W artykule przedstawiono znaczenie konstytucyjnej zasady proporcjonalności w ocenie dopuszczalności ograniczeń reklamy zewnętrznej unormowanych w tzw. uchwale krajobrazowej. Opisano wartości-cele, których osiągnięciu służyć może uchwała, oraz wartości, którym uchwała ta może zagrażać (prawo własności, swoboda działalności gospodarczej). Dokonano analizy dopuszczalności poszczególnych rodzajów restrykcji odnoszących się do tablic i urządzeń reklamowych, w tym szyldów. Zwrócono uwagę na potrzebę uwzględnienia interesów przedsiębiorców.

The article analyzes the importance of the constitutional principle of proportionality in the assessment of the legality of the restrictions on outdoor advertising introduced under the Communal Landscape Acts. Issues described include the values, the protection of which is the aim of Communal Landscape Acts, as well as the values at risk from the legislated norms (property rights, economic freedom). The admissibility of various restrictions on advertising billboards and devices (including on-premise advertising) has been analyzed. The need to respect the interests of enterprises has been noted.
Artykuł poświęcony jest unormowaniu zarządzania ruchem w rozporządzeniu 2015/2120. Przedstawiono w nim podstawowe aspekty techniczne ruchu internetowego i scharakteryzowano stosowane w rozporządzeniu pojęcia, w szczególności zarządzania ruchem i środków zarządzania ruchem. Dokonano szczegółowej analizy zgodnych z rozporządzeniem środków zarządzania ruchem zarówno odpowiednich, jak i wyjątkowych. Opisano także te spośród stosowanych przez dostawców usługi dostępu do Internetu postanowień umownych i praktyk handlowych, niebędących środkami zarządzania ruchem, które są do nich funkcjonalnie zbliżone.

The article deals with traffic management under Regulation 2015/2120. Basic technical aspects of Internet traffic have been described. The terms used in Regulation 2015/2120 have been characterized, in particular traffic management itself and traffic management measures. Both reasonable and exceptional traffic management measures in line with Regulation 2015/2120 have been analyzed in detail. Contractual obligations and commercial practices, which do not constitute traffic management measures but are functionally similar to them, have also been mentioned.
Neutralność sieciowa oznacza jednakowe traktowanie wszystkich komunikatów przesyłanych w sieci Internet niezależnie od treści, wykorzystanej aplikacji lub usługi, urządzenia oraz adre-su nadawcy i odbiorcy. Neutralność sieciowa służy rozwojowi innowacyjnych treści i aplikacji w Internecie oraz ochronie wolności słowa i komunikowania się. Jej podstawowymi gwaran-cjami są: konkurencja i przejrzystość rynku usług dostępu do Internetu oraz łatwość zmiany dostawcy usług. Do współczesnych zagrożeń neutralności zaliczają się praktyki polegające na zarządzaniu ruchem w publicznych sieciach telekomunikacyjnych, integracja pionowa sieci z treś-ciami i aplikacjami, zero-rating, a także dążenia do zmiany modelu biznesowego działalności operatorów sieci. Środki techniczne stosowane przy zarządzaniu ruchem mogą także zagra-żać ochronie prywatności. Odpowiedzią na te zagrożenia stały się przepisy uchwalone w nie-których państwach członkowskich UE. Stosowne rozporządzenie ma zostać również przyjęte na poziomie unijnym.

Network neutrality means that all electronic communications passing through a network are treated equally, independent of their content, application, service, device, or sender and receiver addresses. Network neutrality serves to promote the development of innovative online content and applications. It also plays an important role for the freedom of expression and the freedom to communicate. The basic requirements for network neutrality include: competition on the Internet access services market and its transparency, as well as ease of changing the provider of Internet access services. Current threats to network neutrality include: network management in public communications networks, vertical integration of network and content layers, zero-rating, as well as the proposals submitted by network operators to change their business model. Technical means employed in network management pose threats to the privacy of end-users. To counter these threats, several EU Member States have enacted strict national network neutrality laws. A draft Regulation on the open Internet has also been proposed on the EU level.
The European consumer policy relies on the ideal of consumer empowerment, which involves providing all consumers with detailed information on the goods on offer. This policy also applies to the electronic communications sector, and empowering consumers who are the end-users of internet access services. The author reviews behavioural law and economics literature that pertains to consumer empowerment and applies the resulting insights to interpret Article 4 (1) of Regulation 2015/2120 laying down measures concerning open internet access in a way that would truly empower the sophisticated consumers. The author also proposes advising or obliging the providers of internet access services to label those services to provide even the unsophisticated consumers with meaningful and understandable information

La politique européenne des consommateurs repose sur l’idéal de l’autonomisation des consommateurs (consumer empowerment), qui consiste à fournir à tous les consommateurs des informations détaillées sur les produits proposés. Cette politique s’applique également au secteur des communications électroniques et habilite les consommateurs qui sont les utilisateurs finaux des services d’accès à Internet. L’auteur passe en revue la littérature sur les analyses économiques du droit relative à l’autonomisation des consommateurs et applique les idées qui en résultent pour interpréter l’article 4, paragraphe 1, du règlement 2015/2120 établissant des mesures relatives à l’accès ouvert à l’internet pour le bénéfice des consommateurs sophistiqués. L’auteur propose également de conseiller ou d’obliger les fournisseurs de services d’accès Internet à étiqueter ces services afin de fournir aux consommateurs moins sophistiqués des informations utiles et compréhensibles.
Zero-rating, czyli oferowanie w ruchomych sieciach telekomunikacyjnych nielimitowanego dostępu do pewnej zawartości internetowej, przy jednoczesnym objęciu wszelkiej pozostałej zawartości miesięcznym limitem transferu danych, stanowi jedno z węzłowych zagadnień dyskusji o neutralności sieciowej. W tekście przedstawiono rodzaje zero-ratingu oraz negatywne i pozytywne konsekwencje jego stosowania. Te pierwsze wiążą się głównie z potencjalnie pozytywnym wpływem na konkurencję pomiędzy dostawcami usług dostępu do Internetu, te drugie zaś – z zagrożeniem dla dalszego rozwoju Internetu jako siły napędowej innowacji. Wskazano, że zero-ratingu zakazuje się jako groźnego dla neutralności sieciowej nawet w państwach rozwijających się, mimo iż właśnie w nich może on powodować najszersze, pozytywne skutki społeczne. Na podstawie wykładni przepisów rozporządzenia o otwartym Internecie z uwzględnieniem projektu wytycznych BEREC ustalono, że zero-rating nie jest dopuszczalny w Unii Europejskiej w ramach usługi dostępu do Internetu, a także, że nie może być uznany za rodzaj usługi specjalistycznej.

Zero-rating is the practice of offering unlimited access to certain internet content to data plan subscribers in mobile communication networks. It is pertinent to the concept of network neutrality. The article explains the various types of zero-rating and presents their positive and negative consequences. The positives relate most of all to a beneficial influence on the competition between providers of internet access services. The negatives consist in a detrimental influence on the development of innovative internet content. Zero-rating is considered a threat to network neutrality even in developing countries, even though it is there that social development might benefit the most from it. The article includes an analysis and legal interpretation of the provisions of the open internet regulation, leading to the conclusion that zero-rating is not allowed in the EU in internet access service offers. It may also not be considered a type of a specialised service.
