The aim of this article is to present the concept of an imperative mandate in the Polish constitutional tradition. In the first part, the notion of an imperative mandate will be characterized in terms of basic criteria, which distinguish this mandate from a different type – a free mandate. In further parts the regulation of an imperative mandate in the Polish constitutionalism of the Noble Republic of Poland until the 20th century will be presented. In the context of the discussion a special emphasis will be placed on regulations of the Constitution of the People’s Republic of Poland of 22 July 1952.

The aim of this article is to present constitutional and statutory conditions of the institution of e-voting in the Polish legal system. In this regard, the analysis is made from the perspective of the Polish constitutional law, simultaneously taking into account other non-traditional voting techniques known to contemporary constitutional law, such as voting by proxy or voting by post. The intention of the author of this article is to answer the following question: what propositions de lege lata and de lege ferenda, regarding e-voting, may be formulated form the perspective of the Polish constitutional law. The issue is examined both in the light of the Constitution of the Republic of Poland of 2 April 1997, as well as in the light of other binding legal acts regulating electoral matters.

The aim of the article is to discuss the guarantees of exercise of the constitutional right to petition in the context of the Act of 11 July 2014 on Petitions. The first part of the article presents the constitutional right of petition in the shape as introduced by the lawmaker in the Constitution of the Republic of Poland from 2 April 1997. The above considerations are aimed at demonstrating the way in which the lawmaker safeguarded the constitutional right to petition on the basis of the Act of 11 July 2014 on Petitions.

Celem niniejszego artykułu jest ukazanie instytucji mandatu przedstawicielskiego w polskiej tradycji ustrojowej i we współczesnym polskim prawie konstytucyjnym. Praca w sposób kompleksowy i przekrojowy ukazuje instytucję mandatu przedstawicielskiego w polskim konstytucjonalizmie, z uwzględnieniem zarówno dawnych regulacji konstytucyjnych, jak i aktualnie obowiązującej Konstytucji. Rozważania oparte są na analizie aktów normatywnych i podstawowych stanowisk doktrynalnych. W artykule został położony także nacisk na kontekst historyczny instytucji mandatu przedstawicielskiego oraz wnioski płynące z porównania dwóch podstawowych modeli mandatu parlamentarnego. Autor ubogaca ponadto swoje rozważania potrzebnymi, w jego przekonaniu, odniesieniami do praktyki życia politycznego, która ma znaczący wpływ na rzeczywiste postrzeganie instytucji mandatu przedstawicielskiego.

The purpose of this paper is to address the concept of a representative parliamentary mandate in Polish tradition and in contemporary Polish constitutional law. The paper touches upon the concept of the representative mandate in the Polish constitutionalism in a comprehensive and cross-cutting manner, with regard to both former constitutional rules and the current Constitution. The considerations are based on an analysis of the normative regulations and basic doctrinal approaches. Emphasis has been also placed on the historical context of a representative mandate and on conclusions flowing from comparing the two basic models of a parliamentary mandate. The author enriches his views with references to the everyday political practice, which has a significant influence on the real perception of the notion of a representative mandate.
