Jednym z głównym celów artykułu jest zwrócenie uwagi na materiały biblioteczne jako na komponenty dziedzictwa kultury tak samo istotne jak zabytki i muzealia. W pierwszej części zostają przedstawione definicje legalne wskazanych przedmiotów. Część druga została przeznaczona na omówienie sposobów ochrony materiałów bibliotecznych, muzealiów i zabytków oraz wskazanie ewentualnych mechanizmów wspólnych. Zaakcentowane kwestie stanowią wstęp do dalszych badań podjętych w 2016 r. na Uniwersytecie Gdańskim.

The main purpose of the article is drawing attention to library materials as components of the cultural heritage legacy which are as significant as monuments and museum exhibits. In the first part, legal definitions of the objects are presented. The second part discusses ways of the protection of library materials, museum exhibits, and historic monuments and indicates possible shared mechanisms. The discussed issues are an introduction to further research undertaken at the University of Gdańsk.

The commentary addressed the issue of the author’s entitlement to receive compensation for droit de suite. In particular, it clarifies the rules of conduct of the obligated party. The commentary supports the ruling of the Court of Appeal, unifying interpretations regarding the characteristics of the claim for payment submitted on the basis of the droit de suite.

W glosie poruszona została problematyka uprawnienia twórcy do wynagrodzenia z tytułu droit de suite. W szczególności wykładni poddano przepisy określające podmiot zobowiązany. Glosowane orzeczenie potwierdza przyjętą przez Sąd Apelacyjny linię orzeczniczą, ujednolicając poglądy dotyczące charakterystyki roszczenia o zapłatę zgłoszonego w oparciu o droit de suite.

The main purpose of the article is to outline the role of the local authority monument conservation officer and give a comparative analysis of agreements on the management of cases within the competence of the Pomeranian Monument Conservation officer dealt with by the local government structure of the City of Gdańsk, Sopot and Gdynia. The article begins with a discussion of the process of appointing the local authority monument conservation officer, the operating principles of the post, assessment procedures and main duties as determined in the 1996 Acts and those resulting from the officer’s own objectives. The agreements entered into are presented as the main tools of the local authorities, which should streamline and improve the supervision of monuments in a given commune. Next discussed are the legal grounds of such agreements followed by a detailed analysis of the most substantial differences which are the subject of further discussion. Additionally indicated are areas specific to the provincial monument conservation officer, despite their location in an area covered by a given commune. Final conclusions comment on the differences and, taking the above considerations into account, their application by local government monument conservation officers. The article concludes with a subjective evaluation of the office itself and its operation.

Konferencja została zorganizowana przez Wydział Prawa i Administracji Uniwersytetu Gdańskiego, Wydział Administracji i Nauk Społecznych Uniwersytetu Kazimierza Wielkiego w Bydgoszczy oraz Pałac w Lubostroniu – Instytucję Kultury, w którego murach odbywały się sesje.
