Przedmiotem rozważań jest prawna dopuszczalność stosowania instrumentarium zarządzania jakością przez jednostki samorządu terytorialnego. Z analizy podejmowanych przez nie działań wynika, że w swojej praktyce wykonują czynności nakierowane na osiąganie jakości w różnych obszarach. Potwierdzają ten fakt dostępne na stronach BIP informacje publiczne, opisujące np. wdrożenie danego systemu lub stosowanie konkretnej metody czy narzędzia zarządzania jakością. Oparcie funkcjonowania jednostek samorządowych na zasadzie związania prawem determinuje badanie podstaw prawnych pod kątem stosowania instrumentarium zarządzania jakością przez jednostki samorządu terytorialnego, w celu ustalenia treści normy prawnej, z której wynika kompetencja do podjęcia działań powiązanych z jakością. W konsekwencji artykuł potwierdza tezę o obowiązywaniu prawnej dopuszczalności stosowania instrumentarium zarządzania jakością przez jednostki samorządu terytorialnego, wskazuje na jej zakres oraz formułuje pojęcie instrumentarium zarządzania jakością w kontekście funkcjonowania samorządu terytorialnego.

The subject of the considerations is the use of quality management instruments by local government units. The analysis of their activities shows that in their practice they implement quality-oriented measures in different areas. This fact is confirmed by public information available on the BIP website, describing, for example, the implementation of a given system or the use of a specific methodology or quality management tool. The legal bases for the use of quality management tools by local and regional authorities need to be examined in order to determine the content of the legal provision giving them the power to implement quality-related measures. Consequently, the article reaffirms the thesis on the legal admissibility of using the instruments of quality management by local government units, indicates its scope and formulates the concept of quality management instruments in the context of the functioning of local government.

As a result, they contribute to their efficient operation, shape structures the bodies function in, and determine the ways these structures operate in .

The legislator imposed on local government units the obligation to manage local government property, taking into account the criterion of special diligence. Its consequence is obliging property managers to thoroughly analyze all the premises underlying the taking of activities in this area, related to the use of property as intended, to achieve a specific purpose and to meet the needs of local government residents. This is justified by the nature of the property and the type of tasks it should serve to accomplish. Imposing the obligation to comply with special diligence on property managers is a solution that fits in with the postulate of protecting and securing property to ensure continuity of public tasks.

Ustawodawca nałożył na jednostki samorządu terytorialnego obowiązek zarządzania mieniem samorządowym z uwzględnieniem kryterium szczególnej staranności. Jego konsekwencją jest zobligowanie podmiotów zarządzających mieniem do wnikliwej analizy wszystkich przesłanek leżących u podstaw podejmowania czynności w tym zakresie, związanych z wykorzystaniem mienia zgodnie z jego przeznaczeniem, do realizacji określonego celu oraz dla zaspokojenia potrzeb mieszkańców wspólnot samorządowych. Jest to uzasadnione charakterem mienia oraz rodzajem zadań, których urzeczywistnieniu ma ono służyć. Nałożenie obowiązku przestrzegania szczególnej staranności na podmioty zarządzające mieniem jest rozwiązaniem wpisującym się w postulat ochrony i zabezpieczenia mienia dla zapewnienia ciągłości wykonywania zadań publicznych.

A statutory obligation to perform public tasks has been imposed on local government units - their own tasks, the purpose of which is to satisfy the needs of local communities. Therefore, local government units are also obliged to undertake such actions and select such legal instruments as to make their implementation effective, i.e. to achieve the intended objectives or at least pursue them. The effectiveness of tasks performed by local and regional authorities is affected by the fact that they are carried out at the appropriate level by local and regional authorities, by the proper allocation of tasks and responsibilities in accordance with the principles of decentralisation and subsidiarity, and by the definition of the internal administrative structure, creating tailor-made units for specific needs and effective management. Not without significance is also the issue of adequate funding sources, which often directly determines the effectiveness of the implementation of public tasks.

Na jednostki samorządu terytorialnego został nałożony ustawowy obowiązek wykonywania zadań publicznych - zadań własnych, których celem jest zaspokajanie potrzeb wspólnot samorządowych. W związku z tym jednostki samorządowe mają także obowiązek podejmowania takich czynności i wyboru takich instrumentów prawnych, aby ich realizacja była skuteczna, czyli osiągała zamierzone cele lub przynajmniej przybliżała się do nich. Na skuteczność działania organów jednostek samorządu terytorialnego wpływa: wykonywanie ich przez jednostki podziału terytorialnego odpowiedniego szczebla, właściwe przyporządkowanie zadań i kompetencji, zgodnie z zasadami decentralizacji i pomocniczości, ustalanie wewnętrznej struktury administracyjnej, tworząc jednostki dostosowane do specyficznych potrzeb i umożliwiające skuteczne zarządzanie. Nie bez znaczenia pozostaje także kwestia odpowiedniego finansowania, często bezpośrednio warunkująca skuteczność realizacji zadań publicznych.

Transformation of public administration, associated with the development of civilization, changes in the law, changes in the mentality of citizens, have given rise to a legal analysis of selected forms of action in terms of efficiency. Local government units perform various public functions. For this reason, to increase flexibility in the process of performing these tasks and improve the operation, they use the opportunity to interact with non-state actors. This co-operation is known as the privatization of public tasks. They also cooperate with private entities under the public-private partnership. In addition, they implement the principle of organizational flexibility of the administrative apparatus. Finally, they using systems, tools and methods of quality management. These activities are designed to implement the statutory obligations and improving efficiency.

Przeobrażenia administracji publicznej, związane z rozwojem cywilizacyjnym, zmianami porządku prawnego, świadomością adresatów wykonywanych zadań, stały się przyczynkiem do analizy wybranych form działania uregulowanych w obowiązujących przepisach prawnych pod kątem sprawności. Jednostki samorządu terytorialnego, które wykonują zróżnicowane zadania publiczne, w celu uelastycznienia procesu wykonywania tych zadań i usprawnienia działania, wykorzystują możliwości współpracy z podmiotami niepublicznymi, stosując rozwiązania prawne określane jako prywatyzacja zadań publicznych. Współpracują z podmiotami prywatnymi w ramach partnerstwa publiczno-prywatnego. Realizują w praktyce zasadę organizacyjnej elastyczności aparatu administracyjnego. Wreszcie, coraz częściej, stosują systemy, narzędzia, metody zarządzania jakością. Powyższe działania mają na celu realizację obowiązków ustawowych oraz podnoszenie sprawności działania.
