Ze względu na specyfikę utworu audiowizualnego, łączącego w sobie wiele gatunków twórczości, powstają wątpliwości związane z ustaleniem grona jego współtwórców. O ile sytuacja prawna reżysera, operatora obrazu, twórcy adaptacji utworu literackiego, twórcy stworzonych dla utworu audiowizualnego utworów muzycznych lub słowno-muzycznych oraz twórcy scenariusza wynika bezpośrednio z treści ustawy, o tyle sytuacja pozostałych podmiotów zaangażowanych w produkcję utworu audiowizualnego nie została wprost uregulowana przez polskiego ustawodawcę. Niniejsza publikacja ma na celu przedstawienie wypracowanych przez doktrynę i orzecznictwo przesłanek, których spełnienie jest niezbędne, aby nadać danej osobie status współtwórcy utworu audiowizualnego, oraz przedstawienie uprawnień przysługujących jej z tego tytułu.

The aim of this publication is to present legal regulations regarding co-authors of an audiovisual work. Due to the specificity of an audiovisual work, which contains combinations of various creative contributions, doubts arise in the context of how to determine the group of its co-authors. While the legal status of the director, the cinematographer, the creator of the adaptation of a literary work, the creator of musical and verbal and the script writer is clearly stated in Polish regulations, the legal status of other entities involved in the production of an audiovisual work has not been regulated. The issue discussed includes the premises elaborated by the doctrine and jurisprudence that are necessary to qualify an entity as a co-author of an audiovisual work and also the entitlements which arise from the co-authorship.
