The professional skills and competence play very important role in effective farming in modern agriculture. The farmers can acquire these skills both, in the school education and in agricultural practice. The competences so acquired can be best controlled on the occasion of the agricultural land turnover The requirement of agricultural skills in Polish agriculture is in force, with different intensity, for many decades. However, the importance of that factor have increased significantly after the EU accession. It is concluded that there exist in the Polish agriculture two, quite different, vocational education models. It is advisable, therefore, to unify and adjust the Polish legal rules in force to standards of the common agricultural policy.

Early retirement pensions scheme is one of the most important instruments shaping the structure of the Polish agriculture. Recently, in connection with a new planning period of EU the new principles of early retirement pensions scheme for farmers for 2007-2013 were elaborated. Hence a need to analyse proposed mechanisms, especially the aims of early retirement pensions scheme and mechanisms of pension calculation. The purpose of the paper is to analyse the proposed measures in the context of aims of the scheme. The basic problems are the competitiveness of the new early retirement pension scheme as compared with the previous one as well as its possibilities to realize social and structural aims. Analyses with application of functional analysis were conducted on the basis of the Polish and Community legal acts concerning the early retirement pensions scheme. It appears that the new early retirement pension scheme, proposed for the years 2007-2013, could limit the possibilities of implementing the social and structural purposes of agricultural policy.

One of weaknesses of the Polish agriculture is its fragmented agrarian structure, determinated by economic (low level of economic development, high volume of labour resources), social and cultural factors, resulting in the low competitiveness of that national economy sector. Aiming at production resources concentration in agriculture the Polish Parliament has passed in 2001 an Act on early retirement pensions scheme in agriculture. By its virtue farmers were entitled to transfer their holdings in 2002-2004 to other farms in exchange for the early retirement pensions. The paper aims at evaluation of impact of the early retirement pensions scheme on agrarian restructurisation in the Polish agriculture. The analyses show that the scheme in question did not fulfill the intended aims and functions (structural and social). The direct reason of that were a defective implementation of its mechanisms and disregardingo the economic, social and cultural determinants of the scheme on its preparatory stage

The early retirement pension scheme for farmers, envisaged in the Rural Development Areas Plan 2004-2006 (PROW), aimed at agricultural land concentration in viable economically farm and thus at counteracting the negative phenomena of fragmented agrarian structure in the Polish agriculture. The core of this scheme is offering farmers early retirement pensions in exchange of agricultural land release for agriculture structure improvement. The entitlements to early retirement pensions for farmers are provided with personal and object clauses. However, the legal regulations implementing the scheme in question were significantly liberalized in the PROW in comparison with the earlier ones. As a result of that persons loosely connected with agriculture could apply for the early retirement pensions thus bringing about low efficiency of its structural functions and low effectiveness of public funds spent for its implementation. Therefore, it is necessary to modify the existing legal regulations. Persons without satisfactory period of participation in the social security scheme for farmers and not transferring agriculture land for purpose of agrarian structure improvement should have limited access to the pension scheme..
