Niniejszy artykuł przedstawia syntetyczny opis funkcjonowania budżetu partycypacyjnego w Madrycie. Wskazane zostały zarówno początki omawianego narzędzia demokracji semibezpośredniej, jak i jego obecny kształt. Poruszono kwestie normatywne, ustrojowe jak i społeczne. Tekst zawiera również ocenę rozwiązań przyjętych w stolicy Hiszpanii.

This article synthetically describes the functioning of participatory budgeting in Madrid. It points out both the origins of this tool of semi-direct democracy and its current form. It addresses normative, systemic, and social issues. The text also contains an evaluation of the solutions adopted in the Spanish capital.

Artykuł stanowi wstępną ocenę planowanych zmian normatywnych w treści ustaw samorządowych, tj. ustawy z 8 marca 1990 r. o samorządzie gminnym1 , ustawy z 5 czerwca 1998 r. o samorządzie powiatowym2 oraz ustawy z 5 czerwca 1998 r. o samorządzie województwa3 , w zakresie funkcjonowania rad seniorów. Celem niniejszego opracowania jest wskazanie głównych problemów, mogących stanowić przyczynek do dalszej, pogłębionej dyskusji doktrynalnej. Zasadnicze modyfikacje prawne odnoszą się do możliwości wprowadzenia wskazanego instrumentu demokracji semibezpośredniej również na szczeblu powiatu oraz województwa, a także inicjatywy powołania rady seniorów na wniosek mieszkańców. Przeprowadzone rozważania zawierają konkretne postulaty de lege ferenda, a także określają, czy planowane zmiany nie naruszą istoty wskazanego instrumentu partycypacyjnego.

This article is an assessment of the planned normative changes to the content of local government laws, i.e. the Act of 8 March 1990 on municipal government, the Act of 5 June 1998 on county government and the Act of 5 June 1998 on provincial government, as regards the operation of senior citizens’ councils. The purpose of this study is to identify the main problems, which may be a contribution to further in-depth doctrinal discussion. The main modifications relate to the possibility of introducing the indicated instrument of semi-direct democracy also at the county and voivodeship level, as well as the initiative to establish a council of seniors at the request of residents. The conducted considerations contain specific de lege ferenda postulates and also determine whether the planned changes will not affect the essence of the indicated participatory instrument.
