Państwa Ameryki Środkowej deklarują poszanowanie dla praw człowieka zarówno na poziomie krajowym, jak i międzynarodowym. Łatwość w sygnowaniu kolejnych konwencji, czy powoływania do życia rozbudowanych instytucji (np. biur ombudsmana), nie przekłada się na skuteczność mechanizmów ochrony. Celem niniejszego artykułu jest przedstawienie stanu ochrony praw człowieka w wybranych państwach Ameryki Środkowej (Gwatemali, Salwadoru, Nikaragui i Hondurasu) na przykładzie prawa do rzetelnego procesu. Podstawowy problem stanowi obecnie bezkarność. Powodowana jest ona m.in.: patologiami w wymiarze sprawiedliwości (w tym brakiem gwarancji prawa do rzetelnego procesu), zaniechaniem rozliczenia winnych łamania praw człowieka z okresu wojen domowych i dyktatur, istnieniem przeszkód w dostępie do sądu. Taki stan rzeczy jest konsekwencją wieloletnich konfliktów wewnętrznych oraz specyficznych uwarunkowań społeczno-ekonomicznych.

The States of Central America declare the respect for human rights on the national and international level. It is quite easy for them to sign conventions and to develop new institution (such as ombudsman offices), but it doesn’t improve the protection. This article presents a status of protection of human rights in selected states of Central America (Guatemala, Salvador, Nicaragua, Honduras) illustrated with the example of the principle of fair trial. The impunity, the main problem now, is caused by the existence of pathology in system of Justice (for example violation of right to fair trial), the lack of prosecution of responsible for human rights violations committed during the civil war and dictatorship, the presence of obstacle in access to justice. The tumultuous history as well as the social and economic conditions are the main reason of the situation.
