The analysis of labour market shows that some categories of people are at high risk of being unemployed. It seems to be a good reason to give them priority when it comes to the forms of support provided for the unemployed. Moreover, legislator shows that some forms of professional activity of unemployed are addressed only for these groups and they are authorised for financial benefits. This kind of differentiation of the unemployed status does not constitute a breach of the principle of equal treatment in access to employment and this kind of diversity is allowed on both domestic law and international levels. Issues presented in this article show that people over the age of 50 have special status on the job market.

Analiza rynku pracy pozwala na wyodrębnienie pewnych kategorii osób, które w szczególnym stopniu są zagrożone pozostawaniem poza zatrudnieniem. W stosunku do tych grup wydaje się uzasadnione traktowanie ich w sposób priorytetowy przy udzielaniu form wsparcia przewidzianych dla ogółu bezrobotnych. Ponadto ustawodawca wskazuje formy aktywizacji zawodowej skierowane wyłącznie do tych bezrobotnych, a także przewiduje w stosunku do nich specjalne działania osłonowe. Owa dyferencjacja statusu bezrobotnych nie stanowi naruszenia zasady równego traktowania w zakresie dostępu do zatrudnienia, a tego rodzaju zróżnicowanie jest dozwolone zarówno na gruncie prawa krajowego, jak i ponadnarodowego. W niniejszym artykule zostały omówione wybrane zagadnienia świadczące o szczególnym statusie osób bezrobotnych powyżej 50. roku życia.
