The term ‘administrative state’ is rather unknown in Poland and therefore not used both by academia and public officials. The text aims to ascribe to this term specific model meaning, which should allow us to place the term ‘administrative state’ in the administrative language and make administrative state a distinct field of research.

This article offers an analysis of the rule of law including its multiplicity of meanings, evolution and functions. The analysis confirms that the rule of law is an exceedingly elusive concept. However, its main role is unquestionable: it operates to ensure that governmental power is not abused.

The analysis offers a closer examination of the discussed phenomenon, as well as identifies some obstacles on the road to creating a European administrative space (European administrative system) which at the current stage of a European administrative integration is still more of a model describing hypothetical administrative future than an already existing administrative presence.
