This article is devoted to discussing specific solutions in the field of environmental impact assessments of projects regulated by the Act of June 9, 2011 on Geological and Mining Law. Particular attention has been paid to recent changes in this area. They mainly concern the extension of the scope of exemptions from the obligation to obtain a decision on environmental conditions.

Artykuł ten poświęcony jest omówieniu szczególnych rozwiązań w zakresie ocen oddziaływania na środowisko przedsięwzięć regulowanych ustawą z dnia 9 czerwca 2011 r. – Prawo geologiczne i górnicze. Szczególna uwaga została poświęcona ostatnim zmianom w tym zakresie. Dotyczą one przede wszystkim rozszerzenia zakresu zwolnień od obowiązku uzyskania decyzji o środowiskowych uwarunkowaniach.

The subject of this article is the analysis and detailed interpretation of the provisions of the Act of 3 October 2008 on the provision of information about the environment and its protection, public participation in environmental protection and environmental impact assessments (Journal of Laws of 2020, item 283) concerning reconcilation decisions on environmental conditions. The issues discussed in the article are important both from the theoretical and practical point of view. It refers to the continuous development of a specific administrative procedure, which is the “procedure in environmental matters”. The practice of applying the above-mentioned provisions is also important. Environmental impact assessments play a key role in the investment proces.

Przedmiotem niniejszego artykułu jest analiza i szczegółowa wykładnia przepisów ustawy z dnia 3 października 2008 r. o udostępnianiu informacji o środowisku i jego ochronie, udziale społeczeństwa w ochronie środowiska oraz o ocenach oddziaływania na środowisko (Dz.U. z 2020 r., poz. 283) dotyczących uzgadniania decyzji o środowiskowych uwarunkowaniach. Poruszana w artykule problematyka jest ważna zarówno z teoretycznego, jak i praktycznego punktu widzenia. Odnosi się bowiem do ciągłego tworzenia się szczególnej procedury administracyjnej, jaką jest „postępowanie w sprawach środowiskowych”. Istotna jest również praktyka stosowania wspomnianych przepisów. Oceny oddziaływania na środowisko odgrywają bowiem kluczową rolę w procesie inwestycyjnym.

Lack of general planning duty along with long time required for conduction of procedures concerning passing (introducing changes) in local area development plans lead to substantial difficulties in making location of numerous investment of public nature (public aim investments). Unfortunately the Act of 27th March 2003 on spatial planning and development (Journal of Laws of 2012 item 647 with subsequent changes) does not foresee any particular solutions. Therefore legislator decided to introduce particular regulations within this field. Decisions which approve of carrying out respective investments determining their location are to be solution to the above mentioned problems. The most frequently spatial planning and development regulations are not applied while issuing these decisions, although sometimes they are binding while making local plans, or issuing decisions on development conditions, as well as area development plans. Decisions which are issued within this scope can be determined as particular substitutes of spatial planning. However, it is worth to underline that the above mentioned acts determine also number of different issues connected with conditions of carrying out plans and can result in real estate expropriation at the area of planned undertaking, or at last some of them constitute consent to its construction.
