniczącego wydziału w zakresie rozpoznawania spraw w sądach administracyjnych. Jednocześnie należy zauważyć, iż nadal ma zastosowanie przepis art. 182 p.p.s.a. odnoszący się do rozpoznawania skarg kasacyjnych przez NSA. Zagrożenie dla zdrowia i życia człowieka wywołane wirusem SARS-CoV-2 spowodowało konieczność dostosowania funkcjonowania sądów administracyjnych do zmienionej rzeczywistości w taki sposób, aby nie niwelować zagrożenie dla stron postępowania poprzez wprowadzenie możliwości przeprowadzenia rozprawy odmiejscowionej bądź rozpoznania sprawy na posiedzeniu niejawnym. Rozwiązanie umożliwiające stronom uczestniczenie w rozprawie zdalnej wpływa na realizację zasady jawności postępowania.

The introduction of the SARS-CoV-2 virus epidemic on March 20, 2020 resulted in changes in the functioning of the Polish administrative judiciary in the field of examining administrative court cases. The solutions provided for in Art. 15 zzs4 of the Covid act provide for the possibility of conducting a court-administrative hearing in a differentiated mode with the consent of the party to the proceedings. Moreover, the powers of the head of the division in the field of hearing cases in administrative courts are significantly modified. At the same time, it should be noted that the provision of Art. 182 p.p.s.a. relating to the examination of cassation complaints by the Supreme Administrative Court. The threat to human health and life caused by the SARS-CoV-2 virus made it necessary to adapt the functioning of administrative courts to the changed reality in such a way as not to eliminate the threat to the parties to the proceedings by introducing the possibility of holding a hearing in a place or hearing the case in closed session. The solution enabling the parties to participate in a remote hearing affects the implementation of the principle of open proceedings.
Legal regulations for advertising medicinal products originate from the acts of European Union Law and the acts of the domestic law. The crucial ones include the Code of Medicines (the Law of European Union) and the Act: the Pharmaceutical Law with executive acts, and the Act on the Reimbursement of Medicines, Foodstuffs for Special Nutritional Purposes and Medical Devices. Advertising medicinal products, being a type of marketing activity, is subject to limitations resulting from the specificity of the advertised product. The product determines the scope of the permitted advertising and the circle of its recipients.
The article deals with legal regulations of the life estate and flat easement contract as discussed in Polish law-related reference sources. The article presents the fundamental provisions, according to which the flat easement is included in the content of the right of life estate; it also defines the parties’ legal rights and obligations arising form those regulations. The performance of the flat easement as well as the ordinary use of estate is connected with expenses, encumbrances and repair costs. As these expenditures are extremely important, they are listed in detail in the article. The analysis takes into account the perspective of practicality and the resulting conclusions permit formulating the assumptions to be used while solving the existing problems or clarifying legal ambiguities concerning the institution of the flat easement and the institution of life estate contract.
