The deputy’s oath of office is a solemn declaration taken publicly in the presence of the Sejm and provided to the Senior Marshal by whom a new Member of Parliament (MP) swears to perform his duties to the Nation diligently and conscientiously, to safeguard the sovereignty and interests of the State, to do all within his power for the prosperity of the Homeland and the well-being of its citizens, and to observe the Constitution and other laws of the Republic of Poland. The object of the paper is to exhibit the normative side of the deputy’s oath of office as compared to parliamentary practice of this institution. The analysis of individual legal provisions is combined with the presentation of the operationalization of the given institution in the Polish legal order from the times of the Noble Republic of Poland to nowadays. There are two co-existing aspects of the deputy’s oath of office, namely the legal (normative) aspect and the symbolic (moral, political, religious) one. The legal dimension of the title institution manifests its importance in the fact that taking the oath is an absolute condition of the commencement of the performance of the parliamentary mandate. Following taking the oath of office an MP obtains full rights and responsibilities of the MP status. From the day of the announcement of the results of the elections until the swearing-in a deputy participates only in very limited powers and duties (e.g. formal parliamentary immunity). A refusal to take the oath is in turn deemed as renunciation of the mandate. The text of the oath formulates also the primary principles of the MP’s deontology, that is the ethical requirements governing the deputy’s professional activity in the Sejm. Finally, the given institution reveals its sacral dimension in the capability of taking the oath with the additional sentence “So help me God”. The optional nature of the act of invocation results in both the principle of citizen’s freedom of conscience and religion and the principle of separation of church and state being respected.
The article discusses the practice of invoking literary works in the jurisprudence of the European Court of Human Rights. The quantitative analysis of the case law allowed for the formulation of some conclusions. Firstly, literary references appear exclusively in dissents and concurrences, not in the Court’s judgments themselves. Secondly, the phenomenon of citing fiction in the ECtHR’s case law is neither common nor marginal. Thirdly, in the last two decades there has been a marked intensification in the use of literary references by the Court’s judges. Fourthly, the willingness to cite works of fiction in the dissent or concurrence is essentially independent of the judge’s nationality, sex or country of origin. Fifthly, literature is one of many extra-legal sources quoted in the ECtHR’s case law, among those such as philosophy, movies or music.

W artykule omówiono praktykę posługiwania się odwołaniami do literatury pięknej w orzecznictwie Europejskiego Trybunału Praw Człowieka. Kwantytatywne studium orzecznictwa pozwoliło na sformułowanie kilku wniosków. Po pierwsze, beletrystyczne odniesienia pojawiają się nie w uzasadnieniach wyroków Trybunału, a wyłącznie w zdaniach odrębnych i zbieżnych do tych wyroków. Po drugie, praktyka posiłkowania się utworami literackimi w orzecznictwie strasburskim jakkolwiek nie jest powszechna, to zarazem nie ma też charakteru sporadycznego. Po trzecie, w ostatnich dwóch dekadach sędziowie Trybunału co raz częściej przywołują dzieła literatury pięknej. Po czwarte, gotowość posłużenia się literackim odniesieniem jest zasadniczo niezależna od narodowości i płci sędziego oraz typu kultury prawnej właściwej dla jego kraju pochodzenia. Po piąte, literatura piękna to jedno z wielu źródeł pozaprawnych wykorzystywanych przez sędziów Trybunału w zdaniach odrębnych i zbieżnych, obok np. filozofii, kinematografii czy muzyki.
Public Pro-life Protests in Canadian Case Law Summary The article deals with the legal standards applied in public anti-abortion protests in Canada. On the basis of an examination of Canadian case law, the author argues that the restrictions on pro-life protests are disproportionate with respect to the objective of ensuring safe access to women’s reproductive rights. The Access to Abortion Services Act and court injunctions are preventing pro-lifers from demonstrating in the vicinity of abortion clinics in defence of the right to life of unborn children. The degree to which pro-lifers’ constitutional freedom of speech is being infringed is in breach of the principles of the liberal state. The right to express opposition to abortion is also limited, although to a lesser extent, in other public places, such as street pavements and squares, university campuses and airport terminals. In the author’s view, imprisonment as the penalty for peaceful protest against the Canadian abortion law – for example, Linda Gibbons spent a total of over 10 years in prison for her pro-life activities! – is inherently incompatible with the essence of a “free and democratic society” as defined in Article 1 of the Canadian Charter of Rights and Freedoms.
The article presents the results of a quantitative and qualitative comparative study of the presence of direct references to God in the constitutions of modern states. References to God appearing in the fundamental laws of nearly two-thirds of the countries of the world differ in their linguistic forms and functions they perform. Most often, they take the form of an invocatio or nominatio Dei in preambles and appear in oaths of office, while they are less frequently included in other constitutional provisions such as those defining official state symbols – national flags, national anthems or emblems. References to God in the fundamental laws do not have a theological dimension, but they are a manifestation of legislators’ responsiveness to the convictions and beliefs of citizens about God. In the author’s opinion, the decision to include, not include or remove a reference to God in a constitution should follow from the evolving importance of the sphere of sacrum for the society of a given state as a political sovereign.

W artykule przedstawiono rezultaty ilościowo-jakościowego komparatystycznego studium konstytucji państw współczesnych pod kątem obecności w nich bezpośrednich odniesień do Boga. Odwołania do Boga występujące w ustawach zasadniczych blisko 2/3 państw globu posiadają różną postać językową i pełnią kilka funkcji. Najczęściej przybierają formę invocatio lub nominatio Dei w preambułach oraz pojawiają się w rotach przysięgi funkcjonariuszy publicznych, rzadziej są natomiast udziałem innych postanowień konstytucji, np. tych określających oficjalne symbole państwowe, jak flaga, hymn czy godło. Odwołania do Boga w ustawach zasadniczych nie mają wymiaru teologicznego, lecz stanowią przejaw responsywności ustrojodawcy wobec przekonań i wierzeń obywateli o Bogu. W ocenie autora, decyzja o zamieszczeniu, niezamieszczeniu lub usunięciu odniesienia do Boga w konstytucji powinna stanowić wypadkową ewoluującej doniosłości sfery sacrum dla społeczeństwa danego państwa jako politycznego suwerena.
The article presents a critical analysis of the U.S. federal court rulings regarding restrictions on freedom of religion during the Covid-19 pandemic. The subject of judicial control were the executive orders prohibiting public religious gatherings or limiting the number of participants. The author shares the view of the part of the courts which assumed that the laws introducing stricter restrictions for churches and religious assemblies than for other comparable places and secular gatherings, in order to be constitutional, need to simultaneously pursue the compelling interest of the state and constitute proportional measures. While the protection of public health is a compelling interest of the government, the total prohibition of in-person church services or limiting religious gatherings to only a few people seem to violate the criterion of the least restrictive measure. When deciding what forms of social activity and businesses to exclude from the ban on public gatherings, the authorities cannot discriminatively assume that religious services are something secondary and not very urgent, especially if the same authorities consider the operation of e.g. liquor stores or shopping malls as “essential” or “life sustaining”.

W artykule przedstawiono i poddano analizie orzeczenia amerykańskich sądów federalnych w zakresie ograniczeń wolności religii w początkowym okresie pandemii COVID-19. Przedmiotem kontroli sądów były przepisy zakazujące publicznych zgromadzeń religijnych lub ograniczające liczbę ich uczestników. Autor podziela stanowisko tej części sądów, które przyjęły, że przepisy wprowadzające surowsze obostrzenia dla świątyń i zgromadzeń religijnych niż względem innych porównywalnych miejsc i świeckich zgromadzeń dla swej konstytucyjności potrzebują jednocześnie realizować kluczowy interes i być środkiem proporcjonalnym. O ile ochrona zdrowia publicznego stanowi kluczowy interes władzy, o tyle całkowity zakaz liturgii i nabożeństw z udziałem wiernych czy ustalenie liczby uczestników aktów kultu na poziomie kilku osób wydają się naruszać kryterium najmniej restrykcyjnego środka. Decydując o tym, jakie formy społecznej aktywności i działalności wyłączyć spod zakazu zgromadzeń publicznych władza nie może dyskryminująco zakładać, że praktyki religijne są czymś drugorzędnym i mało pilnym, tym bardziej jeśli ta sama władza za istotną (essential) czy pierwszej potrzeby (life sustaining) uznaje działalność np. sklepów monopolowych bądź centrów handlowych.
The article presents the results of a quantitative and qualitative study of the Polish case law in terms of the presence of direct references to schools of legal thought in the written justifications of judgments. Although these types of references are very rare, their intensification can be observed in the last decade. In justifications of court decisions, references were made to just a few strands of jurisprudence. Most references relate to jusnaturalism and legal positivism. Courts characterize schools of legal thought in a simplified and exaggerated manner, and sometimes also incorrectly. The judicature usually disregards the authors’ versions of particular strands of jurisprudence, reaching for the claims derived from these strands in their ‘average’ form. The paper posits that legal philosophy is potentially useful for courts, especially in hard cases. It may help judges to perform the explanatory and persuasive functions of justifications of judgments. The condition for this is that references to the tenets of specific schools of legal thought should not be superficial, shallow or slogan-like. Otherwise, they play only an ornamental role, not an argumentative one.

Jakkolwiek odwołania tego typu są nieliczne, to jednocześnie w ostatniej dekadzie można zaobserwować ich intensyfikację. W uzasadnieniach orzeczeń rozpoznano nawiązania do zaledwie kilku kierunków filozoficzno-prawnych. Większość odniesień dotyczy jusnaturalizmu i pozytywizmu prawniczego. Sądy charakteryzują szkoły filozoficzno-prawne w sposób uproszczony, a niekiedy również przejaskrawiony i merytorycznie wadliwy. Judykatura zwykle abstrahuje od wersji autorskich poszczególnych kierunków filozoficzno-prawnych, sięgając do właściwych dla tych kierunków założeń w ich „uśrednionej” postaci. W ocenie Autora argumentacja filozoficzno-prawna posiada utylitarny potencjał dla sądów, zwłaszcza w hard cases. Argumenty te mogą pomóc sędziom w realizacji funkcji eksplanacyjnej i perswazyjnej uzasadnienia. Warunkiem tego jest, aby nawiązania do założeń konkretnych kierunków filozoficzno-prawnych nie były jedynie powierzchownego czy hasłowego charakteru. Wówczas bowiem pełnią rolę ornamentacyjną a nie argumentacyjną.
W artykule przedstawiono rezultaty studium uzasadnień orzeczeń polskich sądów pod kątem obecności w nich odwołań do common law. Analiza tytułowego zagadnienia jest głównie kwalitatywnej natury o charakterze deskryptywno-systematyzacyjnym i eksplanacyjnym. W opracowaniu skoncentrowano się na ustaleniu funkcji pełnionych przez odniesienia do prawa anglosaskiego w judykatach oraz na określeniu czynników determinujących czy kauzalnie wyjaśniających praktykę sądów nawiązywania do porządku prawa precedensowego w uzasadnieniach wyroków. Wskazano też ogólne prawidłowości znamionujące omawiane zjawisko. Zaprezentowano ponadto ustalenia kwantytatywne odnośnie do skali, intensywności i dynamik przypadków odwołań do prawa anglosaskiego w uzasadnieniach orzeczeń. Common law będące do tej pory przedmiotem komparatystycznych dociekań polskiej doktryny prawniczej, w co raz większym stopniu zwraca uwagę także polskich sądów jako organów stosowania prawa.

The article presents the results of a study of the reasons for rulings of the Polish courts in terms of the presence in them of references to common law. The analysis of the title issue is mainly of a qualitative nature with descriptive, systematic, and explanatory features. The research has focused on determining the functions played by the references to common law in judgments and on recognizing the factors that rule or causally explain the practice of the courts referring to the given law system in their decisions. Some general regularities characterizing the discussed phenomenon have also been shown. Furthermore, quantitative findings on the scale, intensity, and dynamics of the references to common law in the reasons for judgments have been presented. Common law, which until now has been the subject of comparative studies of the Polish legal science, is increasingly drawing attention of the Polish courts as the law-applying bodies.
In its jurisprudence, the Constitutional Tribunal of the Republic of Poland often uses the comparative law method. For it, comparative material is not only the normative acts in force in other countries, but also foreign jurisprudence. This article presents the results of a quantitative and qualitative study of the judgments of the Polish Constitutional Tribunal in terms of the presence of references to the judgments of other constitutional courts. Reference by the Tribunal to foreign constitutional jurisprudence is a relatively rare practice, but not an occasional one. It was intensified after Poland’s accession to the European Union. Although the main point of reference for the Tribunal in its comparative analysis is still the jurisprudence of the German Federal Constitutional Court and constitutional courts of other Western countries, it also increasingly frequently reaches to the judgments of the constitutional courts of Central European and Baltic countries. The subject issue is part of the progressive process of the so-called transnational judicial discourse or judicial globalization. The reluctance of the Tribunal to reach in its rulings to judgments of foreign constitutional courts, which has been observed since 2017, may be the beginning of its assumption of an exceptionalistic attitude similar to the U.S. Supreme Court.

Second, in the two last decades there has been a clear intensification in the use of philosophical references in judgments. Third, references to philosophers exercise a number of different functions falling within the clarification and persuasive purposes of grounds of judgments. Fourth, there is no one attitude among courts and the parties towards the presence of philosophical arguments in the judicial process. The titular issue is not the further stage of the legal scholarship’s discourse on “judges as philosophers” in the likeness of Dworkin’s “Judge Hercules”. The practice of referring to philosophers by the courts is primarily an issue of the style of reasons for judgment and the role of non-legal sources in the rationalisation of judicial decisions – and not so much in the making of them. In the author’s view, the case law study reveals the utilitarian potential of philosophy for judicial argumentation.

Przedmiotem artykułu jest odniesienie do piękna w preambule Konstytucji RP z 1997 r. W pierwszej kolejności przedstawiono historię legislacyjną fragmentu wstępu ustawy zasadniczej stanowiącym o pięknie jako uniwersalnej wartości. Następnie dokonano jego interpretacji, zajmując stanowisko, że konstytucyjne pojęcie piękna jest nie tylko kategorią estetyczną, ale również i etyczną. W końcu, studium orzecznictwa oraz aktów normatywnych pozwoliło określić zakres operacjonalizacji piękna jako wartości konstytucyjnej. Krytycznie odniesiono się do stanu rzeczy, w którym piękno będące elementem konstytucyjnej aksjologii odgrywa ledwie zauważalną rolę w praktyce tworzenia i stosowania prawa polskiego.

The subject of the article is a reference to beauty in the preamble to the Constitution of the Republic of Poland of 1997. First, the legislative history of the fragment of the introduction to the Constitution, which constitutes beauty as a universal value, has been presented. Then it has been interpreted, taking the position that the constitutional concept of beauty is not only an aesthetic category but also an ethical category. Finally, a study of jurisprudence and normative acts has allowed to define the scope of beauty operationalization as a constitutional value. Critical reference has been made to the state of affairs in which beauty, being an element of constitutional axiology, plays a barely noticeable role in the practice of creating and applying Polish law.
Przedmiotem artykułu są odniesienia do prawdy w konstytucjach państw współczesnych. Komparatystyczne studium pokazuje wielość kontekstów, w których kategoria prawdy jest wzmiankowana w kilkudziesięciu ustawach zasadniczych. Pozytywnie należy ocenić wymienianie w konstytucjach prawdy jako części składowej aksjologii porządku prawnego i społecznego, podstawy sprawiedliwości tranzycyjnej czy zasady postępowania sądowego i administracyjnego. Poważne zastrzeżenia budzi natomiast czynienie z prawdy granicy wolności słowa. Przyznanie konstytucyjnej ochrony jedynie wypowiedziom prawdziwym może tłumić publiczną debatę na sprawy społecznie doniosłe. Przeprowadzona analiza nie potwierdza tezy liberalizmu politycznego o irrelewantności prawdy dla prawa i polityki.

The subject of the article is references to the truth in the constitutions of modern states. The comparative study shows multiplicity of contexts in which the category of truth is mentioned in several dozen fundamental laws. The mention of truth in the constitutions as a component of the axiology of the legal and social order, the basis of transitional justice or the principle of court and administrative proceedings should be assessed positively. However, making the truth a limit of freedom of speech raises serious reservations. Granting constitutional protection only to truthful statements can stifle the public debate on socially prominent issues. The conducted analysis does not confirm the thesis of political liberalism that the truth is irrelevant for law and politics.
The article presents the genesis, evolution and current status of Catholic law schools in the USA against the background of social and cultural changes. Since the 1960s and 1970s most of the nominally Catholic law schools in the United States have practically been no different from their secular counterparts. In the Author’s opinion, the clear Catholic identity of those schools should be framed in the light of the provisions of Pope John Paul II’s Apostolic Constitution Ex Corde Ecclesiae. In the first place, this identity should manifest itself in the research and teaching of a wide range of legal topics. The curriculum and the scholarship of the faculty should take into account the rich Catholic philosophical and theological tradition. Catholic law schools, not only those in the United States, are called to the integrity of their religious identity with full professionalism, faith with reason, respect for Catholic doctrine and morality with strictly scientific and critical methodology aimed at seeking and communicating objective truth, transferring knowledge to students with their spiritual- and intellectual formation.

W artykule przedstawiono genezę, ewolucję i stan obecny katolickich szkół prawniczych w USA na tle zachodzących zmian społecznych i kulturowych. Od lat 60-70. minionego stulecia większość z nominalnie katolickich szkół prawniczych w Stanach Zjednoczonych praktycznie nie różni się od swoich świeckich odpowiedników. W ocenie Autora wyraźną katolicką tożsamość tych szkół należy kształtować, kierując się postanowieniami Konstytucji apostolskiej Jana Pawła II Ex Corde Ecclesiae. W pierwszej kolejności tożsamość ta powinna przejawiać się w działalności badawczo-dydaktycznej. Program nauczania studentów oraz twórczość naukowa wykładowców powinny uwzględniać bogatą katolicką tradycję filozoficzno-teologiczną. Katolickie szkoły prawnicze, nie tylko te w Stanach Zjednoczonych, są powołane do integralności religijnej tożsamości z pełnym profesjonalizmem, wiary z rozumem, respektowania katolickiej doktryny i moralności z działaniem ściśle naukowym i krytycznym ukierunkowanym na poszukiwanie i głoszenie obiektywnej prawdy, przekazywania wiedzy studentom z ich duchowo-intelektualną formacją.
Polish Marian devotion is reflected in the Polish law. Literal references to Saint Mary are contained in legal acts of public authorities, as well as acts enacted by local government bodies. These acts occupy different places in the system of sources of law. Most of them does not raise a constitutional objection, the legality of others is a debatable issue (eg. City council resolution expressing the will of Mary’s patronage on the city), and a few are contrary to the principle of religious, ideological and philosophical impartiality of the public authorities. Symbolic dimension of legal references to Mary – eg. Mary’s images in the municipal coats of arms or Mary’s name used in public streets names – demonstrates responsiveness of the Polish legal order to religious beliefs of some citizens, while not denying the paradigm of the separation of church and state, and without prejudice to the rights and freedoms of other people.

Pobożność maryjna Polaków znajduje swoje odzwierciedlenie w polskim prawie. Literalne odwołania do Matki Bożej zawierają akty prawne naczelnych organów władzy publicznej, jak i akty stanowione przez organy samorządu terytorialnego. Akty te przejawiają duże zróżnicowanie co do kategoryzacji i miejsca w systemie źródeł prawa. Większość z nich nie budzi zastrzeżeń natury konstytucyjnej, legalność innych jest kwestią nieoczywistą (np. uchwała rady miasta wyrażająca wolę ustanowienia Maryi patronką miasta), nieliczne zaś stoją w sprzeczności z zasadą religijnej, światopoglądowej i filozoficznej bezstronności władz publicznych. Symboliczny wymiar odwołań w prawie do Maryi – np. obecność wizerunku Maryi w herbach gmin czy nazwanie imieniem Maryi publicznej ulicy – dowodzi responsywności polskiego porządku prawnego wobec przekonań religijnych części swych obywateli, zarazem nie przecząc paradygmatowi rozdziału Kościoła od państwa i nie naruszając praw i wolności innych osób.

Wśród nich znajdują się akty normatywne, akty o wątpliwej normatywności i akty indywidualno-konkretne, jak również – przyjmując inną typologię – akty prawa powszechnie obowiązującego (w tym akty prawa miejscowego) i akty prawa wewnętrznego. Autor omawia ponadto niewiążące uchwały okolicznościowe Sejmu i Senatu poświęcone Papieżowi, które przynależą nie tyle do systemu prawnego, co szerszej kategorii porządku prawnego. Odwołania do osoby Jana Pawła II w polskim prawodawstwie są głównie symbolicznej natury. Większość wymienionych w artykule aktów dowodzi szacunku prawodawcy wobec Jana Pawła II jako powszechnego autorytetu moralnego. Prawodawca przy pomocy rodzajowo różnych przepisów prawnych składa hołd Papieżowi. Pozostałe z kolei akty, w których znajdują się odniesienia do Jana Pawła II, są pragmatycznego i doraźnego charakteru, służąc zapewnieniu prawidłowego przebiegu papieskich pielgrzymek do ojczyzny. The paper deals with the issue of pope John Paul II’s legal relevance in the Polish legislation. Legal acts that literally refer to the person of the Polish Pope very both as to their theme and their place in the sources of law system. Among them there are normative acts, acts of dubious normativity and individual ones, as well as – concerning another typology – acts of universally binding law (including local law) and acts of the internal management. The author also makes remarks on nonbinding commemorative resolutions of the Sejm and the Senate dedicated to the Pope, which belong not so much to the legal system, as to the broader category of the legal order. References to the person of John Paul II in the Polish legal system is largely symbolic in nature. Most of the acts mentioned in the article prove the legislator’s respect to the title character as a universal moral authority. The legislator with the aid of diverse legal provisions pays homage to the Pope. The other legal acts, in which reference is made to John Paul II, in turn are pragmatic and ad hoc, aiming to ensure the proper operation of the Pope’s pilgrimages to Homeland. Finally, the author formulates conclusions on the need for jurisprudential study on the impact of John Paul II’s teachings on the law-making and law-applying processes in Poland.

В статье представлено польское законодательство с точки зрения действующего законодательства обращений к личности Иоанна Павла II. Законодательства содержащие буквальную ссылку на личность Папы-поляка различаются как тематически и занимаемым местом в системе источников права. Среди них находятся нормативные акты, акты сомнительной нормативности и акты индивидуально-специфические, а - принимая другую типологию - акты общеобязательного права (в том числе актов местного права) и акты законодательства. Кроме того, автор обсуждает, не обязывающие резолюции Сейма и Сената посвященные Папе, которые принадлежат не столько к правовой системе, как к широкой категории права. Обращение к личности Иоанна Павла II в польском законодательстве носят, в основном, символический характер. Большинство упомянутых в статье актов показывают уважение законодателя к Иоанну Павлу II как к моральному авторитету. Законодатель с помощью различных нормативных актов отдает дань уважения Папе. Другие, в свою очередь, законы, в которых есть ссылки на Иоанна Павла II, прагматичны и специального характера, служат обеспечению надлежащего проведения папского паломничества на родину. В конце публикации автор указывает на необходимость юридических исследований о влиянии учения Иоанна Павла II на процессы создания и применения закона в Польше.
W artykule przybliżono i poddano analizie poglądy papieża Franciszka na temat świeckiego wymiaru sprawiedliwości. Przedstawiono wskazania, postulaty czy oczekiwania papieża odnośnie do sędziów i procesu orzeczniczego. Wskazano również te zjawiska i praktyki, które w nauczaniu papieskim zostały uznane za sprzeniewierzające się etosowi sędziego i roli judykatywy. Omówiono podnoszone przez Franciszka wyzwania, przed jakimi stoją współcześnie sądy, w szczególności problem aktywizmu sędziowskiego oraz zagrożeń dla niezależności trzeciej władzy i jej reprezentantów. Ponadto porównawczo nawiązano do zapatrywań poprzedników Franciszka na kwestię sądownictwa. W ocenie autora papieskie nauczanie stanowi źródło wartościowych uwag w przedmiocie sądów i sędziów, zasługując na szerszy rezonans w środowisku prawniczym w ramach tzw. zewnętrznej integracji prawoznawstwa.
Niniejsze opracowanie omawia Wyrok Sądu Sprawiedliwości Ontario z dnia 12 czerwca 2014 r. w sprawie R. v. Wagner. Komentowane orzeczenie dotyczy prawnych ram protestów antyaborcyjnych w kanadyjskim porządku prawnym. Sąd uznał aktywistkę pro-life Mary Wagner winną naruszenia sądowych nakazów nadzoru kuratorskiego – które zakazywały jej przebywania na terenie klinik aborcyjnych w Ontario – oraz zakłócania korzystania z prywatnej nieruchomości. Oskarżona weszła do kliniki aborcyjnej w Toronto i próbowała przekonać znajdujące się tam pacjentki do zrezygnowania z aborcji, wręczając im róże i broszury. Sąd uznał, iż ani obrona konieczna (konkretnie „obrona innych”), ani stan wyższej konieczności nie wyłączają odpowiedzialności karnej Wagner. Odrzucił również twierdzenie, iż płód jest „istotą ludzką” na gruncie prawa. Stwierdził, iż przypisanie człowieczeństwa płodowi w prawie jest zadaniem normatywnym niezależnym od naukowych kategoryzacji. To skrajnie normatywistyczne założenie doprowadziło sąd do wniosku, że protest Wagner w klinice nie był próbą ochrony prawa „każdego” (everyone) do życia w myśl art. 7 Kanadyjskiej Karty Praw i Wolności. W końcu sąd przyjął, że ani zasada „rządów prawa”, ani zasada „zwierzchności Boga” wysłowione w preambule Karty nie konwalidują działań oskarżonej. W ocenie autora komentowany wyrok jest zgodny z pozytywistycznie rozumianą literą prawa. Kwestią sporną jest to, czy pozostaje on sprawiedliwy, w zależności od przyjętej koncepcji sprawiedliwości. Glosowany wyrok przeczy jednak wymogom słuszności. Karanie więzieniem za pokojowe protesty pro-life jest poważnym naruszeniem kluczowych wartości państwa liberalnego i demokratycznego.

The paper deals with the judgment of the Ontario Court of Justice of 12 June 2014 in the case R. v. Wagner 2015 ONCJ 66. The reviewed judgment refers to legal frameworks of anti-abortion protests in the Canadian legal order. The Court found pro-life activist Mary Wagner guilty of breach of probation orders – which prohibited her from being on the premises of any abortion provider in Ontario – and of mischief interfering with private property. She gained entry to abortion clinic in Toronto and sought to intercede with various clinic patients by offering them roses and pro-life brochures in an effort to have them reconsider their interest in having an abortion. The Court held that neither law of self-defence (exactly defence of others) nor the law of necessity could insulate Wagner’s conduct from criminal liability. The Court also rejected the contention that a foetus is a “human being” under the law. It said that ascribing personhood to a foetus in law is a fundamentally normative task which falls outside the concerns of scientific classification. This strong normativism position led the Court to the conclusion that Wagner’s protest in the clinic was not an attempt to protect the “everyone’s” right to life under s. 7 of the Canadian Charter Of Rights And Freedoms. Finally the Court assumed that neither Principle of the “Rule of Law” nor principle of the “Supremacy of God” – both expressed in the preamble to the Charter – convalidated the defendant’s acts. In the author’s view the reviewed judgment is consistent with the letter of the law in the sense of legal positivism. It is debatable whether the given judgment is righteousness, depending on which theory of justice is chosen to rely on. However the court’s opinion belies the requirements of equity. Imprisonment for peaceful pro-life protest is serious infringement of core values of liberal and democratic state.
A review of basic problems, connected with the presentations of the principles of law from the perspective of the dogmatic legal sciences, representing all basic legal branches allows to make an argument that the principles are not only the all-systemic structure but also they have both universal and particular features. The particularities are not always connected with divisions of the legal system on the public vs. private law, substantial vs. procedural law or state vs. international law. The specific proprieties deal with the concept of the principle, its normativity and axiological substantial content, distinction from the legal rules, as well as with the factors of “principality” of principles and their typology. That creates the theoretical significance of the category of principle of law, which, however, does not automatically make transmission of theoretical theses to the dogmatic disciplines and vice versa. That significance may built, on the other hand, the stronger conviction on the need of such cooperation, bringing the communicative and research ties within the so-called internal integration of legal sciences.

Przegląd podstawowych zagadnień związanych z prezentacją ujęć zasad prawa z perspektywy szczegółowych nauk prawnych, reprezentujących w zasadzie wszystkie podstawowe gałęzie prawa, pozwala na stwierdzenie, iż kategoria zasad jest nie tylko konstrukcją ponadgałęziową w wymiarze ogólnosystemowym, ale także jest konstrukcją, która wyraźnie zawiera zarówno powtarzające się w poszczególnych gałęziach i dogmatykach prawniczych składniki, jak i elementy odrębne. Te ostatnie nie zawsze zresztą są adekwatne w odniesieniu do podziałów systemu prawa na prawo publiczne i prywatne, materialne i procesowe czy krajowe i międzynarodowe. Dotyczy to tak pojmowania zasad prawa, ich związku z kategorią normatywności, aksjologicznym wymiarem treściowym, odróżnianiem od norm prawnych, jak i wyznaczników „zasadniczości” czy typologii zasad. Ta różnorodność świadczy również o teoretycznoprawnej doniosłości samej konstrukcji, nieprzekładającej się jednak ani na głębsze korzystanie z dokonań teorii prawa przez dogmatyki, ani też na wszechstronne wykorzystanie dokonań dogmatycznych w budowaniu teorii zasad prawa (co nie było przedmiotem niniejszych prac). Doniosłość ta może jednak wpłynąć na ukształtowanie się przekonania o potrzebie takiego „współdziałania”, w wyniku którego komunikacyjne i badawcze zbliżenie między naukami teoretycznymi i dogmatycznymi oraz między różnymi dogmatykami w ramach tzw. integracji wewnętrznej nauk prawnych mogłoby uzyskać mocniejszy wyraz.
The paper deals with the comparative analysis of the concept of legal principles and generalreference clauses. The legal principle is the intra-legal value, appearing in various ways in the legalorder, with the fundamental set of principles formed directly in the normative acts. The generalclause is presented in the paper as the reference to the extra-legal values, expressed in the legal text(by the name) but substantially left open. That empowers the court to define the name of the clauseand to find its content, what means fulfilling the criterion with the axiology, balancing individualpreferences of the court and socially determined values. Reconstruction of the principles and theclauses restricts the role of the linguistic rules of interpretation, strengthening the impact of axiologicallyinvolved systemic, teleological and functional rules.
The present paper offers a quantitative and qualitative analysis of constitutional references to Christianity. An examination of binding basic laws of individual states allowed the authors to determine the scale of references to Christianity and to systematize and typologize these references. As assumed in the study, “references to Christianity” include both direct mentions of Christian principles, values or heritage as well as implicit ones, i.e., references to God understood in accordance with monotheistic Trinitarianism and to individual Christian denominations, their followers and churches. Due to the fact that Christianity not only has a religious, but also a historical and cultural dimension, its references in the constitutions, in principle, do not deny the ideological impartiality of public authorities or lead to confessionalisation of the state. Neither do they violate the rights of followers of other religions and non-believers. It is an exaggeration to perceive constitutional references to Christianity by non-Christians as allegedly socially alienating and excluding. The constitutional legislator deciding to distinguish Christianity in a constitution is expected to be guided by the will of the sovereign. However, incorporating references to Christianity into basic laws should not serve as a tool of social engineering for proselytic purposes.

W niniejszym artykule poddano analizie ilościowej i jakościowej konstytucyjne odwołania do chrześcijaństwa. W ramach przeprowadzonego studium obowiązujących ustaw zasadniczych poszczególnych państw ustalono skalę odniesień do chrześcijaństwa oraz odniesienia te poddano systematyzacji i typologizacji. Tytułowymi odwołaniami do chrześcijaństwa objęto zarówno bezpośrednie wzmianki o chrześcijańskich zasadach, wartościach czy dziedzictwie, jak i odwołania implikatywne, tj. do Boga pojmowanego zgodnie z monoteistycznym trynitaryzmem oraz do poszczególnych chrześcijańskich denominacji, ich wyznawców i kościołów. Ze względu na historyczno-kulturowy, a nie tylko religijny wymiar chrześcijaństwa, odwołania do niego w konstytucjach co do zasady nie przeczą bezstronności światopoglądowej władz publicznych, nie prowadzą do konfesjonalizacji państwa, ani nie naruszają praw wyznawców innych religii i osób bezwyznaniowych. Egzageracją jest odbieranie odwołań tego typu przez niechrześcijan jako działań ich rzekomo społecznie alienujących i wykluczających. Od ustrojodawcy decydującego się na wyróżnienie chrześcijaństwa w konstytucji należy oczekiwać kierowania się wolą suwerena. Inkorporowanie do ustaw zasadniczych odniesień do chrześcijaństwa nie powinno jednak być narzędziem inżynierii społecznej o celach prozelickich.
