The subject of the considerations contained in the article is the analysis of selected issues related to the legal regulation regarding the civil law obligation to prevent damage that may result from mining plant operations. It is about the regulations contained in the Act of June 9, 2011, Geological and Mining Law, and to a certain extent also in the Act of April 23, 1964, the Civil Code. This analysis includes not only theoretical considerations, but also refers to the practice of applying the law. It contains a discussion and a critical assessment of the Supreme Court’s judgment of February 20, 2018.

Предметом рассуждений, содержащегося в статье, является анализ отдельных вопросов, связанных с правовым регулированием гражданско-правовой обязанности пре- дотвращать ущерб, который может возникнуть в результате работы горнодобывающихm предприятий. Речь идет о правилах, содержащихся в законе о геологическом праве и горном праве от 9 июня 2011 года, и в некоторой степени также в Гражданском кодексе от 23 апреля 1964 года. Этот анализ включает не только теоретические соображения, но также относится к практике применения закона. Он содержит обсуждение и критическую оценку решения Верховного суда от 20 февраля 2018 года.

L’oggetto delle considerazioni contenute nell’articolo è l’analisi di alcune questioni selezionate relative alla regolamentazione giuridica dell’obbligo di diritto civile di prevenire i danni minacciati dal movimento di un impianto minerario. Si tratta della normativa contenuta nella legge del 9 giugno 2011. Diritto geologico e minerario, e in qualche misura anche nella legge del 23 aprile 1964 del Codice Civile. Quest’analisi non comprende solo considerazioni teoriche, ma si riferisce anche alla pratica dell’applicazione della legge. Contiene una discussione e una valutazione critica della sentenza della Corte Suprema del 20 febbraio 2018.
