Książę Augustyn Golicyn spędził większość swego życia we Francji, gdzie zajmował się intensywnie publikacją źródeł historycznych dotyczących głównie historii Rosji. Publikował również prace na temat katolicyzmu i jego roli w historii Rosji oraz możliwości, jakie katolicyzm otwierał dla jej przyszłości – czym kontynuował dyskusję otwartą przez Iwana Gagarina. W tej dyskusji Golicyn skoncentrował się na trzech problemach dzielących katolicyzm i prawosławie, a mianowicie: pochodzeniu Ducha Świętego, istnieniu czyśćca oraz prymatu papieskiego. Golicyn podkreślał, że wolność Kościoła w Rosji, będącego wówczas w pełni zależnym od władzy cesarskiej, możliwa jest jedynie po połączeniu się z Kościołem katolickim.
Prokopovich began his ecclesiastical career as a lecturer of the Kiev academy where he taught many subjects and left extensive lecture published posthumously in a multivolume Christianae orthodoxae theologiae. The paper presents some of his views concerning the defense of the authority of the Bible and the need for its literal interpretation; some positive characterizations of God’s attributes; the creation and the makeup of the world; the position of man in the universe; and the problem of eschatology. After Prokopovich was summoned by Peter I to St. Petersburg, he gradually abandoned theology and philosophy and concentrated on political issues and on justification of submitting the church to the power of the state. This culminated in the Spiritual regulation which spelled the end of an independent church in Russia.

Customs legislation establish rights and obligations of importing and exporting goods from the territory of the European Union and the powers and duties of the customs authorities. One of the primary responsibilities of the persons importing or exporting goods from the territory of the state is obliged to pay customs duties. They are not imposed only for strictly fiscal, but serve to protect the EU market against competing goods imported from abroad. Customs duties are one of the basic institutions of the European Union customs law. Despite it still lacks theoretical studies devoted to this legal institution.
In 1751, Grigorii Teplov published his book that he considered to be an introduction to philosophy for the uninitiated. In the first part, Teplov introduced the reader to the subject of philosophy; however, Teplov concentrated on philosophy and methodology of science, thereby presenting a rather limited view of philosophy. In the second part, he presented the history of philosophy showing how inadequate his knowledge of the subject was. In the third part, he discussed some ontological and epistemological problems when in his presentation of several philosophical concepts basing his presentation largely on Wolff.
Murav’ev was a poet of moderate importance for the eighteenth century Russian literature. He was also a tutor of Catherine II’s grandsons, Alexander and Constantine. In this capacity, he prepared numerous handouts to teach Russian history, politics, science, and ethics. Murav’ev stressed the preeminence of virtue in everyone’s life. The voice of the heart should be the guide in resolving moral problems. This voice is the gift of God and as such it can be usually trusted. Thus, morality is based on theology. Murav’ev’s theology presents a grand vision of providential God who appears to be viewed from the unitarian perspective.
Celem opracowania jest spojrzenie na kontrolę podatkową i kontrolę celno-skarbową przez pryzmat rozwiązań związanych z zapobieganiem, przeciwdziałaniem i zwalczaniem COVID-19, innych chorób zakaźnych oraz wywołanych nimi sytuacjami kryzysowymi. Kluczową kwestią jest zbadanie, czy dopuszczalne jest prowadzenie kontroli podatkowych lub kontroli celno-skarbowych w oparciu o regulacje prawne COVID-19 i wydawania na ich podstawie rozstrzygnięć kończących kontrole w rozumieniu przepisów prawa podatkowego, czy wręcz przeciwnie – organy podatkowe powinny zawiesić na czas pandemii czynności kontrolne na podstawie obowiązującego prawa, wybranego orzecznictwa i poglądów doktryny. Realizowana przez organy podatkowe kontrola podatkowa i celno-skarbowa należy do jednych z najistotniejszych instytucji prawa podatkowego. Wynika to między innymi z faktu, że jednym z podstawowych zadań państwa jest czuwanie nad wywiązywaniem się podatnika z obowiązku ponoszenia ciężarów i świadczeń podatkowych oraz kontrolowania jego prawidłowego wykonania. W ten sposób organy administracji podatkowej ujawniają i eliminują wszelkie nieprawidłowości w zakresie wywiązywania się podatnika z ciążących na nim zobowiązań podatkowych. The objective of this paper is to look at the tax, customs and fiscal inspection through the prism of solutions associated with counteracting, preventing and combating COVID-19, other infectious diseases and the subsequent crisis situations. It is important to determine whether it is acceptable to conduct tax, customs and fiscal inspections based on the COVID-19 related legal regulations, and to issue decisions terminating inspections within the meaning of the tax law or, on the contrary, the tax authorities should suspend inspections during the pandemic on the basis of applicable law, selected case law and the doctrine. The tax, customs and fiscal inspection carried out by the tax authorities is one of the most important tax law institutions. This is due to the fact that one of the basic tasks of the state is to make sure that taxpayers properly fulfil their tax obligations. In this way the tax administration authorities reveal and eliminate any irregularities in meeting tax obligations by taxpayers. The inspection is used by the tax authorities to check and evaluate whether taxpayers perform their duties properly, which in turn allows them to detect irregularities and prevent unfavourable phenomena.
Buzhinskii was a well-educated, high-ranking ecclesiastic during the reign of Peter I. Pomoc publiczna w formule de minimis w zakresie ulg w spłacie zobowiązań podatkowych stano-wi dla przedsiębiorców zamierzających z niej skorzystać dogodną formę otrzymania wsparcia ze stro-ny państwa. Analizując to zagadnienie, należy mieć na uwadze szczegółowe zasady udzielania pomo-cy publicznej w ogóle, bowiem skorzystanie z pomocy – nawet udzielonej przez organ państwowy – niesie ryzyko uznania jej przez Komisję Europejską za pomoc niedozwoloną lub nielegalną, co oczy-wiście wiązać się będzie z koniecznością jej zwrotu. Z drugiej strony istnieje możliwość korzystania z prostszej, lecz ograniczonej kwotowo pomocy w ramach de minimis. Procedura uzyskiwania takiej pomocy jest niewątpliwie łatwiejsza, a uzyskana korzyść szczególnie dla przedsiębiorców małych lub średnich może stanowić znaczące wsparcie. Chociaż wsparcie w ramach de minimis stanowi formę pomocy publicznej „bez konkretnego przeznaczenia”, to zasady i warunki jej udzielania są ściśle regu-lowane przez prawo unijne.

De minimis public aid with regard to reliefs in repayment of tax liabilities constitutes a convenient form of aid provided by the state for entrepreneurs intending to benefit therefrom. While analysing this issue, one should consider particular principles of providing public aid in general, as benefiting from the aid – even granted by a public authority – carries some risk due to the fact that the European Commission may regard it as forbidden or illegal, which is obviously related with the obligation to return the funds. On the other hand, it is possible to use simpler, yet, limited in the amount, aid under de minimis rule – the procedure of obtaining such an aid is doubtlessly easier and the aid, in particular the funds granted to small and medium entrepreneurs, can constitute a significant support. Despite the fact that aid under de minimis rule constitutes a form of public aid “without particular purpose”, the terms and conditions of granting it are strictly regulated by the EU law.

The article discusses a seldom investigated problem of Socrates’s influence on Augustine’s intellectual development. It is shown that Augustine started with an intense use of the Socratic method utilizing its elenctic and maieutic questioning to expose the truth hidden in the soul. Also, just as the Socratic method led to ontological developments in Plato and Plotinus, it led Augustine to the development of his Christian ontology.
Problematyka niniejszego artykułu koncentruje się na analizie cła jako daniny publicznej, będącej źródłem dochodu Polski oraz organizacji międzynarodowej – Unii Europejskiej. Krajowy ustawodawca, określając katalog dochodów publicznych w art. 5 ust. 2 pkt 1 u.f.p., nie wymienia wprost ceł jako daniny publicznej, która wchodzi w zakres katalogu dochodów publicznych. O wyróżnieniu cła jako daniny publicznej spośród innych danin publicznych decyduje to, że jest jedynym świadczeniem stanowiącym nie tylko źródło dochodu budżetu Polski, ale także budżetu unijnego. Cło pełni także funkcję prohibicyjną, która realizowana jest przez utrudnienie, a nawet uniemożliwienie napływu towarów z zagranicy.

The topic of this article focuses on the analysis of customs duty as public levy constituting a source of income for Poland and an international organisation – the European Union. While defining a catalogue of public incomes in article 5, section 2, point 1 of the Act on Public Finances, the national legislator does not directly list customs duties as a public levy included in the public incomes catalogue. Customs duty is defined as one of public levies, since it is the only benefit constituting not only the source of income for Poland’s budget, but also for the budget of the European Union. Furthermore, customs duty fulfils a prohibition function through hindering and even preventing inflow of goods from abroad.
The aim of the presented article is to order and systematize features of customs duty as a public levy resulting from Polish and European Union customs law. The European Union’s law is a special type of a legal system characterising with an autonomous position in comparison with other legal systems. It comprises a set of provisions covering legal regulations initially drawn up by European Communities and then, by the European Union, as well as, partially by the Member States themselves. Independence of the European Union’s law also results from the fact that this law has own system of sources of law, own procedures of enactment, interpretation as well as application control and protection thereof. Transferring to the European Union some of its sovereign laws, Poland authorised the European Union authorities to independently adopt customs law. A characteristic normative feature distinguishing customs in Polish and European Union customs law consists in collecting customs by duly authorised customs authorities from entities importing and exporting goods through the customs area’s borders. Regulations included in the domestic customs law provisions indicate that it is a public levy that is stipulated and collected on the grounds of customs tariff from entities conducting foreign trade in goods in connection with transferring goods through the customs border of a state or a group of states constituting a customs union. Customs duties’ collection is related with import or export of goods subject to customs duties.

Celem prezentowanego artykułu jest uporządkowanie i usystematyzowanie cech cła jako opłaty publicznej wynikającej z polskiego i unijnego prawa celnego. Prawo Unii Europejskiej jest szczególnym rodzajem systemu prawnego charakteryzującego się autonomicznym stanowiskiem w porównaniu z innymi systemami prawnymi. Stanowi zbiór przepisów regulacje prawne pierwotnie sporządzone przez Wspólnoty Europejskie, a następnie przez Unię Europejską, a także częściowo przez same państwa członkowskie. Niezależność prawa Unii Europejskiej wynika również z tego, że prawo to posiada własny system źródeł prawa, własne procedury jego uchwalenia, interpretacji oraz kontroli stosowania i ochrony. Przenosząc do Unii Europejskiej niektóre z jej suwerennych ustaw, Polska zezwoliła władzom Unii Europejskiej na niezależne przyjmowanie przepisów celnych. Charakterystyczną cechą normatywną odróżniającą odprawy celne w polskim i unijnym prawie celnym jest pobieranie cła przez należycie upoważnione organy celne od podmiotów importujących i eksportujących towary przez granice obszaru celnego. Przepisy zawarte w przepisach krajowego prawa celnego wskazują, że jest to opłata publiczna, ustalana i pobierana na podstawie taryfy celnej od podmiotów prowadzących obrót handlowy towarami w związku z transferem towarów przez granicę celną państwa lub grupy państw tworzących unię celną. Opłaty celne są związane z przywozem lub wywozem towarów podlegających opłatom celnym.

Krinovskii was a preacher in the court of the empress Elizabeth and a member of the Synod. A hundred of his sermons have been published four times in A collection of various instructive talks. In his sermons, Krinowskii spoke about the providence of God and the necessity of the full awareness of God’s presence in everyone’s life. To assure the benevolent presence of God, one’s life has to be pure and modelled after Christ. The life led by God’s precepts will ensure happiness on earth and in the afterlife. Krinovskii’s salvific and moral message was mostly ecumenical, but his sermons are not free from exaggerated praises of the empress and of the role of Russia and Orthodoxy.

Krinowski war ein Prediger am Hofe von Kaiserin Elisabeth und Mitglied der Synode. Hundert seiner Predigten wurden vielmals in der Sammlung von verschiedenen lehrreichen Gesprächen veröffentlicht. In seinen Predigten sprach Krinowski über die Vorsehung Gottes und die Notwendigkeit des vollen Bewusstseins der Gegenwart Gottes im Leben eines jeden Menschen. Um die wohlwollende Gegenwart Gottes zu gewährleisten, hat das Leben rein und nach Christi Vorbild zu sein. Ein Leben im Einklang mit den Geboten Gottes geführt wird Glück auf Erden und im Jenseits gewährleisten. Krinowskis religiöse und moralische Botschaft war meistenteils ökumenisch, aber seine Predigten sind nicht frei von übertriebenem Lob der Kaiserin und der Rolle Russlands und der Orthodoxie.
The entrepreneur introducing into the European Union market goods cov-ered with pending anti-dumping investigation should be aware that the introduction of such goods is related with registration thereof and, at a later date, with the possibility to apply increased anti-dumping duty. Measures such as goods registration and temporary anti-dumping duties allow reaching anti-dumping proceedings’ objectives comprising the European Union market protection against detrimental practices incompliant with the market economy principles. Anti-dumping duty collected by customs authorities of Member States constitutes a legal-financial sanction consisting in applying selective protection that is, directed against import from strictly defined countries, and is oriented on a specific group of products or even on a single product. In comparison with traditional market protection instruments, anti-dumping customs are more flexible and can be implemented unilaterally. Deliberations elaborated herein are aimed at discussing the issue of stipulating anti-dumping customs in inter-temporal understanding.
The article constitutes another contribution to the debate regarding the place of customs in the system of public levies. Customs have been for ages seen as a benefit collected from persons trading internationally. Currently, the institution of customs as the only public levy collected by Polish customs au-thorities, contributes not only to the state budget, but it primarily constitutes income of a public-law union, that is, the European Union. Customs is fre-quently an element of trade policy of the European Union and predominantly provides protection for the Union market, it is aimed at preventing import of selected goods. Nevertheless, it has always performed a fiscal function as the public-law union’s income.
Aleksandr Koval’kov was a 19th century civil servant who was keenly interested in theological issues and he expressed his views in the four books he published. His beliefs are summarized in the statement that true Christianity lies in inner conversion, pure love, true faith, and repentance. He described arduous and lengthy path to spiritual rebirth. Although he strongly emphasized the inner life of faith, he also found place in spiritual life for the church, its tradition, and its rites. Human reason in his view has a negative impact on man since it only leads to the fall by inciting pride. In trying to find theological foundations for his spirituality, Koval’kov turned to masonry by trying to make Christianity in the masonic image.

Alexander Kowalkow - urzędnik w XIX-wiecznej Rosji - był bardzo zainteresowany zagadnieniami teologicznymi i wyraził swoje poglądy w czterech wydanych przez niego książkach. Jego przekonania zostały podsumowane w twierdzeniu, że prawdziwe Chrześcijaństwo polega na wewnętrznym nawróceniu, czystej miłości, prawdziwej wierze i pokucie. Opisał trudną i długą drogę do duchowego odrodzenia. Chociaż mocno podkreślał wewnętrzne życie wiary, znalazł także miejsce w życiu duchowym dla Kościoła, jego tradycji i obrzędów. Jego zdaniem ludzki umysł negatywnie wpływa na osobę, ponieważ doprowadził ją tylko do upadku. Próbując znaleźć podstawy teologiczne dla swojej duchowości, Kowalkow zwrócił się ku masonerii, próbując nadać Chrześcijaństwu obraz masoński.

Akcesja Polski do Unii Europejskiej przyniosła ze sobą wiele zmian na różnych płaszczyznach prawa, w tym przede wszystkim w obszarze prawa finansowego. Niewątpliwy jest fakt, że największe zmiany w zakresie rozliczeń z budżetem nastąpiły w dziedzinie prawa celnego z ceł. Regulacje prawa celnego obowiązujące w Polsce są jedną z dziedzin, która niemal całkowicie regulowana jest na poziomie unijnym, w następstwie czego we wszystkich państwach członkowskich Unii obowiązują jednolite zasady dotyczące wymiany handlowej z zagranicą. Wspólna Taryfa Celna UE stanowi istotny instrument, na podstawie którego wyliczane jest cło. Jej konstrukcja prawna często wykorzystywana jest do uszczuplenia krajowego i unijnego budżetu. Jej zaniżenie w przypadku przywozu towarów na unijny obszar celny powoduje poważne szkody finansowe w dochodach budżetowych, gdyż maleją dochody uzyskiwane z ceł w poszczególnych państwach członkowskich. Przedmiotem podjętej analizy w niniejszym opracowaniu jest więc zbadanie wpływu akcesji Polski do UE na uzyskiwane przez budżet państwa dochody pochodzące z ceł.

Poland’s accession to the European Union has brought numerous changes at various law levels, namely within the financial law. It is unquestionable that the biggest changes regarding budget settlements have been observed in the customs law, from duties. The Polish customs regulations are one of those areas that are nearly completely regulated at EU level and thus all Member States have uniform rules regarding foreign trade. The Common Customs Tariff is an essential tool applied for the calculation of duties. Its legal construction is often used to reduce the national and EU budget. The reduction in the Common Customs Tariff in the case of entry of goods into the EU customs territory results in serious financial damage in budget revenues as revenues derived from customs duties decrease in particular Member States.
