Artykuł porusza problematykę odsunięcia od władzy W. Janukowycza przez ukraiński parlament w lutym 2014 r. W tym celu zaprezentowano uchwały Rady Najwyższej Ukrainy z tamtego okresu dotyczące usunięcia z urzędu prezydenta W. Janukowycza, ze szczególnym uwzględnieniem uchwały z 22 lutego 2014 r. o samoodsunięciu się prezydenta Ukrainy od wykonywania konstytucyjnych kompetencji oraz zarządzeniu przedterminowych wyborów prezydenta Ukrainy. Wnikliwa analiza tych uchwał w świetle obowiązującej wówczas ukraińskiej ustawy zasadniczej, orzecznictwa Sądu Konstytucyjnego Ukrainy oraz piśmiennictwa, prowadzi do wniosku o słuszności postawionej w artykule tezy, iż odsunięcie od władzy prezydenta W. Janukowycza zostało dokonane przez Radę Najwyższą Ukrainy w sposób niezgodny z Konstytucją, z naruszeniem takich jej zasad jak zasada: suwerenności narodu, podziału władzy, zwierzchnictwa prawa i nadrzędności Konstytucji, legalizmu działania organów władzy państwowej, czy zakazu uzurpacji władzy.

The article brings up issues of the removing V. Janukovych from power by Ukrainian parliament in February 2014. For that reason resolutions from that period passed by Verkhovna Rada of Ukraine (concerning divesting V. Janukovych of president’s power) were discussed, particularly Resolution on February 22nd, 2014 on Self-Removal of the president of Ukraine from his Constitutional Authority and Early Elections of the president of Ukraine. Thorough analysis of Ukrainian parliament’s resolutions mentioned above in the light of legally binding Ukrainian Constitution at that time, judicial decisions of the Constitutional Court of Ukraine and literature, leads to conclusion, that the divesting V. Janukovych of power by Verkhovna Rada of Ukraine occurred with violation of the Fundamental Law of Ukraine, first of all, principles of: people’s sovereignty, state power division, rule of law and supremacy of Constitution, legality of acting of bodies of state power, ban of state power usurpation, too. This analysis proves an assumption made in the article that Verkhovna Rada of Ukraine divested the Ukrainian president of power unlawfully.

The article brings up issues of the change of the constitutional order in Ukraine in February 2014. For that reason the normative acts passed during that period by Verkhovna Rada of Ukraine (concerning the change of constitutional order) are discussed, in particular: (a) the Act of February 21st, 2014 on Restoring Specifi c Provisions of the Constitution of Ukraine, (b) Resolution of February 22nd, 2014 and (c) Resolution of February 24th, 2014. Detailed analysis of Ukrainian parliament’s acts mentioned above (including the reasons for their adoption) in the light of the Constitution legally binding at that time, judicial decisions of the Constitutional Court of Ukraine and literature, leads to the conclusion that the change of constitutional order in Ukraine occurred in a manner inconsistent with the Basic Law of Ukraine, primarily in violation of the principles of: supremacy of Constitution, separation of powers, legality of operation of State authorities and independence of the judiciary, and ban on state power usurpation. This analysis proves an assumption made in the article that Verkhovna Rada of Ukraine introduced amendments to the constitutional order unlawfully.
