The article considers the main incoherences, which emerge from the meeting of dogmatic theology (theology of sacraments) and the Canon Law, general and detailed theology of sacraments (with reference to matrimony), and in the very sacramentological systematics of this sacrament. Particular focus is placed on the following problems: the significance of faith for the sacramentality of matrimony, the relation between natural and sacramental matrimony (Code of Canon Law, canon 1055), the relation between celebration of the sacrament and indissolubility of matrimony (the problem of unconsummated marriages), and the minister of the sacrament of matrimony. The article presents the background of the listed problems, their historical roots.
Sobór Trydencki znany jest zwłaszcza z jego rozstrzygnięć doktrynalnych. Równolegle jednak zgromadzeni na nim ojcowie pracowali nad reformą instytucji kościelnych – w tym zwłaszcza sprawami związanymi z pasterskimi obowiązkami duchownych oraz odpowiednim do ich spełniania przygotowaniem. W ramach tych rozstrzygnięć Sobór w praktyce zrealizował część postulatów ówczesnych i wcześniejszych krytyków kościelnego życia. Wydaje się uzasadnioną teza – którą niniejszy artykuł ilustruje przykładami zaczerpniętymi z tekstów soborowych – iż reformacja w dużej mierze przyczyniła się do powstania katolicyzmu w kształcie, jaki znamy dzisiaj.

The Council of Trent is known in particular for its doctrinal resolutions. The gathered fathers, however, were engaged in reforming Church institutions, including essentially issues connected with the pastoral duties of the clergy and preparations suitable for their fulfilment. Within those resolutions the Council realized in practice part of the earlier postulates as well as those formulated at the time by previous critics of Church life. The thesis – which this article illustrates by resorting to examples taken from the Council texts – claiming that the Reformation contributed to a great measure to the emergence of Catholicism as we know it today appears to be justified.
