The published text is the voice in the discussion referring to substantiation of protection of personality rights in Poland. There are tensions between the closed catalogue of the sources of law and the freedom of the courts in the protection of personal rights. One of the ways of solution of the conflict is to link the personal rights of immutable human needs described by Abraham Maslow. Maslow's hierarchy of needs is a motivational theory in psychology comprising a five tier model of human needs (physiological, safety, belongingness and love, esteem, self-actualization). The author analyzes the court decisions, in particular on family ties, the basic biological needs and deprivation of access to electricity and water. In particular, the author stresses that although self-realization can not be fully protected, it plays an important role in determining the limits of the protection of personal rights.

Przedmiotem artykułu jest wykazanie możliwości ochrony pierwszeństwa odkrycia naukowego za pomocą konstrukcji praw osobistych prawa cywilnego. Ochrona ta jest niezależna od ochrony utworu naukowego gwarantowanej przepisami prawa autorskiego. Wybór podstawy prawnej powództwa (wskazanie na konkretne prawo osobiste) nie wiąże sądu. Błędne powoływanie się na prawo autorskie do odkrycia nie jest przeszkodą do udzielenia ochrony odkryciu naukowemu za pomocą prawa cywilnego.

The purpose of this paper is to demonstrate the ability to protect the priority of scientific discovery with the construction of the personal rights of civil law. This protection is independent of the protection of scientific work on the basis of copyright law. The choice of the legal basis of the claim (indicate a specific personal right) does not bind the court. Incorrect reference to the copyright of the discovery is not an obstacle to the granting of protection scientific discovery by civil law.
