This paper seeks to provide a systematic analysis of the changing relations between financial institutions, banks in particular, and individuals in the 20th and 21st centuries. The first part of the study presents the history of relations between the state, financial institutions and individuals in the twentieth century, while the second part is devoted to the changes that have taken place internationally in this area in the 21st century in the activities of non-state actors, including financial institutions, as more and more often obligations in the field of human rights protection are being emphasised. The attribution of such responsibility indicates the fact that the international community is seeking to strengthen the protection of individual autonomy. This is also confirmed by the analysis of the final observations formulated by treaty bodies functioning within the UN system of human rights protection.

Celem pracy jest przedstawienie ewolucji relacji zachodzących pomiędzy instytucjami finansowymi, w szczególności bankami, a jednostką w XX i XXI w. (oraz, w niezbędnym zakresie, również z państwem jako regulatorem sektora finansowego, a zarazem podmiotem na którym spoczywa pierwszorzędna odpowiedzialność za zagwarantowanie praw człowieka ustanowionych w traktatach). Pierwsza część pracy przedstawia historię rozwoju relacji pomiędzy państwem, instytucjami finansowymi a jednostką w XX w. Druga część poświęcona jest zmianom, jakie w tym zakresie zaszły w XXI w. na płaszczyźnie międzynarodowej – w działalności podmiotów niepaństwowych, w tym instytucji finansowych, coraz częściej akcentuje się bowiem zobowiązania w zakresie ochrony praw człowieka. Przypisanie takiej odpowiedzialności wskazuje, że społeczność międzynarodowa dąży do wzmocnienia ochrony autonomii jednostki. Potwierdza to również poczyniona w pracy analiza uwag końcowych organów traktatowych funkcjonujących w ramach ONZ-owskiego systemu ochrony praw człowieka.

This paper seeks to provide a systematic analysis of the changing relations between the financial institutions (mainly banks) and individuals throughout the XX and XXI centuries. The topic requires, however, to address the role of the state as well – it is the government which acts as a regulator of the financial markets and remains bound by the human rights treaties. The first part of the paper is sketching necessary historical context while the second part investigets some of the recent developments within the international human rights law. The threats to the enjoyment of human rights posed by non-state actors, including financial institutions, provoke a question over their responsibility in this matter. Endorsement given to the UN Guiding Principles on Business and Human Rights (2011) indicates the direction of evolution towards strengtening the protection of the individual.
