Má EU pravomoci k dosažení cíle sociálně-tržního hospodářství?

While the social market economy is at the first sight one of the many objectives set out in Article 3 of the EU Treaty, it is above all an integrated social model, a set of other EU objectives and a concept that brings together many of these objectives into a single, coherent whole. Achieving this goal requires appropriate powers. This article discusses the 10 main parts of the social market economy contents as analyzed by the current doctrine and compares them with the list of EU competences as set out in the founding Treaties. Through this detailed analysis, it concludes that although EU competencies are relevant to most of the content of the social market economy, the more a specific issue of a social marktet economy gets closer to important aspects of the functioning of the state, the less the impact of the EU and its powers.

I když sociálně tržní hospodářství je na první pohled jedním z mnoha cílů stanovených v článku 3 Smlouvy o EU, je především integrovaným sociálním modelem, souhrnem dalších cílů EU a pojmem, který sdružuje mnohé z těchto cílů do jediného systematického celku. Dosažení tohoto cíle vyžaduje odpovídající pravomoci. Tento článek pojednává o 10 hlavních částech obsahu sociálně tržního hospodářství, jak je analyzován současnou doktrínou, a porovná jej se seznamem pravomoci EU, jak jsou uvedeny v zakládajjících smlouvách. Prostřednictvím této podrobné analýzy dospívá k závěru, že ačkoli pravomoci EU jsou relevantní pro většinu obsahu sociálního tržního hospodářství, čím více se konkrétní problém týkající se sociálně tržního hospodářství přibližuje významným aspektům fungování státu, tím menší je dopad EU a jejích pravomocí.
