Judykatura konstytucyjna zabrania prowadzenia w amerykańskich uniwersytetach publicznych działalności religijnej naruszającej proces dydaktyczny i naukowy, w szczególności zaś ekspresji religijnej aranżowanej przez organy publiczne („prohibited government speech endorsing religion”). Niedopuszczalna jest modlitwa (a tym bardziej jej formy złożone) organizowana przez władze uczelni. Zabroniona jest indoktrynacja religijna czyniona w ramach zakresu obowiązków przez osoby zatrudnione w uczelni i związane z tym dostosowywanie treści wykładów i składu grona wykładowców do wymagań ortodoksji którejkolwiek religii. Przedmiotem zakazu jest także instalowanie wyizolowanych od elementu świeckiego emblematów o charakterze jednoznacznie religijnym - mniej surowy reżim w tym zakresie dotyczy terenów publicznych poza pomieszczeniami zamkniętymi. Jednocześnie słuchacze uczelni i jej pracownicy dysponują szerokim zakresem wolności sumienia i wyznania, pozwalającej na działania o charakterze religijnym, które nie naruszają procesu dydaktycznego i badawczego w uczelniach (np. inicjowana przez te osoby modlitwa indywidualna i w grupach, prowadzenie dyskusji na tematy religii, udzielanie porad duszpasterskich, w tym i sprawowanie aktu spowiedzi, dystrybucja literatury religijnej itd.). Począwszy od lat 80. minionego stulecia Sąd Najwyższy USA orzekał w materii tutaj omawianej w sposób, który pozwalał na szerszą niż wcześniej ekspresję religijną na uniwersytecie publicznym. Jednakże ogół obowiązujących w tym zakresie norm posiada nadal charakter daleko bardziej rygorystyczny w zestawieniu z sytuacją panującą w niemal wszystkich państwach europejskich.

The constitutional judicature prohibits American public universities from undertaking religious activity interfering with the didactic and research work, especially religious expression arranged by public bodies. Prayer, especially in its complex form, organized by university authorities is inadmissible, just as the religious indoctrination on the part of university employees during the execution of their duties and the related adjustment of one’s lectures and the composition of the teaching staff to the requirements of the orthodoxy of any religion. The subject matter of the ban also concerns installing emblems which are isolated from the secular element and whose character is unequivocally religious. In that respect, a less rigorous regime applies only to public areas outside the closed spaces. At the same time, students and university employees are entitled to a broad scope of freedom of conscience and religion, which allows for such religious activity which will not infringe on the didactic and research processes at universities (for example, initiating individual and group prayer, holding religious discussions, giving pastoral advice, including acts of confession, distributing religious literature, etc.). From the 1980s, the Supreme Court of the United States made such decisions on the matters presented, which allowed far greater religious expression than before at universities. However, the relevant norms are still much more rigorous than those in almost all European countries.
W toku swojej ponad 200-letniej historii skolonizowany przez Brytyjczyków kontynent australijski był miejscem realizacji różnych modeli relacji między władzą publiczną a religią, a więc i różnych sposobów określania w prawie granic wolności religijnej. Początkowy model ścisłego zespolenia państwa i Kościoła Anglikańskiego ustąpił systemowi prawnego uprzywilejowania wybranych Kościołów chrześcijańskich, który jednocześnie zapewniał daleko idącą tolerancję dla pozostałych wspólnot religijnych. Rozwiązanie to następnie zastąpione zostało przez model – niekonsekwentnego wprawdzie – rozdziału struktur władzy publicznej od struktur religijnych. Po powstaniu federacji australijskiej ukształtowało się prawodawstwo pozwalające na pragmatyczne popieranie przez protestanckie pod względem ideowym państwo gotowych do współpracy z nim wspólnot religijnych. W postawie akomodacji państwa do religii widoczne było jednak preferencyjne traktowanie światopoglądu religijnego kosztem światopoglądów areligijnych, preferencyjne traktowanie wspólnot chrześcijańskich kosztem niechrześcijańskich oraz sprzyjanie wspólnotom religijnym o dłuższej historii. W warunkach pogłębiającego się na początku nowego millenium pluralizmu ideowego społeczeństwa australijskiego, przed tamtejszym prawem stanowym i federalnym stoi wszakże zadanie przekształcenia dotychczasowego modelu, by sprostać oczekiwaniom żywionym przez członków wielokulturowego, wielowyznaniowego i wieloetnicznego społeczeństwa, które coraz wyraźniej będzie artykułować potrzebę nowoczesnych gwarancji prawnych dla swobód światopoglądowych na wzór systemów ochrony przyjętych w krajach Unii Europejskiej lub USA.

Throughout over two hundred years of its history, the Britain-colonized Australian continent has seen various models of relations between the secular and religious authority and, consequently, various legal solutions to the issue of the boundaries of religious freedom. The original model of relative unity of the state and the Anglican Church was superseded by a system of legal privileges granted to selected Christian churches, however, with far-reaching toleration of the remaining religious communities. This solution was further replaced by a model of – though not complete – separation between the public authorities and religious structures. After the establishment of the Australian Federation, the newly-made legislation allowed the ideologically Protestant state to sanction cooperative religious groups. Nevertheless, the state’s attitude to religion displayed a preferential treatment of religious rather than non-religious outlook, of Christian rather than non-Christian communities and favouring religious groups of long standing. With the currently deepening ideological pluralism of the Australian society, the country’s state and federal law is facing a challenge of transforming the existing model in order to meet the expectations of the multicultural, multiconfessional and multiethnic society. This society will even stronger voice the requirement of modern legal guarantees for the liberty of worldviews, following the patterns adopted in the USA and European Union.
Oceniając proces regulacji spraw majątkowych Kościoła Ewangelicko-Augsburskiego po 1989 r. na terenie Gdańska należy stwierdzić, że możliwość pozyskiwania przez polski Kościół Luterański dawnych nieruchomości ewangelickich na terenie miasta została wykorzystana w wysokim stopniu. Wnioski złożono szybko po chwili zaistnienia prawa składania żądań rewindykacyjnych i zostały w stosunkowo niedługim czasie rozpatrzone. Rezultat tych starań był relatywnie zadawalający, lecz daleki od optymalnego. Ze względu na wcześniejsze przejęcie najbardziej prestiżowego i atrakcyjnego ewangelickiego majątku kościelnego przez inne związki wyznaniowe (w zdecydowanej większości przez Kościół Rzymskokatolicki), gdańska Parafia Ewangelicko-Augsburska miała nikłe szanse na pozyskanie interesujących obiektów kościelnych na terenie miasta. Spośród 9 złożonych wniosków odnoszących się do co najmniej 10 nieruchomości, tylko jedna została przekazana zgodnie z wnioskiem, przy czym była to wieża zburzonego w czasie działań wojennych kościoła. W miejsce pozostałych parafia Kościoła Ewangelicko-Augsburskiego otrzymała obiekty spoza dawnego zasobu sakralnego i ewangelickiego. Biorąc pod uwagę wielowiekową czołową pozycję luteranizmu na forum religijnym Gdańska efekt postępowania regulacyjnego trudno uznać za adekwatny. W toku procedury rewindykacyjnej postawa przedstawicieli Kościoła Luterańskiego była powściągliwa i realistyczna. W sprawach szczególnie drażliwych wnioskodawca zachowywał się z taktem, czego najmocniejszym dowodem było wycofanie wniosku dotyczącego obiektów szpitala im. Mikołaja Kopernika.

When evaluating the process of regulation of property matters of the Lutheran Church after 1989 in the city of Gdańsk, it should be stated that the church has taken considerable advantage of regaining former evangelical property in the urban area. The relevant applications were submitted immediately the right of regaining became effective and were answered in a relatively short time. The effects of these attempts were comparatively satisfactory, yet far from most favourable. Due to a former seizure of the most prestigious and attractive evangelical church property by other religious associations (predominantly by the Roman Catholic Church), the Gdańsk Lutheran parish had but a mere chance to take possession of interesting church property in the city. From among 9 submitted applications involving at least 10 sites, only one was regained according to the application: the tower of a war-torn church. In lieu of other sites, the Lutheran parish was offered the property situated outside the former sacred and evangelical site. Taking into account a many centuries’ leading position of Lutheranism in the Gdańsk religious forum, the result of the regulatory proceeding appears far from adequate. In the course of the proceedings, a stance adopted by the representatives of the Lutheran Church was realistic and reticent. In most sensitive cases the applicant exercised tact, which was corroborated by the withdrawal of the application concerning the complex of Mikołaj Kopernik Hospital.
Prawo wewnętrzne, o którym mowa w art. 3 ust. 2 ustawy z dnia 20 lutego 1997 r. o stosunku Państwa do gmin wyznaniowych żydowskich w Rzeczypospolitej Polskiej, budzi szczególne zainteresowanie zważywszy na nietypową na tle innych ustaw wyznaniowych strukturę organizacyjną związku wyznaniowego podlegającego tej ustawie. Jest ono dodatkowo wzmocnione przez okoliczność udziału żydowskich osób wyznaniowych w szeroko zakrojonym procesie regulacji spraw dotyczących mienia żydowskiego. Z analizy Prawa Wewnętrznego z dnia 15 stycznia 2006 r. czynionej na tle wskazanej ustawy wynika, iż prawodawca wyznaniowy przyjął w wydanych przez siebie przepisach koncepcję ustroju związku wyznaniowego odmienną od koncepcji wyrażonej w przedmiotowej ustawie. Wykreował byt pod nazwą Wyznaniowa Wspólnota Żydowska, obejmujący jednostki organizacyjne określone w Ustawie oraz jednostki przez siebie ustanowione (w tym oddziały Związku Gmin Wyznaniowych Żydowskich). W szczególności umożliwił osobom wyznania mojżeszowego posiadanie członkostwa poza gminami żydowskimi (bezpośrednio w Związku Gmin), wyposażając tych członków w węższy katalog uprawnień niż przysługujący członkom gmin. System organów Związku Gmin ukształtowany został w taki sposób, iż przedstawiciele gmin stanowią tylko część składu ciał kolegialnych decydujących o kluczowych aspektach działalności związku wyznaniowego.

The Internal Law referred to in Article 3(2) of the Act of 20 February 1997 on the relationship between State and Jewish religious communities in the Republic of Poland garners special attention given the unusual - compared with other acts regulating religious affairs - organizational structure of the religious association covered by this act. It is reinforced by the fact that Jewish religious persons take part in the broad process of resolving the issues pertaining to Jewish property. The analysis of the Internal Law of 15 January 2006 against the backdrop of the mentioned act shows that in the proposed provisions the religious legislator had adopted a concept of the system governing its religious association that is materially different from the concept prescribed in the act. It created an entity known as the Religious Jewish Community, made up of organizational units defined in the act and independently established units (including the branches of the Union of Jewish Religious Communities). In particular, it enabled the people of Mosaic persuasion to have the membership outside the Jewish communities (directly in the Union), thus vesting lesser rights in such members than in any members of the communities. The system of the Union bodies was designed in such a way that the representatives of the communities constitute only a fraction of the collective bodies deciding on the key issues of the religious association's activity.
