The reflections included in the article concern the planned changes in liability rules for several behaviours currently classified as misdemeanours and the plans to reclassify them as administrative torts, which equals a conversion of criminal liability system (for misdemeanours) into an administrative-criminal one. The article discusses the purpose of the planned change, possible problems arising from the change of the liability system and most importantly, the problem of instituting adequate standards and ensuring the imposition of sanctions for committing acts currently classified as misdemeanours and to be reclassified as administrative-criminal torts, so that the change of liability system is not perceived solely as the legislator’s circumvention of the guarantee of the civil rights typical for criminal liability (liability for felonies and misdemeanours) and as an instrument of fiscalism, which would make the decriminalization only ostensibly effective.
