Modern enterprise is functioning in a market space in which it is subjected to the whole network of intervention tools in the form of economic regulations. These regulations limit the freedom of its economic activities impacting the business models in use, its internal organization, management systems and, last but not least, its market value. Degree and strength of regulatory intervention is highly differentiated in various countries, depending on the cultivated social and economic model. It also varies depending on the area of economic activities in different groups of enterprises, according to the current perception of its systemic significance. Especially strong regulatory interventions are currently applied for financial institutions. It is because they are threatening the existence of the whole system via the systemic risk they are able to generate. The article explores principal challenges and issues facing the insurance operations and relates them to the enterprise management.

Supervision of the financial markets has become over the last twenty years or so, an increasingly important element of the financial system. It is progressively moving away from passive compliance checks, towards becoming a real and active influence of the financial markets. It is encompassing a growing range both of issues and entities and is undertaking an ever-deeper insight. Financial supervision is also increasingly acquiring regulatory powers through the extensive application of self-produced ‘soft’ regulatory norms as well as accumulation of resources. (proliferating particularly after the recent global financial crisis). The goal of this article is to provide a systematic review of principal challenges currently facing financial supervision. The article is split into three parts. Its first part discusses the theoretical foundations of the supervisory system trying to indicate the sources of its powers, including its societal role. It deserves more attention in view of the unprecedented powers acquired by supervisors over supervised institutions and the financial markets. In the second part we take a close look at the changing supervisory paradigm in its current form. The third part reviews the new challenges facing financial supervision in its search for innovations which adapt to new requirements, and the available opportunities in the development of its new toolkit.

Modern financial systems have been experiencing a period of dynamic changes since the beginning of this century. These changes cause their homogeneous tissue, on which they were based for a long time, to erode, while a multitude of alternatives appears. The existing systems are becoming increasingly heterogeneous and less transparent. In addition to the traditional financial system based on highly regulated financial intermediaries having a legal monopoly, an alternative sector is emerging. It is often based on a different market infrastructure, which allows for direct allocation and acquisition of funds on a P2P or B2B basis and with other rules and intermediate parties. Technological innovations, especially the ubiquitous process of digitisation of financial systems, play a special role in this process of change. The considerations concerning digital financial markets in the current research and literature are focused basically on three issues: competition in the financial market, regulation and supervision of the market in the conditions of its digitisation, and consumer protection issues, including in particular financial exclusion and methods of its counteracting.

Współczesne systemy finansowe przeżywają od początku obecnego stulecia okres dynamicznych zmian. Powodują one, że ich jednolita tkanka, na której były one przez długi czas oparte, ulega erozji i pojawia się mnogość bytów alternatywnych. Istniejące systemy stają się coraz bardziej niejednorodne i mniej przejrzyste. Obok tradycyjnego systemu finansowego, opartego na silnie regulowanych i dysponujących monopolem prawnym pośrednikach finansowych, wyłania się sektor alternatywny. Oparty on jest często na odmiennej infrastrukturze rynkowej, która pozwala na bezpośrednie alokowanie i pozyskiwanie środków finansowych na zasadzie P2P czy B2B oraz na innych regułach i podmiotach pośredniczących. Szczególną rolę w tym procesie zmian odgrywają obecnie innowacje technologiczne, zwłaszcza wszechobecny proces cyfryzacji systemów finansowych. Zagadnienia cyfrowych rynków finansów skoncentrowane są w obecnych badaniach i literaturze zasadniczo wokół trzech zagadnień: konkurencji na rynku finansowym, regulacji i nadzoru nad rynkiem w warunkach jego cyfryzacji oraz kwestii ochrony konsumenta, w tym zwłaszcza zagadnień wykluczenia finansowego i metod przeciwdziałania.

Financial consumer protection has become in the aftermath of a global financial crisis a target of numerous regulatory initiatives and an object of an increased academic penetration. We are witnessing a sharp redefinition of the type and scope of financial consumer protection model, applied supervisory models as well as institutional arragement. This is by far and large a result of an overall change in the regulatory supervisory paradigm of the financial markets. The paper reviews principal elements of the new global financial consumer protection model and illustrates its implementation in the single insurance market of the EU. It indicates dramatic changes in this regard and departure from point of sale to the whole life cycle approach.

Wskutek globalnego kryzysu finansowego, ochrona konsumentów usług finansowych stała się celem szeregu inicjatyw regulacyjnych oraz obiektem zwiększonej penetracji badań naukowych. Aktualnie jesteśmy świadkami całkowitego przedefiniowania rodzajów i zakresu modelu ochrony konsumentów usług finansowych, stosowanych modeli nadzorczych, jak również porządku (układu) instytucjonalnego. Dzieje się tak w znacznym stopniu za sprawą ogólnej zmiany w paradygmacie nadzoru publicznego na rynkach finansowych. Artykuł stanowi przegląd podstawowych elementów nowego globalnego modelu ochrony konsumentów usług finansowych oraz prezentuje jego implementację na jednolitym rynku ubezpieczeniowym UE. Wskazuje ogromne zmiany, jakie zachodzą w tym względzie oraz ilustruje odejście od koncentracji na sprzedaży produktu, na rzecz podejścia holistycznego, opartego na całym cyklu życia produktu.
