By act of 31 January 1980 on the Supreme Administrative Court and alteration of act – the Code of Administrative Procedure, an institution of administrative settlement was introduced granting it a position of a common institution. In the hereby article there were presented pre-requisites speaking for a code regulation of this institution. A differenti-ated attitude of researches was presented in the matter of introducing it to the Code of Administrative procedure. Legal regulations were ana-lysed, which enable concluding an administrative settlement, and more-over effects which are caused by concluding it, as well as consequences of refusal to approve it. On grounds of the carried out study concerning information on activity of three local government boards of appeal it was observed that despite functioning of the administrative settlement in Poland for over 30 years, it is not used entirely. Statements of doc-trine and jurisdiction were subject to analysis in the hereby elaboration.
