Zmiana konstytucji następuje zazwyczaj przy zastosowaniu ściśle określonej procedury i ma charakter trwały. Nieliczne współczesne państwa europejskie dopuszczają jednak możliwość uchwalenia odstępstwa od konstytucji, tzw. ograniczonego wyjątku. Tego rodzaju rozwiązanie wprowadziła w 2012 r. Belgia, pomimo braku stosownych przepisów oraz praktyki w tym zakresie. Belgijskie odstępstwo od konstytucji modyfikuje czasowo procedurę zmiany konstytucji. Polega to na odstąpieniu od typowego dla państw nordyckich wymogu uchwalenia zmiany ustawy zasadniczej przez parlament dwu kolejnych kadencji parlamentu. Pozostałe elementy procedury zmiany belgijskiej konstytucji, takie jak zrównanie praw izb parlamentu oraz podwyższone kworum oraz większość wymagana dla uchwalenia zmiany pozostały bez zmian. Odstępstwo od Konstytucji Belgii wygasa wraz z zakończeniem kadencji parlamentu wybranego w 2010 r.

Changing of the constitution is usually followed by using a well-defined procedure. Few European countries allow the possibility of adopting a limited exception to the Constitution. Such a law introduced in 2012, Belgium, despite the lack of appropriate legislation and practice in this field. Belgian exception to the constitution temporarily modifies the procedure for changing the constitution. This involves the withdrawal of typical Nordic countries requiring approval of amendment of the constitution by two term of the parliament. Other elements of the procedure for amending the Belgian Constitution, such as equal rights of the House of Representatives and the Senate, and increased quorum and majority required for approval of amendment, remained unchanged. Validity exception of the Belgian Constitution ends with the term of the parliament elect-ed in 2010.
Many European countries show tendency to increase the participation of the sovereign, i.e. citizens, in the revision of the constitution. Generally, the citizens may directly participate in the procedure of constitutional revision by means of the folowing solutions: civil initiative, a priori referendum, elections preceding the adop- tion or re-adoption of the constitutional revisions, a posteriori referendum passing, approving or abrogating the revisions and adoption of the constitutional revisions by a referendum. The above-mentioned institutions have not been adopted in 10 European countries, though it is hard to indicate any other difference than the non-application of civil participation institutions in the course of constitutional revisions. It maybe considered surprising that among the countries, apart from Principality of Monaco and State of the Vatican City, are the United Kingdom, the Federal Republic of Germany, Czech Republic, the Republic of Slovakia, the Republic of Portugal, the Republic of Cyprus, the Republic of Greece and Republic of Bosnia and Herzegovina.

W wielu współczesnych państwach europejskich można stwierdzić tendencję do zwiększania udziału suwerena, za jakiego uznaje się naród, w procedurze zmiany konstytucji. Generalnie można wskazać następujące możliwości bezpośredniego udziału obywateli w tym procesie: po pierwsze, ustanowienie konstytucyjnej inicjatywy obywatelskiej; po drugie, instytucja referendum a priori; po trzecie, wybory poprzedzające uchwalenie lub ponowne uchwalenie zmian konstytucji; po czwarte, referendum a posteriori, w wariancie stanowiącym, zatwierdzającym lub abrogacyjnym; po piąte, uchwalenie zmiany konstytucji w drodze referendum. Powyższe instytucje nie występują w dziesięciu państwach europejskich, przy czym trudno wskazać jakikolwiek wspólny wyróżnik. poza nie stosowaniem do instytucji partycypacji obywatelskiej, gdy chodzi o procedurę zmiany konstytucji. Pewne zdziwienie może budzić fakt, że obok Monako i Watykanu do grupy tej zaliczają się także Zjednoczone Królestwo, Republika Federalna Niemiec, Czechy, Słowacja, Portugalia, Grecja, Cypr oraz Bośnia i Hercegowina.
Konstytucja Republiki Francuskiej jest aktem obowiązującym dłużej niż inne francuskie konstytucje. Od 1958 r. została poddana 24 nowelizacjom, co pozwala uznać, że procedura jej zmiany nie należy do nadmiernie rygorystycznych. Jednak nowelizacja francuskiej ustawy zasadniczej jest realizowana w trybie wyraźnie różniącym się od procedury ustawodawczej, co każe traktować ją jako sztywną. Pozwala to zakładać, że twórcom Konstytucji V Republiki udało się stworzyć ustawę zasadniczą stabilizującą ustrój państwa, ale pozwalającą na jego ewolucję pod wpływem zmieniających się realiów. Niniejsze opracowanie stanowi analizę procedury zmiany Konstytucji Republiki Francuskiej w celu stwierdzenia, jakie konstrukcje prawne zastosowano w celu uzyskania tego efektu.

The Constitution of the Republic of France is an act of force longer than other French constitutions. Since 1958, 24 amendments were carried out, which leads to the conclusion that the procedure should not change it to overly stringent. However, the French amendment of the constitution is implemented under clearly different from the legislative process, which makes treated as rigid. This allows to assume that the authors of the Constitution of the Fifth Republic has managed to create a fundamental law stabilizing the state system, but allowing its evolution under the influence of changing realities.This study is an analysis of the procedure for amending the Constitution of the French Republic in order to determine what legal structures used to achieve this effect.
The article refers to the problem of inadequacy of the classification of the constitution due to the mode amend them. The purpose of the analysis was to determine the scope of the diversity of procedures for the amendment of constitutions as well as to create a typology of such procedures, with consideration to their individual components, their functions and effects of their use. To this end, I conducted a review of applicable solutions in terms of grouping related institutions. Considerations begin with indication of systemic importance of amendment procedures, the reasons for the use of stringent solutions and low popularity of flexible acts. For this purpose, it was necessary to present the origin and foundations of the division into rigid and flexible constitutions. Two-step classification proposed by JB Bryce over 130 years ago is not applicable to modern constitutions. The new three-step classification takes into account hedging instruments, which are used in the constitutions created in the twentieth century. The analysis included the following stages of work on the revision modern European constitution. As a result, they managed to identify different types of instruments intended to ensure the functionality and stability of the political system. Because of its universal nature it can be applied to all of the constitution historical and current, regardless of the provisions made for their protection.

Artykuł odnosi się do problemu nieadekwatności stosowanych w nauce prawa konstytucyjnego klasyfikacji konstytucji ze względu na tryb ich zmiany. Klasyfikacja dwustopniowa, zaproponowane przez J.B. Bryce’a ponad 130 lat temu nie da się zastosować do nowoczesnych konstytucji. Nowa klasyfikacja trzystopniowa uwzględnia instrumenty zabezpieczające, jakie są stosowane w konstytucjach stworzonych w XX w. Analiza objęła kolejne etapy prac nad zmianą współczesnych konstytucji europejskich, począwszy od inicjowania zmiany, poprzez jej opracowanie, uchwalenie, aż do ogłoszenia. Dzięki temu udało się wskazać różne rodzaje zabezpieczeń, mających zagwarantować ich funkcjonalność oraz stabilność ustroju państwa, a także dokonać ich pogrupowania. Pozwoliło to na stworzenie nowej klasyfikacji progresywnej. Ze względu na swój uniwersalny charakter może być stosowana do wszystkich konstytucji: historycznych i współczesnych, niezależnie od wprowadzonych do ich przepisów zabezpieczeń.
Artykuł jest próbą wskazania organów konstytucyjnych Polski, których funkcjono-wanie można udoskonalić poprzez zastosowanie rozwiązań funkcjonujących w in-nych państwach. Zmiana sposobu wyłaniania Senatu postrzegana jest jako szansa na podniesienie jakości uchwalanych w Polsce ustaw. Wprowadzenie instytucji wi-ceprezydenta ma usprawnić działanie urzędu Prezydenta Rzeczypospolitej i unie-zależnić go od parlamentu. Powierzenie kontroli konstytucyjności prawa Sądowi Najwyższemu może przyczynić się do odpolitycznienia tego procesu. Podobny efekt można osiągnąć w przypadku odpowiedzialności konstytucyjnej, o ile jej egzekwo-wanie przejmą sądy powszechne.

The article is an attempt to identify the constitutional authorities of Poland, whose func-tioning can be improved through the application of solutions operating in other coun-tries. The change in the way the Senate is elected is seen as an opportunity to improve the quality of the statutes passed in Poland. The appointment of the vice president is to im-prove the functioning of the office of the President of the Republic and to make him in-dependent of the parliament. Entrusting the constitutional review of the law to the Su-preme Court can contribute to the depoliticization of this process. A similar effect can be attained in the case of constitutional responsibility, provided that its common courts are enforced.
The practice of placing in the constitution provisions relating to state symbols (emblem, flag, anthem) is satisfactory. Often accompany such regulation standards, the task is to indicate the center of which is the state capital. The desirability of such regulations is questionable, hence the question whether it is a common practice. The analysis covers the EU Member States. It is a inhomogeneous group, which should be considered as an advantage, because it allows to review the solutions. The aim is to answer the question of whether the EU countries there is a widespread practice of the constitutional establishment of the state capital, whether it is the dominant model, is it possible there are different solutions in this area, when such adjustments are redundant, whether such cases allow conclusions that can be application in practice of Polish political system.

Nierzadko takim regulacjom towarzyszą normy, których zadaniem jest wskazanie ośrodka będącego stolicą państwa. Celowość takich unormowań budzi wątpliwości, stąd pytanie, czy jest to praktyka powszechna. Przeprowadzona analiza obejmuje państwa członkowskie Unii Europejskiej. Jest to grupa niejednorodna, co należy uznać za zaletę, gdyż pozwala dokonać przeglądu stosowanych rozwiązań. Celem jest odpowiedź na pytania, czy w państwach UE istnieje powszechna praktyka konstytucyjnego ustanawiania stolicy państwa, czy jest to model dominujący, czy możliwe są odmienne rozwiązania w tym zakresie, w jakich przypadkach takie regulacje są zbędne, czy przypadki takie pozwalają na wyciągnięcie wniosków mogących mieć zastosowanie w polskiej praktyce ustrojowej.
The Polish National Assembly is a constitutional governing body, endowed with unique powers that cannot be exercised by any other body. However, the status of the Assembly as a separate state organ raises doubts. Since the restoration of the Assembly, its position in the system has changed significantly, which was related to the multiple modification of the competences of this organ. The evolution of this organ in 1989-2020 allows treating it as an interesting research case. Especially since the competences of the National Assembly are crucial for ensuring the continuity of state power.

Polskie Zgromadzenie Narodowe jest konstytucyjnym organem władzy, wyposażonym w unikalne kompetencje, których nie może wykonać żaden inny organ. Status Zgromadzenia jako odrębnego organu państwa budzi jednak wątpliwości. Od czasu przywrócenia Zgromadzenia jego pozycja ustrojowa zmieniła się w sposób znaczący, co było związane z wielokrotną modyfikacją kompetencji tego organu. Ewolucja tego organu w okresie 1989-2020 pozwala traktować jako interesujący przypadek badawczy. Zwłaszcza, że kompetencje Zgromadzenia Narodowego należą do kluczowych dla zapewnienia ciągłości władzy w państwie.

Zmiany statusu prawnego Chorągwi Rzeczypospolitej” jest swoisty regres, jaki stał się udziałem tego symbolu państwowego, wskazanie na determinujące zmiany okoliczności prawne oraz, nie mniej istotne, okoliczności faktyczne. Chorągiew Rzeczypospolitej, ustanowiona w 1919 r., zaliczana wówczas do godeł państwowych, formalnie została zniesiona w 1955 r. W dwudziestoleciu międzywojennym miała status chorągwi państwowej oraz osobistego znaku Naczelnika Państwa, a później Prezydenta RP. Od stycznia 1996 r. flaga niemalże identyczna z wzorem Chorągwi Rzeczypospolitej z 1927 r. funkcjonuje jako Proporzec Prezydenta Rzeczypospolitej - symbol wojskowy, którego używanie podlega licznym i nie do końca zrozumiałym ograniczeniom. Niski status regulacji prawnych normujących wzór oraz okoliczności użycia proporca sprawia, ze jest on Polakom niemal nieznany. Pewna popularyzacja Proporca Prezydenta RP nastąpiła w związku z katastrofą prezydenckiego samolotu w Smoleńsku (10 kwietnia 2010 r.). Nadal jednak mało kto ma świadomość, że Rzeczpospolita Polska nie posiada oficjalnej chorągwi, a jednocześnie funkcjonuje nawiązujący do jej dawnego wzoru znak wojskowy.

The Banner of the Republic of Poland established in August 1919 was asignated to the Chief of State and afterwards to the President of the Republic of Poland. It was also used during momentous state ceremonies. The Banner of the Republic of Poland established on the 27th December 1927 was used ex¬clusively by the President of the Republic of Poland – with the exception of the funeral of Józef Piłsudski when it covered the marshal’s coffin. The banner was taken away to London in 1939 by President Ignacy Mościcki. It was used by the emigre presidents between 1945 and 1990. It was conveyed to President Lech Wałęsa on the 22nd December 1990 by the last emigre president, Ryszard Kaczorowski. Under the communist regime in Poland the flag of the head of the state was used. It was a banner based on the banner of 1927, though without a crown on ea¬gle’s head. It was introduced without any legal regulations. During President Bolesław Bierut’s term of Office it flew over his headquarter. It was officially abolished in 1955, though later on it was used by the prime minister and by the president of the State Council in the 60’s. In post-communist Poland a new flag was established, the present pattern of the coat of arms is consistent with that of 1989, though the crown was returned to the eagle’s head. Similar alterations affected the military flags and other special flags. One of the special flags is the Pennant of the President of the Republic of Poland, the pattern of which was defined in January 1996.
System polityczny każdego państwa podlega nieustannym zmianom. Faktyczna pozycja organów państwa może w związku z tym odbiegać od pozycji prawnej, opisanej w konstytucji. Analiza ma na celu stwierdzenie, czy w przypadku izby pierwszej polskiego parlamentu mamy do czynienia z takim zjawiskiem. W tym celu zostają wskazane przypadki, w których Sejm przekracza swoje kompetencje lub nadużywa swojej pozycji ustrojowej. Badania skupiają się na trzech funkcja realizowanych przez polski parlament: ustawodawczej, kontrolnej oraz kreacyjnej. Na tej podstawie zostają sformułowane wnioski końcowe, dotyczące Sejmu, parlamentaryzmu w Polsce, prawa zmieniającego się pod wpływem praktyki politycznej, a także postaw badawczych pozwalających trafnie oceniać zachodzące procesy.

The political system of each country is subject to constant change. The actual position of the state organs may therefore differ from the legal position described in the constitution. The analysis is aimed at determining if this is the case with the first Polish parliament. For this purpose, cases are indicated where the Sejm exceeds its powers or abuses its political position. Research focuses on three functions implemented by the Polish parliament: legislative, control and creative. On this basis, final conclusions are formulated regarding the Sejm, parliamentarism in Poland, laws changing under the influence of political practice, as well as research attitudes allowing to accurately assess the processes taking place.
The concept of security, which has been popular in recent years, is an integral element of constitutional systems. Securing undisturbed human existence was one of the premises for creating legal acts limiting the arbitrary state – the first constitutions at the end of the 18th century. The tasks imposed on the constitution as a special type of legal act remained unchanged. This tendency was strengthened in the 20th century, hence the modern constitutions are characterized by strong saturation with concepts from the broadly understood field of security. The Polish Constitution of 1997 is no exception in this respect, as it lays down numerous provisions establishing far-reaching restrictions on the state and those in power. In order to guarantee security in some specific areas, the Polish constitution imposes organizational obligations on the rulers, which translates into securing the health, pension or procedural interests of the individual. The issue of respecting constitutional standards related to security is a separate issue, but this is a problem already known at the dawn of constitutionalism.

Popularne w ostatnich latach pojęcie bezpieczeństwa jest integralnym elementem systemów konstytucyjnych. Zabezpieczenie niezakłóconej egzystencji człowieka było jedną z przesłanek tworzenia aktów prawnych ograniczających samowolę państwa – pierwszych konstytucji u schyłku XVIII w. Zadania stawiane przed konstytucją, jako szczególnego rodzaju aktem prawnym, pozostały nie zmienione. Tendencja ta uległa w XX w. wzmocnieniu, stąd też nowoczesne konstytucje charakteryzuje silne nasycenie pojęciami z zakresu szeroko rozumianego bezpieczeństwa. Konstytucja RP z 1997 r. nie jest w tym zakresie wyjątkiem, gdyż ustanawia liczne przepisy ustanawiające daleko idące ograniczenia na państwo i rządzących. W celu zagwarantowania bezpieczeństwa w niektórych specyficznych obszarach polska konstytucja nakłada na rządzących obowiązki organizacyjne, przekładające się na zabezpieczenie interesów zdrowotnych, emerytalnych, czy procesowych jednostki. Odrębną kwestią jest zakres poszanowania konstytucyjnych norm związanych z bezpieczeństwem, ale jest to problem znany już u zarania konstytucjonalizmu.
The dynamic development of the COVID-19 epidemic hampered the functioning of administrative bodies, especially those consisting of many people. In 2020, many countries had to solve the problem of how to adapt their laws to the requirements of the pandemic, while maintaining the safety requirements of members of parliaments. The introduced solutions included suspending the proceedings, modifying the quorum, or changing the voting method. Few countries (including Poland) have fully used the available technologies, deciding to allow parliaments to hold and vote remotely. The conducted analysis is aimed at identifying the systemic solutions that made it possible to introduce such solutions, as well as at determining what modifications of the legal system were necessary to establish innovative solutions.

Liczne państwa musiały w 2020 roku rozwiązać problem, jak dostosować prawo do wymogów pandemii, zachowując wymogi bezpieczeństwa członków parlamentów. Wprowadzone rozwiązania obejmowały zawieszanie obrad, modyfikację kworum, czy zmianę sposobu głosowania. Nieliczne państwa (m.in. Polska) wykorzystały w pełni dostępne technologie, decydując się na umożliwienie parlamentom zdalne obradowanie i głosowanie. Prowadzona analiza ma na celu wskazanie rozwiązań ustrojowych, które umożliwiły wprowadzenie takich rozwiązań, a także ustalenie, jakie modyfikacje systemu prawnego były niezbędne dla ustanowienia nowatorskich rozwiązań.
The political involvement of media may raise doubts, particularly when these are the cas- es of political bias. Many Polish journalists perceive this phenomenon critically and try to counteract it, creating codes of journalistic ethics. Their impact, however, is not com- mon, so they remain ineffective. This problem should be considered while analyzing the Polish constitutional provisions and laws. None of the provisions of the Polish Consti- tution of 1997 does prohibit journalists or media political commitment. Media in Po- land have but to fulfill an important function of informing the sovereign (nation) about all the activities of public authorities. To this end, the legal standards guarantee media freedom of action. Associated with the position of media power is to serve social objec- tives, which is to provide information. Legal norms do not require neutrality, nor do they impose political commitment. It should also be remembered that media are a part of the Polish political system.

Zaangażowanie polityczne mediów może budzić wątpliwości, zwłaszcza gdy są to przy- padki skrajne, charakteryzujące się stronniczością polityczną. Liczni polscy dziennikarze postrzegają to zjawisko krytycznie i starają się temu przeciwdziałać, tworząc kodeksy ety- ki dziennikarskiej. Skuteczność oddziaływania na środowisko tego rodzaju aktów należy ocenić jako niewielki, co jest zapewne związane z ich niewiążącym charakterem. Wydaje się, iż sygnalizowane postawy – związane z politycznym zaangażowaniem mediów – na- leży postrzegać uwzględniając polskich przepisy prawne, konstytucyjne i ustawowe. Ża- den z przepisów Konstytucji RP z 1997 r. nie zakazuje dziennikarzom ani szeroko rozu- mianym mediom politycznego zaangażowania. Jednocześnie należy mieć świadomość, że media w Polsce mają do spełnienia istotną ustrojowo funkcję informowania suwerena (narodu) o wszystkich działaniach władz publicznych. W tym celu zostały ustanowione normy prawne gwarantujące mediom wolność działania. Normy prawne nie wymaga- ją przy tym neutralności, ani też nie nakazują politycznego zaangażowania. Oceniając tego rodzaju postawy należy mieć zatem na uwadze społeczną oraz ustrojową rolę me- diów, jako istotnego elementu polskiego systemu politycznego.
The right to assembly is recognized as one of the key human rights. It is essential for the functioning of the community, it is also the foundation of the democratic state. The legal regulations of the law of assembly in Poland have a tradition dating back to the mid-nineteenth century, but this right was regulated by 1990. The authentic freedom in this respect can be discussed only in the period of the Third Polish Republic, although this freedom has never meant freedom and has always been subject to limitation. The standards, which have been improved for decades, have been broken by the 2015 act, while in 2017 the Polish legislator introduced a number of solutions that made the law inconsistent and problematic in application. This article is aimed at tracing the evolution of statutory regulations from 1918–2015 and evaluating new solutions, especially those introduced in 2017, against it.

Prawo do zgromadzeń jest uznawane za jedno z kluczowych praw człowieka. Ma ono istotne znaczenie dla funkcjonowania społeczności, jest też fundamentem państwa demokratycznego. Prawne regulacje prawa zgromadzeń w Polsce mają tradycję sięgającą połowy XIX w., przy czym prawo to było do 1990 r. reglamentowane. O autentycznej wolności w tym zakresie można mówić dopiero w okresie III Rzeczypospolitej, choć wolność ta nigdy nie oznaczała dowolności i zawsze podlegała limitacji. Doskonalone przez dziesięciolecia standardy w tym zakresie zostały przełamane ustawą z 2015 r., natomiast w 2017 r. polski ustawodawca wprowadził szereg rozwiązań, które uczyniły ustawę prawo o zgromadzeniach niespójną i problematyczną w stosowaniu. Niniejszy artykuł ma na celu prześledzenie ewolucji regulacji ustawowych z lat 1918–2015 i dokonanie na jej tle oceny nowych rozwiązań, zwłaszcza tych wprowadzonych w 2017 r.
Artykuł ma na celu wykazanie, iż stosowany w doktrynie prawa konstytucyjnego podział konstytucji z uwagi na tryb ich zmiany jest anachroniczny. Podział ustaw zasadniczych na elastyczne oraz sztywne, wprowadzony u schyłku XIX w., stał się – częściowo z uwagi na wady zaproponowanej klasyfikacji, częściowo z innych względów – dysfunkcjonalny. Autor dokonuje weryfikacji skali dwustopniowej poprzez jej odniesie- nie do współczesnych państw europejskich i na tym przykładzie wykazuje jej wady. W miejsce ww. skali proponuje znacznie zmodyfikowaną i opartą na ostrych kryteriach skalę trójstopniową, odpowiadającą stwierdzonemu zróżnicowaniu stosowanych procedur zmiany konstytucji współczesnych państw europejskich.

Article aims to demonstrate that applied the doctrine of constitutional law constitutional division due to their mode of change is anachronistic. Distribution of basic laws on flexible and rigid, introduced in the late nineteenth century became – in part because of the defects of the proposed classification, partly for other reasons – dysfunctional. The author makes a two-step verification scale through its reference to contemporary European countries and this example shows its flaws. In place of the above. scale suggests a much modified and based on stringent criteria of a three-stage scale, corresponding to cover identified diversity of the procedures used to change the constitution of modern European states.
The Hungarian constitutional system after 1989 was initially subject to evolutionary changes. The previously binding constitution was only amended, although in most countries of the region the new constitutions created new system concepts. This also concerned the organisation of the judiciary, which in Hungary for a long time remained under the influence of the doctrine formed in the time of the socialist state. Significant corrections in this respect did not take place until 1997, but the solutions and institutions created at that time — including judicial self-government — survived for only slightly more than a decade. The political parties that came to power in 2010 adopted a new Basic Law and made far-reaching transformations in the field of symbolism, constitutional principles and the system of constitutional organs. Both the scope of the changes and the way they were carried out provoked resistance from various environments, including judges, whose influence on the organisation of the judiciary and its functioning was significantly reduced. The dispute that occurred was the subject of debate throughout Europe, and the institutions of the Council of Europe and the European Union were involved in resolving it.
Hungarian constitutional system has a number of characteristics, including division of power. This is a result atypical evolution of the political system in Hungary after 1989. Most of the countries of Central and Eastern made a thorough reconstruction of the political system in the nineties of the twentieth century, many constitutions were adopted in 1991–1994. Otherwise had done Hungarians, making a 1989 amendment to the Constitution of 1949. and the adoption of a new constitution putting off indefinitely. Completely new Fundamental Law was adopted only in 2011., in force since 1 January 2012. It introduced in the Hungarian constitutional system significant changes, modifying the way the principle the division of powers. The changes seem to be rational, and therefore to be expected that the Hungarian model finds followers.

System konstytucyjny Węgier posiada szereg cech charakterystycznych, także jeśli chodzi o podział władzy. Jest to skutkiem nietypowego przebiegu ewolucji ustroju, jaką przechodziły Węgry po 1989 r. Większość państw Europy Środkowo-wschodniej dokonało gruntownej przebudowy systemu politycznego w latach dziewięćdziesiątych XX w., liczne konstytucje były uchwalane w latach 1991–1994. Inaczej postąpili Węgrzy, dokonując w 1989 nowelizacji Konstytucji z 1949 r., a uchwalenie nowej konstytucji odkładając na bliżej nieokreśloną przyszłość. Zupełnie nowa Ustawa Zasadnicza została uchwalona dopiero w 2011 r., obowiązuje od 1 stycznia 2012 r. Wprowadziła ona w węgierskim systemie konstytucyjnym istotne zmiany, modyfikując także sposób realizacji zasady podziału władz. Przeprowadzone zmiany wydają się jednak racjonalne, a zatem należy się spodziewać, że model węgierski znajdzie naśladowców.
