This article presents – in the context of the evolution of the Polish public social assistance system – the genesis and shaping of the personnel of this system, with particular emphasis on the place and role of social workers in this system. Attention was drawn to the direction of the evolution of the personnel of the Polish social assistance system: from the honorary activities of social workers in the times of the Second Polish Republic (1918-1939), through a mixed model of full-time social workers supported by a network of socially active local social workers in the times of the Polish People’s Republic, to professional social service, performing the regulated profession of a social worker in modern times. It also indicated how social workers were perceived in different periods of the evolution of the social welfare system and how the regulations of their legal status were assessed.

W niniejszym artykule ukazano – w kontekście ewolucji polskiego systemu publicznej pomocy społecznej – genezę i kształtowanie się kadr owego systemu, ze szczególnym uwzględnieniem miejsca i roli w tym systemie pracowników socjalnych. Zwrócono uwagę na kierunek ewolucji kadr polskiego systemu pomocy społecznej: od działalności honorowej opiekunów społecznych w czasach II Rzeczypospolitej, przez mieszany model etatowych opiekunów społecznych (a następnie pracowników socjalnych) wspieranych przez sieć społecznie działających terenowych opiekunów społecznych w czasach Polskiej Rzeczypospolitej Ludowej, po profesjonalną służbę społeczną, wykonującą regulowany zawód pracownika socjalnego w czasach współczesnych. Wskazano także, jak postrzegano społecznie pracowników socjalnych w różnych okresach ewolucji systemu pomocy społecznej i jak oceniano regulacje ich statusu prawnego.

The paper presents and assesses the Polish regulations related to Agricultural Social Insurance in the context of family legal protection. The particular attention is given to the rules which stipulate the benefits and range of recipients of this insurance. According to the academic literature, social security law plays an important role in the field of legal protection of the family. The author seeks to answer the question whether the existing normative solutions of the insurance are fulfilling this condition. The paper concludes with a presentation of key changes recommended by the author.

W niniejszym artykule dokonano prezentacji i oceny polskich rozwiązań normatywnych dotyczących renty szkoleniowej jako świadczenia z powszechnego systemu ubezpieczeń społecznych, mającego wspierać realizację procesu rehabilitacji zawodowej. Przedstawiono istotę i cel rehabilitacji zawodowej w ujęciu dokumentów międzynarodowych oraz prawa polskiego oraz wskazano rolę, jaką w procesie realizacji tej rehabilitacji przypisuje się rencie szkoleniowej. Ukazano także mankamenty obowiązujących w Polsce w tym zakresie przepisów prawa oraz przyjętych rozwiązań organizacyjnych i finansowych, które sprawiły, iż wbrew oczekiwaniom rola wskazanego świadczenia pieniężnego z ubezpieczenia społecznego w zakresie wspierania realizacji procesu rehabilitacji zawodowej jest znikoma.

This article presents and evaluates Polish normative solutions regarding the training pension as a benefit from the general social insurance system, intended to support the implementation of the vocational rehabilitation process. The essence and purpose of vocational rehabilitation in terms of international documents and Polish law were presented, and the role assigned to the training pension in the process of implementation of this rehabilitation was indicated. It also shows the shortcomings of the legal provisions in force in Poland and the adopted organizational and financial solutions, which meant that, contrary to expectations, the role of the indicated cash benefit from social insurance in supporting the implementation of the vocational rehabilitation process is negligible.

On 24 April 2011 entered into force the directive of the European Parliament and of the Council No 2011/24/UE of 9 march 2011 on the application of patients' rights in cross-border healthcare. The article analyses the duty of Member States connected with cross-border medical care, types and limits of using cross-border medical care and problems evoked by refund of medical expenses. The subject of this study is also evaluation of the preamble and the normative text of the directive No 2011/24/UE against the regulation of the European Parliament and Council (EC) No 883/2004 of 29 April 2004 on the coordination of social security systems. The new directive provides clarity about the rights of patients who seek healthcare in another Member States and supplements the rights that patients already have at European Union level through the legislation on the coordination of social security systems.

Polish legislator has defined social employment as providing certain categories of people who are threatened or affected by social exclusion (e.g. unemployment, homeless or addicted) with some opportunities to either participate in workshops that are run in centres for social integration clubs or take up supported employment. Social employment understood in this way is to aim at social reintegration that leads to restoring and maintaining the skills to participate in the life of a particular local community, and to perform social roles in one's place of work and domicile. In addition, social employment is supposed to result in vocational reintegration that leads to restoring the abilities to provide work on the labour market. The legal institution in question is, therefore, linked to a new meaning of employment that goes beyond the Polish Labour Code provisions. As it has been agreed, work is not only a source of income but it also may help one's recovery of employability and self-confidence.
