The article focusses on the issue of using off-label medical products. The paper analyses the current views of the doctrine and the jurisprudence on the admissibility of using drugs inconsistently with the characteristics of the medical product. The article discusses the possibility of qualifying the use of off label drugs as a medical experiment based on the premise of innovative therapy. The author also outlines the issue of the doctor’s responsibility for prescribing off-label medical products.

Artykuł poświęcony jest problematyce stosowania produktów leczniczych off-label. Przedstawiono w nim aktualne poglądy doktryny oraz orzecznictwo w zakresie dopuszczalności stosowania leków niezgodnie z charakterystyką produktu leczniczego. W artykule zostały podjęte rozważania o możliwości zakwalifikowania stosowania leków off-label jako eksperymentu medycznego w oparciu o przesłankę nowatorstwa terapii. Autor przedstawił również zarys problematyki odpowiedzialności lekarza za przepisywanie produktów leczniczych off-label.
