W pracy podkreślono i zwrócono uwagę na problem terminologii używanej w Polsce w stosunku do osób z uszkodzeniem funkcji i/lub struktur organizmu w następstwie choroby lub urazu. Wskazano na szereg aspektów, mających wpływ na definiowanie tych osób i związane z nimi następstwa prawne, organizacyjne, rehabilitacyjne, a mające na celu umożliwienie tym osobom pełnienie ról społecznych. Starano się wykazać niezasadność istnienia wielu systemów orzeczniczych opartych na różnych kryteriach oceny obowiązujących w różnych instytucjach zabezpieczenia społecznego. Aby orzecznictwo lekarskie było jednorodne, podporządkowane jednakowym zasadom i regułom prawnym, jawi się potrzeba wydzielenia go z obecnych struktur i powołania jednej instytucji dla oceny niepełnosprawności i jej stopni, która służyłaby wszelkim instytucjom zajmującym się szeroko rozumianym zabezpieczeniem społecznym. Zwrócono także uwagę na nowe możliwości orzecznictwa lekarskiego w związku z rozpoczynającą się w Polsce implementacją klasyfikacji ICF (International Classification of Functioning, Disability and Health).

Medical certification in the system of social security in respect of ilness results Summary In the hereby work the author emphasizes and brings into the focus the problem of terminology used in Poland with regard to persons with impaired functions or/and structures of organism as an aftermath of illness or injury. A range of aspects are pointed to which have an impact on defining such persons, and the legal, organizational and rehabilitation-related effects of such definition, whose goal is enabling those people to fulfill social roles. One tries to prove here the purposelessness of there being many systems of certification, basing on many criteria of estimation, valid in different institutions of social security. In order for the medical certifying system to be uniform as well as subordinate to uniform principles and legal regulations, there appears a need of separating it from the present structures and establishing one institution for estimating disability and its degrees, which can serve all kinds of institutions dealing with the broadly understood social security. Also the new possibilities of medial certification are brought into attention in connection with the newly started in Poland implementation of ICF classification (International Classification of Functioning, Disability and Health).
The article shows the role of comprehensive rehabilitation in restoring good health, ability and in social and professional activation of the growing population of the disabled. The author discusses changes that have occurred in the approach to disability over time. The paper stresses the importance of comprehensive rehabilitation including medical, social and professional rehabilitation due to the fact that rehabilitation results depend on the work of a team of professionals from different fields working under the direction of a doctor specialised in rehabilitation medicine. It also presents acts of international and domestic law pursuant to which Poland should provide the disabled with equal and quick access to comprehensive rehabilitation, thus enabling them to participate in all aspects of life as fully as possible.
Artykuł o charakterze polemicznym. Autorzy przytaczają przykłady dawnych i aktualnych aktów prawnych dotyczących zabezpieczenia społecznego, zawierających określenia i terminy niejednoznaczne lub niejasne, powodujące dowolność ich interpretacji. Zwracają uwagę na potrzebę załączania słowników terminów i określeń użytych w aktach legislacyjnych. Podejmują polemikę dotyczącą pojęcia osób niepełnosprawnych, wskazując jego nieodpowiedniość i niezgodność z Konwencją WHO z 2006 r.

In the polemic article the authors cite examples of past and current legislation on social security, containing ambiguous or unclear definitions and terms, resulting in freedom of their interpretation. They draw attention to the need to add vocabularies containing terms and definitions used in legislative acts. They gainsay the idea of people with disabilities, indicating its inadequacy and inconsistency with the WHO Convention, 2006.
Dopiero w drugiej połowie XX wieku podjęto próby kompleksowych rozwiązań problemów osób niesprawnych. Dotychczas niepełnosprawność, jako następstwo choroby lub urazu, rozpatrywano z medycznego punktu widzenia, traktując ją jako problem jednostkowy osoby wymagającej odpowiedniej opieki medycznej, mającej na celu poprawę stanu zdrowia i funkcjonowania organizmu. Od rezolucji XXIX Światowego Zgromadzenie Zdrowia (1976 r.) trwały prace zakończone w 2001 r. przyjęciem ostatecznej wersji nowej Klasyfikacji pod nazwą: Międzynarodowa Klasyfikacja Funkcjonowania, Niepełnosprawności i Zdrowia (ICF – ang. International Classification of Functioning, Disability and Health). Jest ona składnikiem komplementarnych względem siebie klasyfikacji dotyczących zdrowia i czynników z nim związanych, zaakceptowanych przez WHO i polecanych do stosowania we wszystkich krajach świata. ICF nie jest klasyfikacją ludzi, natomiast jest klasyfikacją cech charakterystycznych stanu zdrowia człowieka w kontekście jego indywidualnej sytuacji życiowej oraz wpływów otaczającego środowiska. Przedstawiono charakterystyki podstawowych składników klasyfikacji i wzajemne ich uwarunkowania, przewidywane dalsze kierunki jej rozwoju, zakres jej wdrażania w krajach Europy (także w Polsce). Zaprezentowano szereg zalet szerokiego jej stosowania. ICF ocenia funkcjonowanie i niepełnosprawność w skali jakościowej i ilościowej, umożliwia zapis w języku międzynarodowym w formie elektronicznej (kodów), pozwala na porównanie wyników w skali jednostkowej i makro, ale także w różnych okresach. Może być narzędziem nie tylko statystycznym, ale również klinicznym, badawczym (zwłaszcza w działaniach wielodyscyplinarnych zespołów diagnostyczno-terapeutycznych), edukacyjnym, ekonomicznym, a także narzędziem przydatnym dla celów polityki społecznej. Not until in the second half of the 20th century, attempts have been made to introduce comprehensive solutions of problems of the disabled. So far, disability, as a consequence of illness or injury, has been considered from a medical point of view, and treated as an individual problem of person requiring appropriate medical care, to improve health and functioning of the body. Since the resolution of the XXIX World Health Assembly (in 1976), efforts have been made and completed in 2001 with the adoption of the final version of the new Classification, namely the International Classification of Functioning, Disability and Health (ICF). It stands for a component of complementary to each other classifications of health and the related factors, accepted by WHO and recommended for use in all countries of the world. ICF is not a classification of people, but it is a classification of the characteristics of human health in the context of the individual circumstances and influences of the surrounding environment. In the article the characteristics of the basic components of classification and their mutual determinants, expected future directions of its development and the scope of its implementation in Europe (including Poland) are presented. A wide range of benefits for its wide application is also shown. ICF uses qualitative and quantitative methods to measure functioning and disability, enables recording in the international language and in electronic form – the codes, allows for the comparison of the individual and macro level results, and at different times as well. It can be a statistical, clinical, research (especially in the activities of multi-disciplinary diagnostic and therapeutic teams), educational, and economic tool, that can be used in social policy as well.

Obecna koncepcja niepełnosprawności zakłada, że stopień niepełnosprawności jest wypadkową stanu zdrowia fiycznego i psychicznego oraz warunków środowiskowych, w których żyje osoba niepełnosprawna. Dlatego również na społeczeństwie spoczywa odpowiedzialność za taką modyfkację środowiska, aby poprawie uległy warunki uczestnictwa i aktywności osób niepełnosprawnych w życiu społecznym i zawodowym. Cel. Celem pracy jest przedstawienie problematyki rehabilitacji osób niepełnosprawnych i kwestii związanych z ich zatrudnieniem. Materiał i metoda. Oparto się na danych opublikowanych przez Zakład Ubezpieczeń Społecznych (ZUS), Kasę Rolniczego Ubezpieczenia Społecznego (KRUS) i Państwowy Fundusz Rehabilitacji Osób Niepełnosprawnych (PFRON), biuro Pełnomocnika Rządu ds. Osób Niepełnosprawnych oraz na wynikach Narodowego Spisu Powszechnego Ludności i Mieszkań przeprowadzonego w Polsce w 2011 roku. Przeanalizowano ponadto akty prawa krajowego i międzynarodowego z ostatnich kilkunastu lat. Wyniki: W 2013 roku w Polsce rentę z tytułu niezdolności do pracy pobierało 1 075 000 osób., zaś rentę z tytułu niezdolności do pracy w gospodarstwie rolnym otrzymywały 216 373 osoby. Według Badania Aktywności Ekonomicznej Ludności Polski (BAEL) w 2013 roku aktywnych zawodowo było 27,3% osób niepełnosprawnych w wieku produkcyjnym. Istotne znaczenie ma zapewnienie osobom niepełnosprawnym zdobycia lub utrzymania zatrudnienia, a więc możliwie pełnej integracji społecznej. Wydane na ten cel pieniądze są inwestycją, która się zwraca, a nawet daje korzyści społeczne i ekonomiczne. Podsumowanie, Konieczne jest holistyczne podejście i koordynacja całego procesu leczenia, rehabilitacji i zatrudnienia osób niepełnosprawnych uwzględniające współodpowiedzialność pracodawcy, połączenie usług medycznych, spo- łecznych i zawodowych, odpowiednie doradztwo, zastosowanie modelu biopsychospołecznego (ICF) w ocenie efektów rehabilitacji osób niepełnosprawnych.

Introduction. According to the current concept of disability the degree of impairment is a product of physical and psychological health as well as environmental conditions in which a disabled person lives. Therefore, it is also the society that is responsible for modifying the environment so as to improve the conditions of participation and activity of the disabled persons in social and professional life. Objective. The objective of this work is to present the problem of rehabilitation of persons with disabilities and issues related to their employment. Materials and method: The work is based on data published by ZUS (the Polish Social Insurance Institution), KRUS (the Agricultural Social Insurance Fund), PFRON (the State Fund for Rehabilitation of Disables Persons), Offi of the Government Plenipotentiary for Disabled People and on the results of the 2011 Polish Census of Population and Housing. Also acts of Polish and international law from the last dozen of years have been analysed. Results. In 2013 in Poland, 1 075 000 people received the inability to work benefi and 216 373 persons received the benefi related to inability to work on a farm. According to the Polish Research on Economic Activity of the Population (BAEL), 27.3% of disabled persons in the working age led an active professional life in 2013. It is crucial to ensure that the disabled persons access or maintain employment and thus to provide for their largest possible social inclusion. The expenses on this are an investment that pays back and even generates social and economic profis. Conclusion. It is necessary to adopt a holistic approach and to coordinate the entire process of treatment, rehabilitation and employment of persons with disabilities, taking into account employer’s co-responsibility, combination of medical, social and vocational services, appropriate counselling and application of a biopsychosocial model (ICF) in evaluating the effcts of rehabilitation of the disabled persons.
Background In Poland average life expectancy extends, while the number of the elderly who are active in the labor market decreases. Material and Methods The study population consisted of 429 people aged 50–70 years old living in the community of south-eastern Poland. The respondents were divided into 2 study groups: group I – late middle age (50–60 years old) and group II – early old age (61–70 years old). With the use of questionnaires they were given, we obtained their socio-demographic data, assessed their cognitive and emotional state, as their physical activity levels. We used the Tinetti test to assess their gait and balance. Results We did not find statistically significant difference in cognitive functioning between the studied groups (p = 0.109). Moreover, there was no significant relationship between belonging to an age group and suffering from depression (p = 0.06) as well as no major differences were observed in the general level of physical activity in relation to age (p = 0.112). Our study found that most of our subjects, regardless of gender, declared their willingness to continue professional work after reaching retirement age. Conclusions The results of own research did not show significant differences in psychophysical state between people in late middle age and at the beginning of old age. Most of the researched participants declared their willingness to continue professional work. Due to changing demographic conditions, it is becoming an important issue to maintain the highest possible level of professional activity of older people in the labor market in Poland. Background The increasing number of people receiving benefits due to incapacity for work is a heavy burden for the state budget. In order to reduce the scale of this phenomenon, the Social Insurance Institution (ZUS) carries out a rehabilitation program as part of disability pension prevention. Material and Methods The study was based on the analysis of medical documentation of 607 patients rehabilitated at the Saint Queen Jadwiga’s Regional Clinical Hospital No. 2 in Rzeszow, as part of the ZUS prevention of disability pension program in 2011−2013. Medical documentation included the medical history and results of the Functional Test recommended by ZUS. Two years after the completion of rehabilitation, a telephone check was conducted among 118 rehabilitated patients to assess their occupational status. Results The analysis of the Functional Test documentation showed that in all groups of wykorzystująpatients included in the rehabilitation program, as well as those among whom the control was carried out, the majority were people with post-exercise pain, full physical fitness, slight mobility limitation, full efficiency in everyday activities, correct strength of muscles and moving abilities, as well as normal psychosocial efficiency. The vast majority of them received a recommendation regarding work in a properly-adjusted position. It was shown that in the 2-year observation period, the percentage of professionally active people increased from 56% to 61.02%. Conclusions The most important factors determining the return to work include psychosocial efficiency and the level of pain. Med Pr. 2019;70(4):459–73

Wstęp Wzrastająca liczba osób pobierających świadczenia z tytułu niezdolności do pracy jest dużym obciążeniem budżetu państwa. W celu zmniejszania skali tego zjawiska Zakład Ubezpieczeń Społecznych (ZUS) realizuje program rehabilitacji w ramach prewencji rentowej. Materiał i metody Badanie przeprowadzono na podstawie analizy dokumentacji medycznej 607 pacjentów rehabilitowanych w latach 2011−2013 w Klinicznym Szpitalu Wojewódzkim nr 2 im. św. Jadwigi Królowej w Rzeszowie w ramach prewencji rentowej ZUS. Dokumentację medyczną stanowiła historia choroby i wyniki rekomendowanego przez ZUS Testu funkcjonalnego. Po 2 latach od zakończenia rehabilitacji (2013−2015) przeprowadzono telefoniczne badanie kontrolne dotyczące losów zawodowych rehabilitowanych pacjentów, w którym wzięło udział 118 osób. Wyniki Analiza dokumentacji dotyczącej postępów usprawniania po zakończeniu leczenia z wykorzystaniem Testu funkcjonalnego wykazała, że we wszystkich grupach pacjentów, u których zostało przeprowadzone badanie końcowe, przeważały osoby, u których wystąpił ból powysiłkowy, z pełną wydolnością fizyczną, o nieznacznym ograniczeniu ruchomości, z pełną sprawnością w zakresie czynności dnia codziennego, prawidłową siłą mięśniową, zdolnościami lokomocyjnymi i prawidłową sprawnością psychospołeczną. Zdecydowana większość badanych otrzymała rekomendację pracy na przystosowanym stanowisku. Wykazano także, że w dwuletnim okresie obserwacji odsetek badanych aktywnych zawodowo zwiększył się z 56% do 61,02%. Wnioski Na podstawie wyników Testu funkcjonalnego stwierdzono, że do najważniejszych obszarów warunkujących powrót do pracy należą sprawność psychospołeczna i poziom odczuwanych dolegliwości bólowych.
