In the gloss to the decision of the Supreme Court of 26 May 2021 (I KK 23/21), the issue ofthe correctness of establishing the scope of the term “health service” with regard to treatments in the field of aesthetic medicine was addressed. In this context, it has been analyzed which entities can legally carry out such treatments and in which cases taking specific actions by an unauthorized person will result in criminal or disciplinary liability.

W glosie do postanowienie Sądu Najwyższego z 26 maja 2021 r. (I KK 23/21) odniesiono się do kwestii prawidłowości ustalenia zakresu pojęcia „świadczenie zdrowotne” odnośnie do zabiegów z zakresu medycyny estetycznej. W kontekście tym przeanalizowano, jakie podmioty mogą przeprowadzać w sposób legalny zabiegi tego rodzaju oraz w jakich przypadkach podjęcie określonych czynności przez osobę nieuprawnioną będzie wiązać się z jej odpowiedzialnością karną lub dyscyplinarną.
