RESEARCH OBJECTIVE: The aim of the article is to present in abbreviated form the possibility of limiting the freedoms as well as human and citizen rights in states of emergency according to the Constitution of the Republic of Poland published in 1997, to compare the possibilities with the solutions established in Poland during the COVID-19 pandemic and finally to assess the constitutionality of these regulations. THE RESEARCH PROBLEM AND METHODS: The arguments are based on content analysis of constitutional solutions which give the possibility to limit citizens’ rights and freedoms. It also analyses and legally evaluates the regulations adopted by the government during the pandemic. THE PROCESS OF ARGUMENTATION: The considerations have a twofold structure – the first part presents constitutional possibilities of limiting rights and freedoms in states of emergency based on the Constitution and subject literature. The second part discusses the restrictions on rights and freedoms established in Poland during the pandemic, with an attempt to critically analyse them in terms of compatibility with the Constitution. RESEARCH RESULTS: Although the Polish Constitution precisely defines the rules and possibilities of limiting the rights and freedoms in states of emergency, its regulations have not been applied in practice. Normative acts which were introducing restrictions during the pandemic raise very serious reservations from the point of view of their constitutionality. CONCLUSIONS, INNOVATIONS, AND RECOMMENDATIONS: Laws limiting rights and freedoms during the pandemic not only break the rules of the legal system and increase legislative chaos but also undermine citizens’ trust in the law. A lot of people have been fined for not respecting unconstitutional restrictions which, as a result, might lead to a series of claims for damages against the state. Polish post-pandemic society may no longer be as sure of the inviolability of the rights guaranteed by the Constitution.

CEL NAUKOWY: Artykuł ma na celu przedstawienie w skrótowej formie możliwości ograniczania wolności i praw człowieka i obywatela w stanach nadzwyczajnych w ujęciu Konstytucji RP z 1997 roku, a następnie zestawienie z nimi rozwiązań przyjętych w Polsce w trakcie pandemii COVID-19 oraz próba oceny konstytucyjności tychże regulacji. PROBLEM I METODY BADAWCZE: Wywód opiera się na analizie treści rozwiązań konstytucyjnych, limitujących możliwość ograniczania praw i wolności. Poddaje również analizie i ocenie prawnej unormowania przyjęte przez rządzących w czasie pandemii. PROCES WYWODU: Rozważania mają dwudzielną strukturę – w pierwszej części na podstawie ustawy zasadniczej i literatury przedmiotu omówiono konstytucyjne możliwości ograniczania praw i wolności w stanach nadzwyczajnych. W drugiej części omówiono ograniczenia praw i wolności wprowadzone w Polsce podczas pandemii, a także podjęto próbę ich krytycznej analizy względem zgodności z Konstytucją. WYNIKI ANALIZY NAUKOWEJ: Chociaż polska ustawa zasadnicza precyzyjnie określa zasady i możliwości ograniczenia praw i wolności w stanach nadzwyczajnych, to jej unormowania nie znalazły zastosowania w praktyce. Akty normatywne, które wprowadzały ograniczenia w czasie pandemii, budzą bardzo poważne zastrzeżenia z punktu widzenia ich konstytucyjności. WNIOSKI, INNOWACJE, REKOMENDACJE: Przepisy ograniczające prawa i wolności w trakcie pandemii nie tylko łamią zasady systemu prawnego i zwiększają chaos legislacyjny, ale także podważają zaufanie obywateli względem prawa. Wielu ukarano za nieprzestrzeganie niekonstytucyjnych ograniczeń, istnieje zatem ryzyko, że nastąpi szereg pozwów przeciw państwu o odszkodowania. Polskie społeczeństwo postpandemiczne może zatem nie być tak samo pewne jak niegdyś nienaruszalności praw i wolności gwarantowanych ustawą zasadniczą.

Around twenty years ago Finnish economy plunged into deep recession, which was manifested in a rising unemployment rate and increasing public debt. Just a decade later Finland headed the ranking of world’s most technologically advanced countries and was the second most competitive country in the international arena. This enormous success happened mostly because the country took conscious efforts to develop and implement an original concept of knowledge-based economy, coupled with extensive involvement and support from the public at large. Finland’s model of information society harmoniously fits into the country’s welfare State system, incorporating humanistic values and principles of sustainable growth. Economic growth, achieved through innovative technologies, does not represent a goal in itself but, rather, is a means to welfare, security and social cohesion. At present, the Finnish model is faced with many challenges due to globalisation processes. However, it is interesting to look at the distinctive attributes of this model as it has brought numerous social and economic advantages: a successful information society helps to finance the welfare State whereas the welfare State produces superbly educated citizens, capable of leveraging the successes of the country’s knowledge-based economy.

Niespełna dwadzieścia lat temu fińska gospodarka popadła w głęboką recesję, objawiającą się m.in. znacznym wzrostem bezrobocia i długu publicznego. Już dekadę później Finlandia zajęła pierwsze miejsce w rankingu najbardziej rozwiniętych technologicznie krajów świata oraz drugie miejsce pod względem międzynarodowej konkurencyjności. Osiągnięcie tego ogromnego sukcesu było możliwe przede wszystkim dzięki świadomemu opracowaniu i wdrożeniu oryginalnej koncepcji gospodarki opartej na wiedzy, któremu towarzyszyło zaangażowanie i poparcie całego społeczeństwa. Fiński model społeczeństwa informacyjnego harmonijnie uzupełnia istniejący w tym kraju system państwa opiekuńczego, uwzględniając wartości humanistyczne i zasady zrównoważonego rozwoju. Wzrost gospodarczy, osiągany dzięki innowacyjnym technologiom, nie stanowi celu samego w sobie, lecz jest jedynie środkiem służącym do osiągnięcia dobrobytu, bezpieczeństwa i spójności społecznej. Obecnie, w związku z procesami globalizacji, przed fińskim modelem stoi wiele wyzwań, warto jednak się zapoznać z wyróżniającymi go cechami, gdyż jak dotąd przyniósł on wiele korzyści społecznych i gospodarczych - odnoszące sukcesy społeczeństwo informacyjne umożliwia finansowanie państwa opiekuńczego, a państwo opiekuńcze „generuje” świetnie wykształconych obywateli, zdolnych do kontynuowania sukcesów w dziedzinie gospodarki opartej na wiedzy.

The study refers to the occurrence of conflicts of interest on the capital market, which negatively affects the functioning of the capital market, limits its development potential, and may even affect the outflow of investors, particularly those providing liquidity in the market. Today, the social responsibility of business entities becomes something important. It is a specific determinant of the company’s image and the basis of its operation. Word = Institution “brokerage house” should be associated with competence, honesty, or righteousness resulting from observance of the law and ethics principles of conducted business. The existence of a set of regulations (the Code of Good Practice for Brokerage Houses, the Act on Counteracting Unfair Market Practices) relating to the functioning of brokerage houses, there are situations in business practice that are not used to develop a capital market, based on a conflict of interest. Brokerage firms are obliged, on the one hand, to: sell shares and, on the other hand, recommend buying them. “Manipulation on the market” would mean entering into transactions that give false, misleading signals about supply, demand, and prices of equity instruments. To avoid conflicts of interest, there are special procedures in brokerage offices that prevent co-operation between competing departments: chinese walls. Each office additionally has rules governing the flow and control of confidential information. Such information may not be available, for example, between primary and secondary market forces, between sales departments and analysis departments. The indicated issues were brought together, focusing on the possible consequences of conflicts of interest. It emphasizes the difficulty of bringing justice through the necessity of showing the causal link between the conflict of interest and the possible loss of the investor. Then solutions were identified to protect against the negative aspects of the conflict of interest, and the proposals were presented in their conclusions.

Celem artykułu było przeanalizowanie efektywności funduszy inwestycyjnych i stworzenie rankingu funduszy inwestycyjnych o najwyższej efektywności ekonomicznej. Przedstawiono zakres wyboru próbki testowej. Skuteczność funduszy inwestycyjnych oceniono za pomocą różnych miar ich oceny. Porównując uzyskane stopy zwrotu i ryzyko, mierzone odchyleniem standardowym, ze stopą zwrotu z giełdy, wybrano najbardziej rentowne fundusze. W rezultacie wykazano, że chęć inwestowania w fundusze inwestycyjne nie musi kończyć się inwestowaniem w te, które wydają się opłacalne, ale można przeprowadzić niezależną analizę.

The article aimed to analyze the effectiveness of investment funds and to create a ranking of investment funds with the highest economic efficiency. The scope of selection of the test sample is presented. The effectiveness of investment funds was assessed using various measures of their assessment. Comparing the obtained rates of return and risk, measured with a standard deviation, with the rate of return from the stock exchange, the most profitable funds were selected. As a result, it has been shown that the desire to invest in mutual funds does not have to end with investing in those that seem viable, but independent analysis can be done.
