Preaching the word of God is the part of the ministry of the divine word. The activity belongs exclusively to the Church and is regulated by the church law, but it is also under regime of Polish law. The article focuses on the Polish civil law and treats about: copyright law, the protection of secret information in labor law and in educational law, the obligation of silence before election day, and protection of personal interests. The catholic ministers must be aware of the civil liability for the preaching.

Artykuł koncentruje się na polskim prawie cywilnym i traktuje o prawach autorskich, ochronie tajemnicy służbowej w prawie pracy i prawie oświatowym, obowiązku ciszy wyborczej i ochronie dóbr osobistych. Katoliccy kaznodzieje muszą być świadomi odpowiedzialności cywilnej za to, co głoszą.

The problem can be stated in the following question: Can a faithful fulfill two obligations of assisting at Mass on one Mass? The regulations are to be applied to answer the difficulty come mainly from two canons of 1983 Code of Canon Law: can. 1247 and can. 1248 § 1. Clarifying the problem the paper describes the canons and interprets norms that come from them. The conclusion is that although law allows to give two quite opposite answers to the question, for practical and for pastoral reasons there must be only one obliging response given by the competent ecclesiastical authority. It would be appropriate if diocesan bishop clearly pronounced what behavior is obliging in his diocese in the matter. Christ’s faithful have the right to know unmistakable what they are expected to do.

Problem tego artykułu może być zawarty pytaniu: czy wierny może wypełnić dwa obowiązki uczestniczenia we mszy świętej podczas jednej mszy świętej? Regulacje prawne, które mają zastosowanie przy udzieleniu odpowiedzi na to pytanie to głównie kan. 1247 i kan. 1248 § 1 z KPK 1983. Rozwiązując wskazany problem należy podać wykładnię tych przepisów. Wniosek z rozważań jest następujący: chociaż prawo pozwala na udzielenie dwóch całkowicie odmiennych odpowiedzi na powyższe pytanie badawcze, to z praktycznego i pastoralnego punktu widzenia, tylko jedna odpowiedź powinna być udzielona przez kompetentną władzę kościelną. Byłoby wskazane, gdyby to biskup diecezjalny jasno ogłosił, jaka norma obowiązuje w diecezji w tej sprawie. Wierni mają prawo wiedzieć, jakiego zachowania się od nich oczekuje.

This article originated in an effort to explain the usefulness of employing the models of the Church in the study of canon law. The article consists of three parts. The first one offers general approach to model as a tool for understanding the reality. The second part of the text is presenting some models of the Church. The last section of this reflection centers on R. Sobański's model of the Church as a mystery. Summing up, it can be said that among many models of the Church, Sobański's model can be successfully used in the realm of canon law.

In recent years one can observe in Poland the increasing numbers of investments of the churchyard crosses, roadside shrines, memorials, or plaques, that is, the objects of so-called „small sacred architecture”.The article presents the current Polish and Church law that regulate the matter. Observance of the norms from both systems of laws is required to avoid serious legal consequences, which can overshadow the noble intensions of originators.At the end of the paper, there are given some practical remarks and specific solutions, which can be of help for the persons who are responsible for the sacred architecture in a diocese.

The problem of papal primacy is one the most fragile issues between Catholics and Protestants. The author of the article discusses the possibility of a separation of the primacy of jurisdiction from the primacy of teaching. The method of reasoning follows the one of St. Thomas: first the arguments pro are given, and later the arguments contra. The arguments are from Catholic theology, Lutheran theology and philosophy. The answer is given from Ecumenical Perspective.

This article contains several ex promptu written comments on the Decree of the Polish Bishops’ Conference of 13 March 2018 on the protection of individuals with regard to the processing of personal data in the Catholic Church on the basis of the case study of a kindergarten. The article discusses such issues as: the subject matter, material scope, simultaneity of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data in the activities of the public juridic persons, as well as the problem whether the Decree is in force ad poenam or ad culpam.

W artykule zostały przedyskutowane takie zagadnienia jak: zakres podmiotowy, zakres przedmiotowy, symultaniczność obowiązywania Dekretu i Rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 roku w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych w działalności kościelnych publicznych osób prawnych, a także problem, czy Dekret obowiązuje ad poenam, czy ad culpam.

Legislation is an art that takes inspiration from a variety of sources. There is a question: Should the antiquity be one of them? The paper attempts to give the answer. The author gives some proposals of such borrowing of ideas in the realm of marriage and family: making a choice of a candidate for a spouse, engagement and financial aspect of future marriage, contracting marriage without obligatory form, and a role of a father in the family. The presentation leads to the conclusion that the legislator should value culture of antiquity as a source of ideals but while borrowing the antique ideas he must follow the rules needed for such an action. The rules are presented in the paper, as postulates for good legislation.

The aim of the paper is to present the role and tasks of imagination in legislation. The author focuses on the following realms of legislation action: legitimacy of enacting a new law, variants of possible interpretations of law, acceptance of law by the addressees of law, and the results of entering the law into force. The conclusion is as follows: a good legislator is a realist with a proper dose of imagination.

In present times, there are many threats to the marriage and the family. Among other things the risks come from provisions of law that is drafted without regard for Christian roots of the European civilization. In the face of the situation, the Christian Communities are called to start an ecumenical dialog and to undertake a practical action to promote their common Christian paradigm of the marriage and the family that would be a pattern for a state legislator. It is possible in Poland, because the teaching of the Catholic Church and the Evangelical Church of the Augsburg Confession in Poland about the marriage and the family have in terms of content much in common. Additionally, there are many legal possibilities, like, e.g., legislative initiative, to undertake such a promotion of Christian paradigm.

The purpose of this article is to present, in the form of several comments, a critical assessment of the Guidelines made in the context of the principles of the principles technique and the amendment of the Penal Code.

Although it has been 50 years since the constitution Gaudium et spes of the Second Vatican Council was published, the document is not out of date at all. The aim of the paper is to seek out and analyze the requirements towards legislation in the social matters, which are contained in the constitution in question. The points discussed in the paper are: relevance of law, directing law towards common good, safeguarding human rights, taking into consideration human dignity and not absolutizing the autonomy of law. As it was proven, Gaudium et spes still can be a valuable and vivid source of ideas for organizing social matters.

The paper presents the meeting of theology and jurisprudence in the work of church legislator. The conventional acts and norms of competency presented in canon law, such as reception of orders, celebration of marriage, imparting blessings, giving dispensation, giving absolution, pardoning an adulterous partner, giving judgment, being a qualified witness for marriage are reasonable because of the rules of sense giving them a sense. In canon law, the rules in question do not depend on the will of legislator only but they are built on the theological reasoning. The conclusion is that the church legislator, in drafting law, must take into consideration the theological factors. This limits his freedom in making legislative decisions. For instance, he cannot admit in the rules of sense a competence for the conventional acts to those who are not able to carry out the act according to theological rules. The article ends with postulate to the church legislator to take care of theological correctness of law drafted by him.

The article presents some regulations in particular canon law issued by the Episcopal Conference of Poland in reaction to the social changes that have taken place after a political and economic turning point in the year 1989. In the first part of the paper a short description of the Episcopal Conference is given. It serves to facilitate the subsequent evaluation of the acts issued by the Conference. The second part deals with one of the transformations in Polish society that is a new way of application and realization the right to association. Proper norming acts are analyzed. At the end of the second part some areas which require more regulations in canon law are mentioned. The very last part is dedicated to the recapitulation and conclusions. Summing up it can be said that the Episcopal Conference of Poland appropriately fulfills its duty by helping the faithful to cope with the hardships accompanying the changes in society.

Law is an essential part of existence and functionality of every human community. Law, as well as a society, is like a living organism – it comes to existence, lives and dies. Life of law is always connected with change in law. The paper’s aim is to present some of the factors of the modification in law. The factors taken under consideration are as follows: sociological, cultural, and economical. They all come from the life of society what is well articulated by an ancient motto – ius sequitur vitam. It is very important for a legislator to be aware of the necessity of change in law in regard to the level of development of society, and, on the other hand, he must know well what is unchangeable in legal system.

Legislation is an art. It requires a vast knowledge of the principles of law and also of the technique of legal drafting. Due to the special importance of law in the Church, a church lawgiver must try hard to do his job duly. Any critique of the outcome of his activity should be seen as an expression of sincere care for the Church. In the perspective of law drafting techniques, the paper offers an analysis of the new statute of the Pontifical University of John Paul II in Kraków, that went into force on June 8th 2015. The general conclusion is that the statue in question was made without much respect for rules of the good legislation and should be amended soon.

Ze względu na szczególne znaczenie prawa w Kościele, każdy prawodawca kościelny musi dołożyć wszelkich starań, aby należycie wykonywać swoją pracę. Krytyka wyników jego działalności powinna być zawsze postrzegana jako wyraz szczerej troski o Kościół. W perspektywie technik legislacyjnych w niniejszym artykule przedstawiono analizę nowego statutu Uniwersytetu Papieskiego Jana Pawła II w Krakowie, który wszedł w życie 8 czerwca 2015 roku. Ogólny wniosek z rozważań jest taki, że statut, o którym mowa, został napisany bez większego poszanowania zasad dobrego prawodawstwa i powinien zostać wkrótce zmieniony.

The paper discusses the problem of the integrating function of canon law for the community of the faithful. The author offers some arguments in support of the thesis. They are as follows: an argument from the genesis of canon law, an argument from the nature of customary law, an argument from the function of church law and from values connected with canonical norms. Also arguments from legal institutions like diocesan synod and diocesan and parish pastoral council are provided. Realization of the right to association and role of particular law are offered as arguments. The conclusion of the paper is that canon law serves the process of integration of the faithful.

The article offers a demonstration of the correlation between faith and church law in the catholic perspective. The author stands on the position that faith is of essence for law understood as a phenomenon and as regulations that play an active role in the life of community of believers. It is because faith is a factor in the processes of drafting law, interpreting law, and implementing law. The conclusion is that in the study of church law more attention should be paid to faith especially during the Year of faith.

The percentage of successful collections of alimony for children in Poland is very low. This serious problem can raise the question: What can the Church do, using its own legal means, to help increase the fulfillment of court-ordered provisions for children? Answering the question, the article discusses the bans on marriage. The fist is a ban of assisting, without the permission of the local Ordinary, at marriage of a person for whom a previous union has created natural obligations towards children (can. 1071 § 1). The second is a prohibition of entering marriage imposed by the local Ordinary in a specific case for a time, for a grave reason and while that reason persists (can. 1077 § 1). There is also in the paper a presentation of alimony in Polish state law and a supplement that treats about a prohibition of marriage appended to the judgement by the tribunal in annulment case (can. 1684 § 1).

The Concordat between the Holy See and the Republic of Poland from 1993 has a preamble. The purpose of this paper is to answer the question whether in the specific case of the Polish concordat, the general principle, which states that the preamble to law helps to interpret it, is working. To consider the matter, some points are discussed which refer mainly to the subject matter of the preamble. The conclusion is ambivalent. The preamble in question may be helpful in explaining the meaning of the provisions of the fundamental part of the concordat. However, due to the editorial shortcomings or vague wording of the preamble, it may make the process of interpretation more difficult.

Celem niniejszego artykułu jest odpowiedź na pytanie, czy w konkretnym przypadku polskiego konkordatu ogólna zasada, zgodnie z którą preambuła pomaga w interpretacji, się sprawdza. W celu omówienia tego zagadnienia przeanalizowano kilka kwestii, które odnoszą się głównie do treści preambuły. Wniosek jest niejednoznaczny. Preambuła, o której mowa, może być pomocna w wyjaśnieniu znaczenia postanowień podstawowej części konkordatu. Jednakże ze względu na braki redakcyjne lub niejasne sformułowania w preambule może ona utrudnić proces interpretacji.

A part of the relation between Church and state are interrelations between their systems of law. The aim of the paper is to present the problem of influence of state law on canon law. The discussion presented in the paper is to refer to the current situation in Poland and relations of the Catholic Church and the Republic of Poland. Document issued by the Episcopal Conference of Poland titled “The Guidelines for initial canonical inquiry and in the case of clerical accusations of deeds against the Sixth Commandment of the Decalogue with a minor under the age of eighteen” (2014) and the amends to it is an example. The conclusion is that the church legislator, who wants to be a good Shepherd of his Flock is to be knowledgeable about the state law and must be vigilant and constantly monitor the legislative work of the legislative state organs. The postulate in the matter can be formulated especially for the legislative body of the Episcopal Conference that is the Council for Legal Affairs. Mutatis mutandis the principles of the Church and state relations and consequences of the relations for legislation can be applied to different religious organizations or different states.

Częścią relacji między Kościołem a państwem są wzajemne zależności między ich prawnymi systemami. Celem artykułu jest przedstawienie problemu wpływu prawa państwowego na prawo kanoniczne. W artykule omówiona została aktualna sytuacja w Polsce pomiędzy Kościołem katolickim i Rzecząpospolitą Polską. Dokument wydany przez Konferencję Episkopatu Polski zatytułowany „Wytyczne dotyczące wstępnego dochodzenia kanonicznego w przypadku oskarżeń duchownych o czyny przeciwko szóstemu przykazaniu Dekalogu z osobą niepełnoletnią poniżej osiemnastego roku życia” (2014) i zmiany w nim dokonane są ilustracją tego oddziaływania. Wniosek z przeprowadzonych rozważań jest następujący: prawodawca kościelny, który chce być dobrym pasterzem swojego stada, powinien mieć wiedzę na temat prawa państwowego. Musi on być czujny i stale monitorować prace państwowych organów ustawodawczych. Postulat w tej materii może być sformułowany specjalnie wobec organu legislacyjnego Konferencji Episkopatu, czyli Rady Prawnej. Mutatis mutandis zasady relacji Kościoła i państwa oraz konsekwencje działalności prawodawczych Kościoła można zastosować do różnych związków wyznaniowych lub różnych państw.
