Celem niniejszego opracowania jest wykazanie różnic i podobieństw pomiędzy ochroną informacji niejawnych a tajemnicą bankową oraz wskazanie możliwości przeniesienia pewnych mechanizmów ochronnych zawartych w ustawie o ochronie informacji niejawnych na grunt prawa bankowego. Szeroki zakres wymagań, jakie należy spełnić aby, mieć dostęp i móc przetwarzać informacje niejawne w stosunku do wymogów ochrony tajemnicy bankowej poddaję pod wątpliwość, czy ta druga jest należycie chroniona.

The aim of this paper is to demonstrate the differences and similarities between the protection of classified information and banking secrecy, and an indication of the possibility of the transfer of certain safeguard mechanisms contained in the Act on Protection of Classified Information to the ground of the Banking Law. Definitely higher requirements which must be met in order to have access and be able process the classified information in relation to the requirements of the protection of banking secrecy puts into question whether the latter is adequately protected.
