Apostolic Letter motu proprio Mitis Iudex Dominus Iesus by Holy Father Francis which reforms the canons of the Canon Law concerning nullity of marriage process was issued on 8 September 2015. Its aim is to provide proper justice in the Church and it meets the need of simplifying the marriage nullity process, while giving protection of the unity of faith and of marriage discipline. This article is an attempt to present basic presumptions and novelties of the process reform which was introduced by Francis.

In glottodidactical practice, the introduction of references to children's poems may be an efficient way to stimulate students. The poems of Brzechwa and Tuwim contain numerous references to children's folklore, similarly present in the works of Lewis Carroll and Edward Lear who primarily used nursery rhymes as their source of inspiration. Poems and language games of this sort were collected by the brothers Grimm, in French children's folklore by Paul Hazard, as well as Kornel Czukowski, who analyzed and used Russian children's folklore in his own creative output. Elements of children's folklore can also be found in works of multiple languages and writers such as in; Danish (Andersen), Swedish (Lingren), Czech (Čtvrtek), and Italian (Rodari). Brzechwa and Tuwim as poets who tailored their work for child audiences, capitalized from their experiences gained through many years of cabaret performances (as evidenced by satiric portraits of adult characters), drew upon the works of Lear and Milne as well as English absurdist humor, in order to carnivalize reality. The comicality of Brzechwa and Tuwim can be understood readily by students who are beginning to discover the intricacies of the Polish language.

Every marriage annulment process, regardless of its form, starts from summons. A judge cannot examine any case until the petition is put forward by the one who can challenge the validity of marriage. Spouses and a promotor of justice have an unchangeable right to challenge the validity of marriage in some circumstances. This article is an attempt to define and determine the circumstances in which the parties can file for a shortened process, or the so called bishop process.

Taking up the issue of depresion as a cause for declaring a marriage null and voit, the author begins his reflections with a look at psychosis. From the point of view of marriage validity, of special significance is also the analysis of depresion with very particular medical aspects. The cause of nullity of a marriage discussed here, in turn, requires a rather precise definition of depresion and the factors by which it may be triggered. The last part of the author’s reflections is devoted to the analysis of canon 1095 of the Code of Canon Law, especially to the definition of cases when this depresion is serious enough to exclude marriage validity.

L’immaturité émotionnelle en tant que cause (définie par canon 1095 du Code du Droit Canonique) de l’incapacité mentale du sujet à exprimer le consentement matrimonial d’une manière valable constitue l’un des problèmes les plus controversés et en même temps actueles dans le domaine du droit matrimonial. Dans notre étude, en se basant sur la notion de l’immaturité émotionnelle élaborée par la psychologie et la jurisprudence romaine, essaie de définir l’influence destructive de cette immaturité sur la personalité de l’homme et, surtout, sur sa liberté de décider. Cette maturité ne permettrait pas de connaître le sujet du consentement matrimonial ni de juger les arguments „pour” et „contre” le mariage; elle peut réduire enfin le libre arbitre de l’homme de cette manière qu’il ne serait pas capable de prendre la décision rationnelle et mûre, et, même, s’il la prenait, son immaturité émotionnelle rendrait incapable de réaliser ce but. Cette immaturité émotionnelle est envisagée dans coteste „gravis defectus discretionis iudicii” (on souligne ici le manque de la liberté interne du sujet) et dans celui „incapacitas assumendi obligationes matrimonii essentiales”. C’est le caractère de cette immaturité qui est le plus important. Comme le souligne le Pape Jean Paul II elle doit se distinguer visiblement d’une simple difficulté qu’un sujet peut manifester dans ses relations interpersonnelles. Elle doit être la vraie incapacité d’un sujet à créer „consortium totus vitae” c’est–à–dire le mariage dans toute sa complexité et plénitude.

According to can. 1096 § 1 Code of Canon Law of the 1983 if the marriage harmony is going to come into existence, both sides should be able to dispose of at least minimal knowledge about state of marriage. In accordance with can. 1096 § 2 after reaching maturity, such knowledge is acquired. So what is really the minimal knowledge concerning marriage and what does it refer to in a subjective scope? Legislator defines it as a general concept of marriage with two enumerated aspects: relationship of a man and a woman, which is based on constancy and is oriented towards bearing descendants by a sexual cooperation.

Wolność ta może być jednak w niektórych przypadkach ograniczona różnymi uwarunkowaniami psychicznymi człowieka, które pozbawiają go zdolności krytycznej i możności dokonania wyboru. Tematem niniejszego artykułu jest wpływ zaburzeń osobowości na tzw. wolność wewnętrzną osoby, w kontekście wyrażanej przez nią zgody małżeńskiej.

The Code of Canon Law of 1983 classifies the reasons for marriage invalidity in three different categories: diriment impediments, defects in matrimonial consent and lack or defect of canon form. Among different defects in matrimonial consent, in its can. 1101 § 2, the Code of Canon Law enumerates simulations. Simulation signifies that a person contracting marriage expresses marital agreement merely on the surface, excluding in reality, through a positive act of will, the marriage itself, some essential elements of or an essential property of marriage. The grounds for excluding the sacramental dignity constitute a novum as compared to the Code of Canon Law of 1917. The present article attempts to look at the relation between the lack of faith and the exclusion of marriage sacramental dignity, with the consideration of marriage invalidity.

The Code of Canon Law of 1983 referring to hierarchical recourse, does not limit it merely to appeal to the Congregation of Roman Curia, but it refers to each recourse placed to higher executive administration organ. The subject of our interest, however, is the hierarchical recourse placed in front of the Roman Curia after exhausting the hierarchical path of lower grades. Because according to can. 1737 § 1 Code of Canon Law, anyone who considers himself injured with the decree can place recourse to hierarchic superior of the one who delivered the decree. Therefore we are speaking about the subject of the recourse, the motive, as well as, the procedure to be undertaken in order to obtain the desired goal, appeal or change of harmful act.

After it has been validly received, sacred ordination never becomes invalid. A cleric, however, loses the clerical state by a judicial decision or administrative decree which declares the invalidity of sacred ordination, by the legitimate infliction of the penalty of dismissal, by a rescript of the Apostolic See which is granted by the Apostolic See to deacons only for serious reasons and to presbyters only for the most serious reasons.
